Baker Botts Is Latest Texas Firm to Give Associates Raises
Houston-based Baker Botts jumped on the bandwagon Monday and gave its Texas associates a nice, big raise.

First-year associates with Baker Botts will be paid a $140,000 base salary and can make up to $10,000 more in bonus, according to the firm's new Texas salary scale.

Baker Botts is following Houston rival Vinson & Elkins, which announced a new, higher Texas salary scale on March 8. But Baker Botts did a bit better all the way up the scale -- associates with Baker Botts can potentially make a little more than their V&E counterparts.

For instance, V&E's new first-year Texas associate salary is a $135,000 base, plus a $5,000 guaranteed bonus, for a total of $140,000. Baker Botts will now pay $140,000 plus a maximum bonus of $10,000, which goes to associates who bill 2,300 hours or more during the year.

An eighth-year Texas associate with Baker Botts will make up to $240,000, which includes a $190,000 base salary and up to $50,000 in bonus. At V&E, the maximum compensation is $235,000 for an eighth-year associate, according to the new scale the firm announced March 8.

Baker Botts' new salary scale is retroactive to March 1.

"The market has clearly moved, and if you are going to recruit the best and the brightest, which is what we are all about, you have to do it," says Walter Smith, managing partner of 720-lawyer Baker Botts.

"If you are not competitive, paying the top rate, that's certainly a negative in [recruiting]," he says.

Hours after V&E announced its raises March 8, Andrews Kurth, another large Texas firm, notified its Texas associates that it would raise salaries. The firm hasn't announced details of its new scale yet, but did tell associates their raises would be retroactive to Jan. 1.

At Baker Botts, Smith says the firm's executive committee approved the new Texas associate scale on Friday, and after a few details were worked out during the weekend, associates were told about the new scale Monday.

Smith says associates and partners at the firm have reacted "very positively" to the news of the raises.

"We work together, and we want to make sure that our associates are appropriately compensated for what they do. They work hard," he says.

Smith says the raises will cost the firm "in the millions of dollars" this year. The firm has 289 associates in Texas.

Smith says the firm raised salaries on the East Coast for several associate classes at the end of 2005, and the firm is re-evaluating that scale in the wake of the new Texas scale. He says "it will be a matter of days" before the firm announces anything new for associates working in the firm's offices in New York City and Washington, D.C.

To earn the maximum annual bonus, associates must bill a minimum of 2,300 hours a year. According to Baker Botts' new scale, second-year Texas associates will be paid a base salary of $145,000 and can earn a bonus up to $15,000 annually. Third-year associates will earn a $150,000 base salary plus a potential $25,000 bonus. It's a $160,000 base salary and potential bonus of $30,000 for fourth-year associates; a $170,000 base salary and potential bonus of $40,000 for fifth-year associates; a $180,000 base salary and $40,000 potential bonus for sixth-year associates; a $185,000 base salary and $45,000 potential bonus for seventh-year associates; and a $190,000 base salary and $50,000 potential bonus for eighth-year associates.

Baker Botts pays bonuses at three levels on the new Texas salary scale -- at 2,000, 2,150 and 2,300 hours annually. The hours include billable, pro bono and management-approved nonbillable time.
