Defense Verdict for Carlton Fields\' Client Pepperidge Farm Against Former Distributor
a Seminole County jury rendered a defense verdict in favor of Pepperidge Farm, Incorporated in a case brought by a former distributor for breach of contract and fraudulent inducement.

Plaintiff Frank Ruperto claimed that his son's distributorship was wrongfully terminated and that he was induced to sell his distributorship. Plaintiff also brought defamation claims against Pepperidge Farm. Circuit Court Judge Debra Nelson entered a directed verdict on the defamation claim following the close of Plaintiff's case. Plaintiff sought damages in excess of $450,000. Pepperidge Farm was represented by Carlton Fields Orlando Shareholder, David E. Cannella and Tampa Associate, Lori Baggett.

Wiley Rein & Fielding Partner Quoted on \"Clawback\" Provision in Anti-Dumping Case
Wiley Rein & Fielding International Trade partner Eileen P. Bradner was quoted in the New Hampshire Union Leader on Japanese retaliatory legislation that could affect printing press maker and WRF client Goss International. Goss had won a $31.6 million anti-dumping judgment in the United States against Japanese competitor TKS, but under the retaliatory law, Goss' Japanese subsidiary may be forced to pay back any money TKS pays as a result. While Japanese officials claim the U.S. antidumping law central to the case is in violation of World Trade Organization (WTO) agreements, WRF has argued on behalf of Goss that the U.S. has fully complied with the WTO rulings and should urge Japan to repeal the retaliatory law.

""It is Goss' position that the U.S. government should have opposed [the legislation] more strongly and even today should be insisting that Japan repeals it,"" said Ms. Bradner.
""The U.S. did comply with the WTO ruling, the U.S. repealed a domestic statute that has been on the books for 90 years and came into compliance with its GATT obligations, and if Japan did not like the way the U.S. complied, it could seek arbitration in the WTO.

AS WORK RELATED WEB BLOGS PROLIFERATE, NEW NATIONAL SURVEY FINDS FEW EMPLOYERS ARE PREPARED FOR THE IMPACT
Millions of adults in the United States have created personal web logs (or “blogs”) in which they chronicle their lives, share political and social views and discuss their employers and work. While millions of workers - as many as 5% of the American workforce by some estimates - engage in blogging, the latest survey by the Employment Law Alliance (ELA) is reporting that only about 15% of employers have policies that specifically address work-related blogging.

Michael S. Glassman, a partner in the Labor & Employment Department of Dinsmore & Shohl, says, “blogging not only presents a wide array of personnel issues, but it also raises many legal challenges for employers. Employers need to be aware of the proliferation of blogging by employees and analyze what kind of policies may be appropriate for their particular workplaces.”

Glassman, who has represented employers in all aspects of labor and employment law for more than 25 years, says that the issues blogging presents for employers are numerous and often complex. He cites as one example the issue of just how far an employer should or legally can go in prohibiting employees from blogging about their employer even though the blogging takes place outside the workplace on the employees’ own time with the employees’ own equipment. Glassman noted that “balancing an employer’s legitimate business interests with its employees’ off-duty conduct and privacy can be tricky and has generated considerable controversy and debate.” Employees may also use blogs to promote racist, sexist, religious or other discriminatory messages which co-workers may read. Should an employer consider policies governing these kinds of off-duty conduct? Glassman believes they should.

While employee blogging can negatively reflect on the employer, other employees, customers or vendors, employers sometimes believe that certain kinds of blogging actually may be beneficial and have incorporated provisions into their policies that permit blogging favorable to the employer. For example, some employers view positive statements on employees’ personal blogs about the company, its products or as a place to work a definite plus.

The ELA telephone poll of 1,000 adults, with a confidence interval of +/- 4%, was conducted over the weekend of January 22, 2006. Besides finding that 5% of American workers maintain personal blogs and that only 15% of their employers have a policy directly addressing blogging activities, it also revealed that:

* 59% of employees believe employers should be allowed to discipline or terminate workers who post confidential or proprietary information concerning the employer
* 55% think employers should be allowed to discipline or terminate employees who post damaging, embarrassing, negative information about the employer
* 23% support fellow workers being free to post criticism or satire about employers, co-workers, supervisors, customers, or clients without fear of discipline

Of the employees polled who work for a company with a blogging policy:

* 62% say the policy prohibits posting any employer-related information
* 60% say the policy discourages employees from criticizing or making negative comments against the employer
* 58% say the regulations deal with all blogging regardless of content.

Glassman further observed that while the law in this area has not caught up with the new technology, each employer at a minimum still should analyze the issue of employee blogging and determine what is the best approach for its workplace. At the very least, employers should have a clear policy that puts employees on notice of what and what is not acceptable and the consequences for not adhering to the policy. Failure by the employer to be proactive in this regard, Glassman concluded, not only could result in the employer not being prepared to properly address a situation when it arises, but also could create potential legal liability.

C&M Capitolink Adds Two Partners, Grows Government Relations Capabilities in Emerging Chemicals, Defense, and International Policy Sectors

Donnelly, Ph.D. and Paul D. Behrends. Winstead Sponsors Finalist Reception for the Rice University Business Plan Competition
The Rice University Business Plan Competition (RBPC) scheduled for Mar. 30 – Apr. 1 has become one the largest intercollegiate competitions in the United States. It features 36 teams from top MBA programs competing for over $200,000 in prizes. The three-day competition simulates the real-world process of entrepreneurs soliciting start-up funds from early-stage investors and venture capital firms. This year, the Finalist Reception on Mar. 31 will be hosted by Winstead Sechrest & Minick P.C., and Shareholders Jeff Harder and Robert Shaddox will serve as judges for the practice rounds.

Pamela Rothenberg Named to Prestigious Real Estate Group
Pamela Rothenberg, a real estate lawyer and the office managing member* of the Washington, D.C., office of Womble Carlyle Sandridge & Rice PLLC, was recently named a member of the American College of Real Estate Lawyers (ACREL).

The prestigious, invitation-only organization includes only 900 attorneys in the entire nation. ACREL admits only distinguished real estate practitioners who, in addition to their outstanding work for their clients, also devote substantial time and effort to educating the bar and the public about real estate law and make efforts to improve that area of law by teaching, writing, working in the organized bar, working toward the passage of legislation, or otherwise performing public service.
