OIG Finds that the Method CMS Uses to Calculate Volume-Weighted ASP is Incorrect
On March 2, 2006, the OIG released the report Calculation of Volume-Weighted Average Sales Price for Medicare Part B Prescription Drugs. The OIG believes that CMS is calculating volume-weighted ASP incorrectly, and that this incorrect calculation results in reimbursement amounts that are inaccurate and inconsistent with the ASP payment methodology set forth in section 1847A(b)(3) of the Act.

Buchanan Ingersoll Attorney Leslie Harris\' New Position Noted in New York Law Journal
The New York Law Journal noted the appointment of Buchanan Ingersoll senior attorney Leslie J. Harris of the firm's New York office to the Executive Committee of the Antitrust Law Section of the New York State Bar Association in its February 16, 2006, edition.

Harris will serve a two-year term, aiding more than 500 committee section members with their mission to keep members of the bar apprised of developments in antitrust law.

Harris is a member of the firm's Litigation Section and focuses her practice on complex litigation and antitrust law. Prior to joining Buchanan Ingersoll, Harris was an associate at a litigation boutique in New York, where she focused on commercial litigation, antitrust and matrimonial litigation.

Gilbert Casellas Serves as Co-Chair of \"Best Practices in Diversity\" Program
On Tuesday, March 7 Gilbert F. Casellas will serve as co-chair of and presenter at a ""Best Practices in Diversity"" program to be held at the EEOC's Washington headquarters. Co-chairing the event will be Hon. Cari Dominguez, Chair for the EEOC, and Edie Fraser, President of Diversity Best Practices. Attendees will include chief diversity officers, general counsel and human resource leaders of several fortune 500 companies.

Gil practices in the firm's Washington office in the Employment, Labor and Benefits Section. Prior to joining Mintz Levin, Gil was president of Casellas & Associates, LLC, providing strategic diversity planning and design, EEO compliance, and litigation support.

Cadwalader Strengthens Financial Restructuring Practice

We very much look forward to their future contributions to the firm.” Jason Cohen focuses his practice on representing debtors, individual creditors, and official and unofficial creditors’ committees in all aspects of Chapter 11 bankruptcy cases and out-of-court financial restructurings. He currently represents Pfizer Inc. in connection with the chapter 11 case of Quigley Company, Inc., and Pharmacia Corporation in connection with the chapter 11 case of Solutia Inc. He has recently represented the bondholder or creditors committees of Arch Wireless Communications, Florida Coast Paper Holding Co., Grove Worldwide., Pathmark Stores, Inc., RSL Communications, Ltd., TransTexas Gas Corp., and Winstar Communications.

Camille Olson Quoted in Presstime Magazine
Camille Olson was quoted in the March 2006 issue of Presstime, the magazine of the Newspaper Association of America (“NAA”), in an article (“Alito Appointment Viewed as Good News for Media Companies”) which reviews the judicial decisions involving media issued by recently installed Supreme Court Justice Samuel A. Alito, Jr. Alito, the article states, is generally supportive of established media rights and is a defender of business interests; he has ruled favorably toward the media in First Amendment cases, but less so in cases involving the Freedom of Information Act.
On labor issues, including those involving discrimination, minimum wage, and the Family Medical Leave Act, “the result ends up favoring the company,” states Camille, who is a member of the NAA’s Employee Relations Committee.

An example of Alito’s favorable rulings toward media companies details a case from 1994, when Alito was a judge on the 3rd U.S. Circuit Court of Appeals in Philadelphia. The issue involved overtime pay for reporters and editors who worked for a newspaper which, while part of a larger company, had a circulation of less than 4,000. Alito dissented from the 2-1 majority that ruled that reporters and editors were not professionals under the Fair Labor Standards Act and therefore were entitled to overtime pay. Alito’s dissenting opinion stated that the paper’s small size and separateness from the company’s other operations meant that the paper was not subject to any of the act’s requirements, including overtime pay for nonprofessionals.
