31 T&K Attorneys Selected as 2006 Rising Stars by Texas Monthly
Texas - Thompson & Knight is pleased to congratulate its 31 attorneys awarded Texas Rising Star status byTexas Monthly in the March 2006 issue.

""This recognition is the result of providing our clients the highest level of service expected throughout our 118 year history,"" says Peter Riley, Thompson & Knight's managing partner.

Austin partner William E. Hopkins (Health Law) and Of Counsel Nancy A. Shellhorse (Health Law) were selected for inclusion.

Dallas partners on the list included W. Mark Bennett (Trial), Charles C. Boettcher (Corporate and Securities), Anthony J. Campiti (Labor and Employment), Amy R. Curtis (Corporate and Securities), David G. Harris (Corporate and Securities), Andrew A. Ingrum (Real Estate and Banking), Michelle M. Kwon (Tax), Michael E. Schonberg (Trial), Shad E. Sumrow (Finance), Wesley P. Williams (Corporate and Securities), and Richard L. Wynne Jr. (Intellectual Property).

Dallas associates designated as ""Texas Rising Stars"" were Stephanie B. Gracia (Tax), Neely P. Munnerlyn (Tax), Alyson Outenreath (Tax), Jennifer L. Presley (Trial), and Robert D. Probasco (Tax).

Fort Worth partner Jennifer P. Henry (Trial) was also selected for inclusion in the list.

Houston partners selected were E.F. Mano DeAyala (Trial), Thomas R. Lamme (Corporate and Securities), W. Cameron McCulloch Jr. (Trial), Sarah E. McLean (Corporate and Securities), John S. Moody (Real Estate and Banking), Robert L. Paddock (Trial), Kirk Tucker (Corporate and Securities), and Jill Willard Young (Trial).

Houston associates included were Richard W. Bass (Trial), Harry R. Beaudry (Corporate and Securities), Alex J. Brown (Real Estate and Banking), and Tye C. Hancock (Corporate Reorganization and Creditors' Rights).

All 2005 Texas Super Lawyers (comprising five percent of the Texas State Bar) were mailed ballots. They were asked to name the best lawyers who were 40 years-old or younger, or have been practicing for 10 or fewer years. They were to only vote for lawyers they had personally seen in action. Ballots were verified to ensure they were only completed by the Texas Super Lawyers. The nominees were given scores based on the number and type of votes received. Higher scores were given for nominees from other law firms than those nominating attorneys within their own firm.

Then, an attorney-led research team reviewed each nominee and awarded points based upon defined evaluation criteria. The staff also checked to ensure each candidate was properly licensed, in good standing with the State Bar, and did not have a history of disciplinary actions.

The final points were tallied and segregated by firm size (small, medium, and large). Top point-getters from each of the three firm size categories were selected to identify the top emerging Texas Rising Stars, consisting of the top 2.5 percent of up-and-coming Texas attorneys.

Small Employee Group Health Plans--Security Compliance Date Imminent
The date for security rule compliance for so-called ""small"" employer group health plans is April 21st . Many health care companies group health plans have less than $5M in receipts and thus have, to date, been exempt from the reach of the HIPAA security rule. As a practical matter insured employee group health plans fall within the scope of the security rule, and incur risk assessment obligations, if they maintain or transmit enrollment and disenrollment data. HHS' Office of Civil Rights has recently confirmed this interpretation.
The risk assessment must identify the various threats (everything from hackers to earthquakes) to the confidentiality, integrity and availability of electronic PHI of plans (e.g., enrollment data, claims appeals, claim advocacy email). The ERISA plan must respond to each risk through administrative, physical and/or technical safeguards but can use a flexible approach. Plans can use third parties to assist in this assessment but EBG can facilitate the plan/employer plan sponsor doing the analysis itself. Self-administered analyses can be more cost-efficient but, more importantly, allow the plan to take responsibility for setting the level of remediation and remaining risk that the plan will find appropriate. Self-administered risk assessment also allows the plan to update the analysis as required by the rule as circumstances (threats and data) change in the life of the organization. (EBG uses its own methodology built from ISO standards and using a hybrid quantitative/qualitative approach to allow its clients to meet their documentation needs in this regard.)

Bracewell & Giuliani Announces 2006 Rising Stars
(HOUSTON, Mar. 1, 2006) – Sixty-two Bracewell & Giuliani LLP attorneys have been named as Texas Rising Stars for 2006.

A special publication by Law & Politics that appeared in Texas Monthly, the Texas Rising Stars list consists of the top 2.5 percent of Texas attorneys, which were nominated by 2005 Texas Super Lawyers.

The selection criteria set by the publication asked Super Lawyers to name the state's best up-and-coming lawyers who they had personally observed in action and were either 40 years old or younger, or had been practicing law for 10 or fewer years.

Each nominated attorney received points in three ways: from nominations within their own firm, from nominations outside of their firm and from an attorney-led research staff which reviewed the credentials of all Texas attorneys meeting the Rising Stars criteria and assigned to them points based upon evaluation criteria.

Honored attorneys came from all four of Bracewell's Texas-based offices, including 42 from Houston, seven from San Antonio, 10 from Dallas/Fort Worth and three from Austin.

Chambers Global Guide Recognizes Bracewell Partners Among World\'s Finest
HOUSTON (March 1, 2006) – Two partners at Bracewell & Giuliani LLP, as well as the firm's energy and Caspian Sea practices, have been recognized as leaders in their field by 2006 Chambers & Partners' Global: The World's Leading Lawyers for Business.

The ranking, which is published annually by Chambers and Partners, is renowned for its in-depth assessment of attorneys practicing law in 175 nations worldwide. The guide lists recommendations for attorneys and firms by country and area of law based upon market recommendations on technical legal ability, professional conduct, client service, commercial awareness/astuteness, diligence, commitment and other qualities most valued by the client. Individuals and practices were ranked Nos. 1 through 4.

Bracewell was ranked No. 3 as a Corporate/Commercial leading firm in Kazakhstan and Kazakhstan office managing partner, Greg Vojack, was named a leading individual. Chambers stated “clients are impressed by the professionalism and timely service of this team, while peers commend thorough research of the relevant issues.”

The United States section ranked Bracewell No. 4 as a leading firm in Energy: Oil & Gas. Clients commended Bracewell’s “responsiveness, value for money and long experience in the sector.” Chuck Shoneman, Washington, D.C. Energy and Telecommunications Markets and Regulation partner, was named as a leading individual in oil & gas. One interviewee described Shoneman as possessing “a knack of knowing when to be aggressive and when to look for compromise, and a talent for understanding his client.""

Both Shoneman and Vojack were recognized as leading individuals in the 2005 Chambers USA: America's Leading Lawyers for Business directory.

San Diego Attorney Howard E. Susman Joins Stoel Rives
SAN FRANCISCO - Practice to focus on Expanding Renewable Energy Transactions and Dispute Resolution

San Diego-based attorney Howard E. Susman has joined Stoel Rives where he will continue his litigation and transactional practice focusing on the renewable energy industry. Portland-based Stoel Rives has offices throughout the Pacific Northwest including four in California — San Francisco, Sacramento, Lake Tahoe and a new office in San Diego. Susman will divide his time between the San Francisco and the new San Diego office.

In California, Stoel Rives represents entities and businesses ranging from Fortune 100 companies to start-ups and municipal agencies. It has depth and experience in many areas, including litigation and transactional counseling services in energy, natural resources, the environment, real property, commercial transactions, governmental relations, products liability, and title insurance. Susman joins Stoel Rives from the San Diego office of Duckor Spradling Metzger & Wynne where he was a partner. Prior to that Susman was at Hillyer and Irwin, where he served as managing partner from 1996 to 1999.

ATTORNEY MIKE RUTLEDGE NAMED ADMINISTRATIVE PARTNER OF LOCKE LIDDELL & SAPP
March 1, 2006 – Mike Rutledge, a partner in the Houston office of Locke Liddell & Sapp, has been named Administrative Partner of the Firm. Cozen O\'Connor Member Jodi A. McDougall Named Managing Partner of Seattle Office
SEATTLE, WASH. – March 01, 2006 – Cozen O’Connor recently announced that Jodi A. McDougall has been named office managing partner of the firm’s Seattle office.

McDougall chairs the Seattle office’s international practice group. Her practice focuses on complex litigation matters. She has extensive experience in maritime law, professional liability and insurance defense and coverage issues.

McDougall is a frequent lecturer on claims and insurance matters, both domestically and abroad. She is a member of the Maritime Law Association, Professional Liability Underwriting Society, Maritime Insurance Association of Seattle and the American Bar Association. She is admitted to practice in Washington.

McDougall was selected by her peers as a “Super Lawyer” in Washington Law and Politics in 2001, 2002, 2003 and 2005. Along with the firm’s Seattle office, she received the 2005 Amicus Award from the Northwest Immigrant Rights Project, due to the office's ongoing pro bono efforts on behalf of immigration and asylum clients seeking assistance while in proceedings.

A resident of Sammamish, Wash., McDougall earned her undergraduate degree from the University of Southern California (B.A., magna cum laude, 1989), where she was elected to Phi Beta Kappa. She earned her law degree from Seattle University (J.D., cum laude, 1992). McDougall studied the law of the sea and international law at Cambridge University in England. During and after law school, she served as a deputy prosecuting attorney for both King and Pierce Counties.
