Mark Wisniewski testifies before Michigan Senate Judiciary Committee regarding Asbestos Bill
Mark Wisniewski, head of the Kitch firm's mass tort litigation practice, testified before the Michigan Senate Judiciary Committee regarding Senate Bill No. 1123.

This bill would amend the Judiciary Act of 1961 and add provisions regarding asbestos- and silica-related personal injury actions. Specifically, the bill would require persons exposed to asbestos or silica to meet certain medical criteria before they would be able to assert a claim. With over 15 years of wide-ranging experience in asbestos litigation, Mr. Wisniewski was able to provide the committee with both a local and national perspective regarding asbestos personal injury actions.

Mr. Wisniewski is also scheduled to testify before the Michigan House of Representatives regarding the House companion bill, House Bill 5851.

M. Derek Harris and Catherine Salinas Join Carlton Fields in the Atlanta Office
Atlanta - The law firm of Carlton Fields is pleased to announce that M. Derek Harris and Catherine Salinas have joined the Atlanta office as associates in the Firm’s Business Litigation and Trade Regulation Practice Group.

Prior to joining Carlton Fields, Harris was an associate for Jones Day in Atlanta , Georgia from 2002 to 2006 where he practiced in the areas of products liability, government regulation, antitrust, and general litigation. Harris received his J.D. in 2002 from Georgetown University Law Center and his Bachelor of Arts degree in 1999 from the University of Delaware with a Major in Criminal Justice and a Minor in Legal Studies.

Prior to joining Carlton Fields, Salinas served as a law clerk for Willis B. Hunt, Jr., the United States District Court, Northern District of Georgia in Atlanta , Georgia from 2002 to 2006. Salinas received her J.D., with honors in 1994 from the University of Texas School of Law and her Bachelor of Arts degree in Spanish in 1990 from Emory University .

Bud Arnot and Talmage Boston Present a New Approach to Appellate Mediation
lawyer's challenge: increase settlement success rates when mediating pending appeals. The solution: incorporate a non-binding opinion from a former appellate judge delivered to both parties at the outset of the mediation. The benefit: the non-binding opinion can serve as a crystal ball, showing both parties their fate if they fail to achieve settlement at mediation.

The Appellate Practice Group at Winstead Sechrest & Minick P.C. has created a new, two-tiered approach to alternative dispute resolution that taps the power of their three appellate practitioners who have extensive judicial experience either on the Texas Supreme Court or the Texas Court of Appeals, or both. ""We begin the mediation with a brief mock argument to one of Winstead's three judges, Craig Enoch, John Hill, or Bud Arnot,"" explains Talmage Boston, a shareholder who is board certified in Civil Appellate Law. ""The judge then delivers a non-binding opinion and gives the parties the opportunity to ask questions about the opinion.""

Boston says the next step is to commence settlement negotiations in a session led by one of Winstead's mediators. ""We can't guarantee that the non-binding opinion delivered by our judges will match the exact outcome of the case if settlement is not achieved at mediation, but we believe it is accurate to suggest that the decision of our former judge, who has written hundreds of Texas appellate opinions and knows several of the current judges on the applicable appeals court, will be similar.""

So firmly does Boston believe in this new approach, that he and Arnot have approached multiple Courts of Appeal & appellate lawyers who, according to Boston, all seem receptive to the idea. They are also scheduled to present their approach to the annual meeting of the Association of Attorney Mediators, scheduled for Mar. 31-Apr. 1 in Little Rock, Arkansas where approximately 100 attendees from Texas, Oklahoma, Missouri, Arkansas, Louisiana, Mississippi, Alabama, Tennessee, Pennsylvania, Kansas, Virginia, Florida and Ohio will have the opportunity to hear about Winstead's new approach to appellate mediation and ask questions.

""I believe using this approach will greatly enhance the settlement success rate of appellate mediations,"" said Boston. ""Discussing the review with a former appellate justice gives the attorneys a much deeper insight into their case while it's pending an appeal. Even if the mediation doesn't end in a settlement, this process provides an analysis of their case from a judicial perspective that will help them prepare any future reply briefs and oral arguments in a much more incisive manner.""

Arnot agrees and adds, ""Parties who win at trial are sometimes unrealistically confident of winning an appeal. I believe this new approach helps reduce that over confidence, helping clients approach settlement negotiation more realistically and directing them to a better final business result in ending litigation.""

Donald L. Mrozek, Chairman of Hinshaw & Culbertson LLP for 17 Years, Elected to Another Three-Year Term
Donald L. Mrozek, Chairman of Hinshaw & Culbertson LLP for the past 17 years, has been elected to serve another term as the firm’s Chairman. Beginning on June 1, 2006, Mrozek will take the helm for another three years, leading a firm of more than 425 lawyers located in 27 offices coast to coast.

""Under the leadership of Don, Hinshaw continues to flourish even in the most competitive of times,” said firm Managing Partner J. William Roberts. “Given this stunning achievement, it is not surprising that there was unanimous consent that Don should continue at the helm. Donald L. Mrozek joined Hinshaw 33 years ago, in 1973. Buchanan Ingersoll Shareholder Gerald Sherman Quoted in Washington Post Tax Article
"Buchanan Ingersoll shareholder Gerald H. Sherman was quoted in the March 15, 2006, edition of the Washington Post in an article about the recent Washington, D.C., Superior Court ruling that the district is illegally taxing business owners who live in the city's suburbs.

The ruling stated that the district was breaking federal law by applying the city's unincorporated business franchise tax to partnerships with investors who live in the Washington suburbs.

While the ruling makes the district more attractive to investors, the investors who live in the city limits will be forced to pay taxes that others do not.

""It's an invitation to step out"" of the district, Sherman told the Post.
