Cost of Compliance
Broker-dealers have seen outside counsel bills more than double in the last three years as a result of complying with the myriad rules that securities regulators have been churning out since 2002, according to a report by the Securities Industry Association (SIA), a trade group for the securities industry. The survey, which tracked compliance-related spending by securities firms between 2002 and 2005, found that broker-dealers paid an average of $1.3 million in legal fees for outside counsel in 2005, an increase of more than 140 percent from 2002. According to Stuart Kaswell, a partner in Dechert's alternative investments practice, there is no question that the growth is largely driven by increased regulation. . . but the goal is to achieve more efficient investor protection, because investors ultimately pay for that regulation. Regulation is a never-ending process," Mr. Kaswell said, with regulators constantly evaluating or changing the rules, and regulated entities adapting to the regulatory environment.

McKee Nelson named finalist by IFLR for Structured Finance Deal of the Year and Team of the Year
Washington, DC, March 16, 2006 -- The International Financial Law Review (IFLR), the benchmark of excellence in the field of financial law, named McKee Nelson's team as a finalist for Deal of Year. The deal, Providian Master Note Trust, is an innovative credit card ABS transaction originated by Providian National Bank.

McKee Nelson's Structured Finance group was also named a finalist for Team of the Year, only one of five firms given this honor.

3 Attorneys Join Lewis and Roca\'s Las Vegas Office
Lewis and Roca is pleased to announce that Lisa Wong Lackland has joined the firm as Of Counsel and Darren Brenner and Leanne Dodds-Eastman have joined the firm as associates in the firm’s Las Vegas office. Lackland joins the firm's commercial dispute group focusing on products liability, drug, and medical device litigation. Brenner joins the Products Liability and Insurance groups focusing on Bad Faith and Life, Health & Disability. Dodds-Eastman joins the Corporate and Securities Practice Group focusing on focus on corporate, commercial transactions, and securities.

Lackland was formerly an associate with Fain Sheldon Anderson and VanDerhoef in Seattle, Washington. Lackland is a member of the Tort Trial and Insurance Practice Section of the American Bar Association and the Washington Defense Trial Lawyers. Lackland received her B.A. in business administration from the University of Washington (1993) and her J.D. from Seattle University School of Law (cum laude, 1997).

Brenner was formerly an associate with Alverson, Taylor, Mortensen & Sanders. While in law school, Brenner was an external law clerk for the Honorable Thomas B. Donovan with the United States Bankruptcy Court. Brenner received his B.S. in Management Science from the University of California, San Diego (1999) and his J.D. from Loyola Law School (cum laude, Order of the Coif, 2003).

Dodds-Eastman is re-joining the firm, previously she was an associate in the firm’s Phoenix office where her practice focused on representation of both public and private entities in connection with mergers and acquisitions, business formations, and secured loans and real estate financing. Dodds-Eastman received her B.A. in Psychology from California State University of Fresno (cum laude, 1992) and her J.D. from Arizona State University College of Law (cum laude, Order of the Coif, 1996).

Lewis and Roca Expands Practice Area to Include Life Sciences and Bio Tech
Lewis and Roca, one of the Southwest’s most well-known and respected law firms, announces the expansion of its life sciences and bio tech practice. The firm has adopted an industry-wide focus and assembled a multidisciplinary team of specialists with experience representing clients in the biotech, pharmaceutical, medical device and research fields.

The firm’s collective knowledge and experience gained from working with life sciences clients combined with participation in organizations such as the Arizona Bioindustry Association positions Lewis and Roca firmly in the midst of this exciting and rapidly growing industry.

The life sciences team includes attorneys with corporate, securities, intellectual property, tax, healthcare and regulatory experience. The group consists of long-time Lewis and Roca attorneys Quentin Vaughan, practice group leader, Tom Campbell, José Cárdenas, Brad DeSandro, Scott DeWald, Gregory Harris and Diane Madenci. Associates Jason Furedy, May Mowzoon, Shane Olafson and Daniel Walker are also a part of this expanded practice area. Keller and Heckman LLP Partner Obtains Grant of Registration To Import Schedule II Substances for Client
On February 9, 2006, Keller and Heckman partner, Douglas Behr, received a Grant of Registration to Import Schedule II Substances from the Drug Enforcement Administration for his client, Chattem Chemicals, Inc. - a chemical manufacturer located in the Southeast. The DEA granted Chattem an unrestricted registration even though it had not yet manufactured any active pharmaceutical ingredients from narcotic raw materials.

The client applied to DEA for registration to import narcotic raw materials, including raw opium and poppy straw concentrate in January 2005. Chattem's application was opposed by DEA, Mallinckrodt, Inc., Noramco of Delaware, Inc. and Penick Corporation.

This was the first time that the DEA Office of Diversion had taken a position against an application to register as an importer. However, the DEA administrator rejected that opposition and found that Chattem should be registered. Chattem's registration is effective March 29, 2006.

Douglas Behr is a partner in Keller and Heckman's Litigation Department. Mr. Behr represents business, trade associations, and individuals before federal and state trial and appellate courts, regulatory bodies, and licensing forums with a concentration on Lanham Act false advertising, contract disputes, insurance coverage, white collar crime defense, product liability, and trade regulation controversies. He also advises members of the business community on litigation avoidance, and works with health care professionals on matters relating to controlled substances. Prior to entering private practice, Mr. Behr served 12 years as an Assistant United States Attorney, primarily as a prosecutor, and received a special achievement award from the Justice Department.

Philadelphia Firms May Be Ripe for Mergers
While larger Philadelphia firms attempt to create various identities -- whether they be national, regional, super-regional or global -- one fact remains: There are few out-of-town national firms with offices in the City of Brotherly Love. There is a bit of a debate around the legal community as to whether that is about to change, not through new office openings but through big-name mergers. … "To some extent Philadelphia has been, over the years, in the shadow of New York or Washington, D.C.," Drinker Biddle & Reath managing partner Andrew C. Kassner said. "But that may not be the case for much longer." … Kassner said that while Philadelphia firms may not be the first on the list of merger prospects, they could eventually move up. "As consolidation is completed in major markets like New York, Washington, D.C., and maybe Chicago, I think national firms might look to other major markets," including Philadelphia, he said. … Kassner questioned whether national firms would manage practice areas in markets with varying rate structures and be able to maintain their profitability. … Kassner said Drinker Biddle would never merge simply to get bigger, but added that strategic growth is important. "Given the legal market today, firms throughout the country are always talking to each other, and we're no different," he said.

Kelly J. Eberspecher and Yuezhong Feng Join Brinks Hofer Gilson & Lione
CHICAGO – Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the United States, is pleased to announce that Kelly J. Eberspecher and Yuezhong Feng, Ph.D. have joined the firm. Mr. Eberspecher will serve as an associate and Dr. Feng joins as a scientific advisor.

Mr. Eberspecher’s practice focuses on intellectual property litigation. He has first and second chair experience in both jury and bench trials and has substantial experience in all aspects of pre-trial discovery. His litigation experience extends to a wide variety of technical areas, including mechanical inventions, biotechnology, chemical inventions, medical devices and electrical technologies. Mr. Eberspecher started his career at Brinks and in 2002, left the firm to practice at a smaller IP boutique law firm. He is a veteran of the United States Navy where he served as a member of a SEAL team conducting special operations. Mr. Eberspecher earned his J.D. from the Indiana University School of Law in 1998 and a B.S. in Biology from the University of Wyoming in 1994.

Dr. Feng’s practice focuses on the preparation and prosecution of domestic and international patent applications. He works in several technical areas, including chemical, biotechnology, pharmaceuticals and nanotechnology. He also handles trademark registration for domestic and international clients. Prior to joining Brinks, Dr. Feng served as a research scientist with Platypus Technologies LLC in Madison, WI. He earned his Ph.D. in organic chemistry from the University of Chicago in 2002 and his B.S. in chemistry, with a minor in law, from Beijing University in 1995.
