Pro Bono Client Acquitted Due to Flawed Eyewitness Identification, Lack of Evidence
Jenner & Block pro bono client DeMarko Williams was recently acquitted of two counts of aggravated vehicular hijacking after Associates Christopher V. Parente and Donald S. Boyce Jr. convinced an Illinois jury that the case against Mr. Williams was based on flawed identifications, lack of physical evidence and an inadequate crime scene investigation.

Mr. Williams had been identified by the two victims of a carjacking and a state trooper who was on the scene as the “tall, black male with a doo-rag and dark jacket” who stole the victims’ car at gunpoint, then abandoned the car after the trooper attempted to stop him.

At trial, Mr. Parente told the jury in his opening statement that the State’s case was a “house of cards.” Mr. Parente also cross-examined the three eyewitnesses, eliciting inconsistencies and facts suggesting that there was limited opportunity to view the actual offender. Mr. Boyce successfully cross-examined the police on the scene, who found the fingerprints of an unknown person in the car, but did not find any belonging to Mr. Williams. Upon questioning by Mr. Boyce, the lead detective in the case failed to offer an explanation for not pursuing the unknown fingerprint lead.

Mr. Boyce in his closing remarks highlighted the fact that the police had also failed to find a gun or any other physical evidence connecting Mr. Williams to the crime. He also told the jury that the eyewitness identification was “suggestive” because it had been done at the crime scene with Mr. Williams in handcuffs, while he was surrounded by police.

The jury returned “not guilty” verdicts on both counts after hours of deliberation.

MCCA: Harris Advises Corporate Counselors on Strategies for Litigation Avoidance
At a dynamic panel discussion held as part of the Minority Corporate Counsel CLE Expo, Jenner & Block Partner Philip L. Harris advised attorneys to consider using an 120-day “early resolution process” after their client receives notice of a claim or lawsuit.

Front loading case preparation in the first 120-days helps in-house attorneys and outside counsel to ensure ""the best result possible,"" he said, because the attorney and client often have the most creative flexibility and control during that period. Mr. Harris observed that key facts can be obtained during this period while the events are relatively fresh, and that important witness testimony (including corporate 30(b)(6) witnesses) can be identified and developed. Focus group work can be used during this period to test defense themes and, if necessary, advise senior officers the it might be prudent to settle.

“Settlement generally becomes more expensive with the passage of time, so it behooves your client to decide whether or not to settle within the first 120 days of the claim,” Mr. Harris said.

Also serving as panelists were Deborah J. Israel of Womble Carlyle PLLC and Terry Bates of Reed Smith LLP. Muzette Hill, Managing Counsel of Litigation at Ford Motor Credit Company, moderated the discussion.

A former television talk show host, he currently hosts a weekly two-way talk radio show focused on a number of community issues and national topics. Additionally, Mr. Thompson is an adjunct professor and lecturer of a pre-law course at the University of Maryland, College Park.

Duane Morris Welcomes Trial Partner Robert Firriolo to Growing New York Office
Duane Morris LLP is pleased to welcome Robert P. Firriolo, formerly of Mendes & Mount, LLP, as a partner in its New York office. Robert joins the firm's Trial Practice Group. Robert is the fifth new partner to join Duane Morris' growing New York office in the past year.

Robert focuses his practice in the area of complex civil litigation, with a concentration in insurance coverage litigation and environmental matters. He has served as counsel to a number of insurers in complex environmental liability claims involving corporate plaintiffs such as utility, oil, petrochemical, pharmaceutical and mining companies. He also acts as a technical consultant, and supervises outside consultants, for clients. Robert served in the New York City Department of Transportation as well as the city's Department of Environmental Protection, where he gained extensive experience in environmental regulation, heavy construction, and safety procedures. Brightcove Acquires MetaStories, Expanding Its Internet TV Service
Internet TV pioneer Brightcove has acquired Seattle-based MetaStories, expanding the rich-media publishing capabilities Brightcove will offer independent producers and media companies through its Internet TV service, which allows content owners to harness the power of the Internet to distribute content and build broadband businesses. Financial terms of the acquisition were not disclosed.

TED FAULS NAMED TROUTMAN SANDERS RICHMOND MANAGING PARTNER
RICHMOND, VIRGINIA (March 20, 2006) . . . Troutman Sanders LLP is pleased to announce that Thomas E. duB. 'Ted' Fauls has been named Managing Partner of the law firm's Richmond Office. Robert D. Ted Fauls joined Troutman Sanders in 1986. He is a member of the Lending and Structured Finance Practice Group and has been the Practice Group Leader since 1998. Mr. Fauls' practice focuses on representing lenders and borrowers in a broad range of lending and financing transactions. He assists clients with structuring and closing sophisticated financing transactions, including term and revolving credit loans, loans secured by real and personal property, acquisition loans, syndicated and non-syndicated loans, asset-based loans, and secured and unsecured subordinated and mezzanine debt transactions; and he assists clients with loan restructurings and workouts. IPO Boom Continues At Reed Smith
International law firm, Reed Smith advised Canaccord Adams, the Nominated Advisor and Broker to Clean Air Power Limited, who successfully floated on AIM on 28th February 2006.

Clean Air Power, the company behind Dual-FuelTM technology, floated successfully on AIM, in conjunction with a placing of 10,000,000 common shares at 100p pence per common share, raising £10.0m (gross).

Clean Air Power had a market capitalisation of approximately £26.3 million at the placing price on admission. The proceeds of the placing will be used for product development, test facilities, marketing and for general corporate purposes.

Clean Air Dual-FuelTM technology enables heavy-duty diesel engines to operate on a combination of diesel and natural gas without jeopardising diesel engine performance.

The Reed Smith team was led by Partner Giles Beale, with Saul Sender (Associate) in London and Bob Smith (Partner) in San Francisco. Baker & McKenzie acted for Clean Air Power.

Reed Smith was delighted to work with Canaccord Adams and Clean Air Power on this deal, which will enable Clean Air Power to deliver reductions in both costs and emissions to its customers. Commenting on the deal, Saul Sender said “Our trans-Atlantic securities law capability allowed us to work with Canaccord Adams to bring Clean Air Power to market. We wish Clean Air Power every success in the next stage of its development as an AIM listed company.
