On Behalf of Nassau County District Attorneys Office, Edwards Angell Palmer & Dodge Attorneys Defeat Criminal Defendant’s Attempts to Overturn His Conviction For Possession and Sale of Crack Cocaine
Anthony J. Viola and Andre K. Cizmarik, litigators in Edwards Angell Palmer & Dodge’s New York Office, successfully opposed a criminal appeal brought by a three-time convicted felon attempting to overturn his latest conviction for possession and sale of crack cocaine. The conviction was affirmed and the criminal defendant will continue to serve the remainder of his 5-10 year sentence. Typically, these appeals are defended by the County District Attorneys Office. However, in this instance, Messrs. Viola and Cizmarik were appointed as Special Assistant District Attorneys and served in a pro bono capacity on behalf of the Nassau County District Attorneys Office. The defendant was charged with felony counts of criminal possession of a controlled substance (crack cocaine) including one count of criminal possession of a controlled substance in or near school grounds (in this case, a grammar school). The defendant was convicted by a jury of possession, intent to sell and sale of crack cocaine and was sentenced to concurrent sentences of 3½ to 7 and 5 to 10 years. On appeal, the defendant argued that the conviction should be overturned because: (i) of alleged breaks in the chain of custody of evidence given that one of the members of the Forensics Evidence Bureau who handled the recovered cocaine did not testify at trial; (ii) the testimony of one of the prosecution’s witnesses allegedly contradicted the prosecution’s theory of the case; and (iii) potentially exculpatory tape recorded evidence of a confidential informant who participated in the drug transaction was not introduced at trial, even though it was defendant’s own trial counsel who moved to exclude the tapes. The Appellate Division, Second Department rejected all defense arguments and upheld the conviction for this third-time felony offender. Kalisha Crawford, a NYU law student and a 2005 summer associate (who will be joining EAPD in the fall of 2006 as an associate) provided invaluable assistance in this case. Ms. Crawford’s involvement in drafting the appellate brief exemplifies the hands-on, practical experience and responsibility enjoyed by summer associates at EAPD.

Government Relations Expansion Continues at Buchanan Ingersoll with Addition of Karen Lynch
Buchanan Ingersoll PC announced today that Karen M. Lynch — former chief of staff for Congressman Rick Renzi (R-AZ) — has joined its Federal Government Relations Group as special counsel and assistant director of government relations in Washington, D.C. Lynch's arrival comes just days after Buchanan Ingersoll was ranked 22nd on Influence's Top 50 List of law firm lobbying practices.

""Karen's background on the Hill and in the private sector allows her to bring relationships and insight to our clients that is tremendously valuable to them and their ability to get things done,"" said Ronald Platt, senior director of Federal Government Relations in the firm's Washington, D.C., office. ""I'm sure that her experience in financial services will be put to work almost immediately to assist our clients in that industry.""

As Renzi's chief of staff, Lynch managed his D.C. office and the operations of eight district offices and served as his chief political and policy advisor. During her career she also served as counsel and manager of congressional affairs for the Consumer Bankers Association, and worked closely with members of Congress, congressional staff and federal agency regulators on retail financial services issues for banks, credit card companies and other financial institutions. Lynch also served as a legislative and legal advisor to House Financial Services Committee Chairman Mike Oxley (R-OH), as well as to Republican committee members, on all federal banking legislation.

Buchanan Ingersoll's Government Relations Section has more than doubled its capacity to serve clients during the last two years. It has added consultants and professionals such as former Congressman Bill Gray, former chief counsel to the U.S. House of Representatives' Committee on Financial Services Terry Haines, government affairs veteran Ron Platt and professional services boutique, Hill Solutions. Additionally, Hill Solutions co-founder Jack Tomarchio accepted a position late last year as the deputy director of intelligence for the Department of Homeland Security.

Lynch said her interest in Buchanan Ingersoll had a great deal to do with the firm's focus and commitment to growing its government relations practice. She said, ""This is a good fit for me, both because of the expansion the firm has seen in government relations over the last year, and because so many of the firm's practice strengths — financial services, homeland security and tax — are areas that I know a lot about.""

About Lynch

Before coming to Buchanan Ingersoll, Lynch was the chief of staff for Congressman Rick Renzi (R-AZ) of the U.S. House of Representatives. In that capacity she designed and supervised an effective constituent outreach operation and mail program.

Prior to that, she served as the regional field director for the Mel Martinez (R-FL) in his successful bid for United States Senate, where she created and managed a successful grassroots field operation for 15 counties, winning 13 in the general election. Lynch acted as the primary liaison between campaign headquarters and area volunteers, local Republican leadership and community leaders.

From August 2003 to July 2004, she served as counsel and manager of congressional affairs for the Consumer Bankers Association. Before that, Lynch served as the legislative and legal advisor to House Financial Services Committee Chairman Mike Oxley (R-OH).

In 2000, Lynch worked as a regional director of governmental affairs for a diversified $100 billion Fortune 500 financial services company, where she developed and executed a legislative strategy in nine state legislatures. In 1999, she was assistant legal counsel and legislative analyst for the Republican Research & Appropriations Staff of the Illinois House of Representatives, actively advising the House Judiciary-Civil Law Committee.

Lynch received her J.D. degree from the Chicago-Kent College of Law in 1997. She earned a B.A. in political science from Loyola University-Chicago in 1994.

Pillsbury Continues Bipartisan Expansion of First-Rate Public Policy Team Asia Policy Lawyer and Capitol Hill Veteran Deepen and Diversify Washington, D.C., Public Policy Practice
Pillsbury Winthrop Shaw Pittman LLP, a leading international law firm, is pleased to announce the arrival of two distinguished attorneys to its Washington, D.C.-based Public Policy Practice. Hakkyun Kim and Kristina Pisanelli will join Pillsbury from the law firm of Patton Boggs LLP. They will join a Pillsbury team that already includes six of their former Patton Boggs colleagues.

The new attorneys will bring broad experience not only in the substance and procedure of executive and legislative branch lawmaking, but also in business and public policy matters relating to Asia.

“Our commitment to continually enhance one of the top public policy teams in the nation’s capital is further demonstrated by the arrival of these accomplished attorneys,” says Pillsbury Chairwoman Mary Cranston. “These lawyers further deepen two established areas of Pillsbury strength: the regulatory/legislative arena in Washington, D.C., and the business and public policy interests of our clients based in, or with interests in, Asia.”

Hakkyun Kim, a former economist at the Bank of Korea (the Central Bank of Korea), helps to facilitate foreign investment into Korean and other Asian markets, advises U.S. companies establishing facilities in Korea and Asia, and assists Korean and Asian corporations in complying with U.S. commercial regulations. He also helps Asian entities navigate the U.S. legislative process. The scope of his practice includes representation of telecommunications companies, automakers, Internet service providers, international steel companies, energy concerns, food companies, high technology manufacturing corporations and pharmaceutical companies. Kim also counsels Korean government agencies and prominent Asia-based think tanks. He earned law degrees from distinguished schools in both Korea and the United States: Seoul National University and the University of Minnesota. He is a member of the New York and District of Columbia bars. Kim joins Pillsbury as Senior Counsel in Public Policy and will also take the lead in expanding the firm’s Korea Practice.

Kristina Pisanelli counsels corporate and nonprofit clients on a broad range of public policy issues, including health care, education and appropriations. Before entering the private sector, she served on the staff of U.S. Senator Patrick Leahy (D-VT). Her specific assignments in that office included Medicare and Medicaid policy; child welfare programs; elementary, secondary and higher education issues; and other matters under the jurisdiction of the U.S. Senate Appropriations Subcommittee on Labor, Health and Human Services and Education. Prior to joining Senator Leahy’s office, Pisanelli served as a policy analyst in the Office of the Governor of Vermont for the current Democratic National Committee Chairman, Howard Dean. In this position, she advised the governor on matters relating to agriculture, education, workforce development and state-federal relations (working closely with officials at the National Governors’ Association and the Democratic Governors’ Association). Pisanelli earned a J.D., cum laude, from Georgetown University Law Center and a B.A., magna cum laude and Phi Beta Kappa, from the University of Vermont. She is a member of the Maryland and District of Columbia (pending) bars. Pisanelli joins Pillsbury as a Public Policy Associate.

For over 100 years, Pillsbury has developed a practical understanding of the complexities of the U.S. political and public policy process. The firm’s experience extends to all three branches of the U.S. government. This enables the members of the Public Policy practice based in Washington, D.C., to provide counsel to a diverse base of clients on highly sensitive and complex public policy and regulatory matters including antitrust, aviation, communications, employment, energy, environment, financial services, government contracts, health care and life sciences, immigration, international trade, securities and tax.

Pillsbury Winthrop Shaw Pittman LLP is an international law firm with 900 attorneys in 16 offices, including San Francisco, New York, Washington, D.C., Los Angeles and London. In business for more than 130 years, Pillsbury’s practice focuses on capital markets and finance, energy, global sourcing, litigation, real estate, technology, life sciences and communications.
