DLA Piper advises Northern Ireland water service on multi-million pound customer billing and contacts handling service
Leeds and Belfast - The Water Service in Northern Ireland has signed a contract with Crystal Alliance (a Xansa plc led consortium including Echo Managed Services Ltd and AMT-SYBEX) to provide billing and contact handling services.

The Water Service is an executive agency of the Department for Regional Development with responsibility for the collection of charges for water and wastewater services in Northern Ireland. Crystal Alliance will be responsible for sending out water bills, collecting revenue and providing call centre services. Later in the life of the seven-year contract Crystal Alliance will also be required to provide technical services to support Water Service's field force as it manages and maintains the water/wastewater infrastructure.

Water Service was given legal advice by a joint team from legal services organisation DLA Piper Rudnick Gray Cary ("DLA Piper") and local Belfast law firm, Carson McDowell. The team, led by Stewart James, a partner from DLA Piper's Technology, Media & Communications Group and supported by Alan Bissett, a partner from Carson McDowell's Business and Commerce Group, were responsible for drafting the contract and conducting legal negotiations with the bidders on behalf of Water Service.

Stewart said: "This has been a tremendous project to work on. It has been a very important project for Water Service and for Northern Ireland, boosting regional employment prospects in the process. It has also been a very important project for Carson McDowell and DLA Piper, complimenting the desire of both organisations to provide pan-Ireland services in this market space."

Alan Bissett added: "We are delighted to work in partnership with DLA Piper on this project and we believe we have been able to bring a high level of local expertise to it. This project is essential if Northern Ireland wants to create a more dynamic economy in the coming years and we are delighted to be contributing to the development of the infrastructure in Northern Ireland.

White & Case Appoints New Financial Services Advisory Partner
London, February 2, 2006 ... White & Case announces the appointment of financial services advisory lawyer Carmen Reynolds, who arrives at the Firm as partner on February 13, 2006. Her expertise covers virtually the entire spectrum of financial institutions advisory work, including wholesale and retail banking, investment banking, asset management, insurance, commodities, securities and investments.

Commenting on the hire, head of White & Case's London Capital Markets practice Josh Kiernan said, "Our European financial institution clients are facing an increasingly heavily regulated market and complex environment. One of the leading individuals in her field, Reynolds has a background that includes a mix of client and governmental work. In 1999 and 2000 she was instrumental in producing the main UK legislative framework for the financial markets in the UK. She has also been involved in commenting on draft pan-European directives in the financial institutions area.

Reynolds joins the Firm's Capital Markets practice from international law firm Norton Rose, where upon her appointment in 2001 she worked to establish a strong and highly regarded financial services practice group.

Reynolds's team will form part of the financial services practice that will also work closely with the litigation and regulatory investigations and enforcement team in London. She will work alongside the head of Dispute Resolution, Alistair Graham, in continuing to offer White & Case's clients a combined contentious regulatory and non-contentious regulatory and risk management service.

Warner Norcross to Sponsor SoVoSo
February 2, 2006) – Warner Norcross & Judd LLP is pleased to announce that the firm will be the premier sponsor of SoVoSó when it returns to Grand Rapids in February.
The a cappella group, which blends jazz, gospel, world music and R&B, will perform at St. Cecilia Music Society on Friday, Feb. 10, at 8 p.m. The Firm will also underwrite SoVoSó's performances at two area schools. SoVoSó will present a clinic to music students at 11:30 a.m. on Feb. 8 at East Grand Rapids High School and will also perform at a general school assembly at Union High School on Feb. 9 at 12:45 p.m.

The SoVoSó repertoire focuses on original compositions and other songs that present a global perspective, from Afro-Latin idioms to traditional jazz choral arrangements. SoVoSó, which means from the soul to the voice to the song, draws several of its members from Bobby McFerrin's successful a cappella group from the 1980s and 1990s.

"We are very pleased to sponsor SoVoSó's performances in Grand Rapids during Black History Month," said Douglas E. Wagner, managing partner of Warner Norcross. "We are particularly glad to be able to bring their imaginative and engaging performance to the local students.

Five to Watch: From Water Allocation to Shoreline Rights, Warner Norcross Spotlights Top Environmental Issues for 2006
February 2, 2006) – Water rights, air quality and wetlands development are among the top environmental issues that Michigan attorneys will grapple with in 2006, according to the Environmental Law Group of Warner Norcross & Judd LLP.
Warner's Environmental Law Group, which is one of the largest in the state, has identified five key environmental issues that will most impact Michigan businesses and residents in the year ahead - and likely beyond.

"As businesses look to mitigate the impact their operations have on natural resources, they face a series of challenges, including changes in state and federal regulations, increased demand for accountability and the growing need to move toward energy self-sufficiency," said John Byl, chair of the Firm's Environmental Law Group. "Over the past 12 months, a number of key environmental issues have made headlines in the media. Warner Norcross wanted to spotlight the top five most critical issues we will face as a state in 2006."

The top environmental issues are:


Water rights issues: As with many states around the country, Michigan will continue to grapple with water rights issues as communities struggle to develop workable, long-term plans that balance the demands of population growth against the need to preserve surface and groundwater resources. The issue is closely tied to population growth, land use and economic development, often pitting business and agricultural uses against the needs of growing communities. While the Michigan Court of Appeals recently ruled that there is no "public trust" in groundwater and many surface waters in the State, that has not stopped certain citizens groups from claiming public ownership of "our water."

Wetlands and other natural resources development: The U.S. Supreme Court will be considering two important wetlands jurisdiction cases originating in Michigan. The expected decision will likely have a profound impact on states, such as Michigan, with significant wetlands and other natural resources.

Air quality: Proposed changes in federal and state regulations related to air quality will have tremendous impact on a wide variety of industries over the next 18-24 months. Among other things, proposed regulations will change permit requirements that govern new construction projects for manufacturers and other businesses. Additionally, new requirements for sources of particulate matter and volatile organic compounds will create additional burdens for those sources.

Environmental due diligence: Recent changes to the EPA's regulations and guidelines that govern purchase of contaminated property under federal law now mandate that purchasers conduct "all appropriate inquiries" before purchasing property without resulting environmental liability, and to be eligible for federal Brownfield grant funds. These changes, which are the first federal regulatory standards for environmental site assessments, significantly change the concept of "all appropriate inquiry" used in the past - which will directly impact disclosure and liability issues of companies seeking to buy, sell or redevelop contaminated property.

Brownfield tax credits: The U.S. Supreme Court has agreed to hear a case that will determine whether Michigan and other states can continue to offer investment tax credits to businesses considering locating or expanding. A 2004 ruling by the U.S. Court of Appeals for the Sixth Circuit, which has jurisdiction over Michigan, ruled that the tax credits - which figure prominently in state and municipal economic development strategies were unconstitutional.

ATTORNEY NICK GLADDING JOINS RUDEN McCLOSKY AS A PARTNER IN SARASOTA

The Elephant in the Room: Litigating the Fix After Arch Coal and Dairy Farmers
O'Melveny counsel Darren Tucker recently authored the article "The Elephant in the Room: Litigating the Fix After Arch Coal and Dairy Farmers." This was the lead story in the January issue of the ABA's Antitrust Source journal. Parties to proposed mergers are seeking with increasing frequency to eliminate competitive concerns by unilaterally restructuring their transactions or selling overlapping assets to third parties. These efforts do not always eliminate the concerns of the enforcement agencies, which have challenged a number of acquisitions involving these self-help, or fix-it-first, remedies. The article reviews the state of the law of self-help remedies and offers suggestions to merging parties' considering this approach in light of recent developments.
