MILBERG WEISS ANNOUNCES THAT $100 PLUS MILLION DOLLAR CLASS ACTION SETTLEMENT WITH ZURICH NORTH AMERICA ENTERS FINAL STAGES
Plaintiffs in the class action pending in the United States District Court for the District of New Jersey before the Honorable Faith S. Hochberg announce that the October 2005 Memorandum of Understanding entered into between Zurich and a proposed nationwide class of insurance purchasers is one step closer to becoming a final settlement. In that litigation, the plaintiffs allege, among other things, a nationwide conspiracy between insurers and brokers to manipulate the market for insurance through the use and payment of undisclosed contingent commissions, bid rigging, and other practices aimed at steering business and allocating customers and markets. Under the MOU, Zurich agreed to pay at least $100 million to settle the claims in the MDL on the condition that Zurich obtains regulatory support consistent with the terms of the MOU. The regulatory settlements announced yesterday are an important step toward satisfying that contingency, and may result in payments of in excess of $150 million to be allocated among insurance purchasers nationwide as consideration for settling their claims in the litigation. The parties are proceeding toward finalizing the terms of the class action settlement agreement and, subject to completing ongoing due diligence, will seek court approval of that settlement.

Milberg Weiss Bershad & Schulman LLP is the most respected and effective plaintiff law firm in the United States. Founded in 1965, the firm now has more than 110 lawyers, with principal offices in New York City and additional offices in Boca Raton, Florida; Wilmington, Delaware; Washington, D.C.; and Los Angeles, California. The firm’s practice focuses on prosecution of class and complex actions in many fields of commercial litigation, emphasizing securities, corporate fiduciary, consumer, insurance, healthcare, antitrust, mass tort, human rights, and related areas of litigation principally through the use of class actions.

\"CROWELL & MORING ELECTS KENT GARDINER AS NEW CHAIRMAN,
Crowell & Moring LLP is pleased to announce the firm's partnership has elected Kent A. Gardiner, member of the firm's Antitrust Group, to succeed John A. Macleod as chairman of the firm.

Gardiner, a former trial attorney with the Antitrust Division of the U.S. Department of Justice, has practiced with the firm for 19 years. He has served with Macleod on the firm's management board and its three-person executive committee for five years.

“I look forward to carrying on a tradition of leadership that champions the values of outstanding client service and integrity that define Crowell & Moring. As chairman, my top priority will be to foster the continued passion for excellence that has driven the firm for the last 26 years,” Gardiner said.

In addition to maintaining an active antitrust litigation practice, Gardiner will focus on efforts to strengthen Crowell & Moring's client service and relationship initiatives, ongoing firm priorities that have fostered client integration among multiple practice groups. Since 2002, the number of clients generating annual revenues of more than $1 million has grown from 11 to 31.

Macleod, who will remain at the firm as senior partner, will assist the leadership team in client relationship and expansion efforts. The firm also received several awards for its commitment to quality of life and pro bono service, including being named one of Washington Business Journal's “50 Best Places to Work” and receiving the Bar Association of the District of Columbia 's Constance L. In a personal note to the firm, Macleod wrote, “I could not be more enthusiastic about our new leadership team, nor could I be more confident about our future. It has been an honor and a pleasure to serve you and this fine firm, and I am deeply grateful to my partners for having given me that opportunity.”

In other Crowell & Moring news, the firm's management board has appointed newly elected member David B. Siegel to replace the recently retired Herbert J. Martin as managing partner. Siegel, who has practiced with the firm for nearly 25 years, will work closely with Gardiner on the firm's strategic growth and general management. Wager: Assignment System is Key to Creating Inclusive Environment
A firm's work assignment system is one key to building an “inclusive” law firm environment that attracts and retains promising attorneys early in their careers, according to Jenner & Block Partner Charlotte L. Wager, who spoke at the National Association of Law Placement’s recent Diversity Summit in Chicago.

The means by which work is distributed to associates is “fundamental"" to creating equal opportunities for all new attorneys who wish to succeed in a large law firm, said Ms. Wager, the Firm’s Director of Professional Development and Co-Chair of the Hiring Committee. Ms. Wager explained that Jenner & Block has a regulated “free market” assignment system, wherein a partner can ask any associate to work on a particular case, or alternatively, associates may approach any partner directly to seek out the work experiences that they want. But Jenner & Block helps associates and partners use the free market system to their advantage – it's important to network internally, Ms. Wager emphasized, and make sure that all associates have access to the Firm's institutional clients and a broad section of partners.

After the first year, law firms should also monitor the associates’ development and have mechanisms in place to ensure the associates are doing level-appropriate work at each stage of their career, Ms. Wager said.

In addition to Ms. Wager, panelists included Verná Myers, principal of Verná Myers & Associates, LLC, and William Cook, partner at Arnold & Porter LLP. The panel was moderated by Katherine Herzog, President of Eastern Point Consulting Group, Inc.
