State and Local Tax Attorney Rejoins Baker & McKenzie LLP as a Partner
San Francisco/Palo Alto, CA, March 29, 2006 – Baker & McKenzie LLP announced today that Kimberley Reeder, formerly counsel at McDermott Will & Emery, has rejoined the Firm’s Palo Alto office as a Partner in the North American Tax Practice Group, where she will focus her practice on state and local tax. She joins more than 125 tax professionals in the North American Tax Practice, and brings the San Francisco/Palo Alto office Tax Practice Group to 27 attorneys.

“We are thrilled to have Kim return to Baker & McKenzie and contribute to the Firm’s established state and local tax practice,” said John Peterson, Chairman of Baker & McKenzie’s Global Tax Practice Group and a Tax Partner in the Palo Alto office. “She is a rising star in the industry and will make a valuable contribution to our team.”

Reeder was an associate in Baker & McKenzie’s Palo Alto office from 2000 - 2004. She has significant experience with California and multistate tax issues, especially in the areas of income/franchise tax and sales/use tax. She has assisted companies with state tax controversies involving nexus, treatment of gain as business or nonbusiness income, the scope of the unitary business principle and state tax treatment of posessions corporations. On the tax planning front, Reeder has experience counseling clients on corporate restructurings and reorganizations, transfer pricing and apportionment issues.

Reeder received a dual J.D. (with honors) from the University of North Carolina School of Law and Master of Public Policy from Duke University in 1998. She received her B.A. from Yale University in 1991. Reeder is admitted to practice law in North Carolina and California.

Walter G. Reinhard Named Among New Jersey Super Lawyers
SOMERVILLE, NJ – The Somerville law firm Norris McLaughlin & Marcus, P.A. is pleased to announce that member Walter G. Reinhard has been selected for inclusion in the Public Utilities section of New Jersey Super Lawyers 2006.

New Jersey Super Lawyers are selected based on a peer-review survey mailed to more than 35,000 attorneys throughout the state, a blue-ribbon panel review process and independent research on each candidate. Only five percent of New Jersey attorneys are given this honor.

A resident of Fanwood, Reinhard practices administrative, environmental and regulatory law involving public utilities and other regulated industries such as telephone, cable television, electric and gas, water, sewer and solid waste.

With more than 30 years experience, Reinhard regularly handles detailed public utility rate cases, and many other types of matters, before the New Jersey Board of Public Utilities, and, where necessary, the judicial system.

Through his years of practice, Reinhard has worked with municipally-owned electric and water companies, as well as real estate developers requiring municipal, environmental and utility approvals. In addition, Reinhard has represented industry groups and large business concerns in opposition to regulatory and legislative action taken by both the Board of Public Utilities and the Department of Environmental Protection. He has also worked on cases involving environmental matters such as air and water pollution, hazardous waste management, and Superfund issues.

Reinhard is currently on the Board of Directors for Middlesex Water Company. He is a member of the New Jersey State Bar Association, for which he previously served as Chairman of the Board of Consultors of the Public Utility Law Section and as a Delegate to its General Council. Reinhard is also a member of the American Waterworks Association and the Water Utility Council of its New Jersey Chapter. He is listed in the most recent edition of The Best Lawyers In America.

Nicole J. Gray Joins the Business Department of McDonald Hopkins Co., LPA
Cleveland (March 2006) –Nicole J. Gray has joined the law firm of McDonald Hopkins Co.,
LPA as an associate in the Business Department’s Employment and Labor Law Practice Group.
Nicole will focus her practice on assisting clients in consultation and litigation of employment matters
arising under the Ohio Civil Rights Act, the Fair Labor Standards Act, the American’s with
Disabilities Act, Title VII, the Age Discrimination in Employment Act, the Family Medical Leave
Act, and other labor laws. Prior to joining the firm, Nicole served as an Assistant Prosecuting

Tyler Cooper Partner Earns Professional Honors
Irving S. Schloss, a partner in Tyler Cooper's Madison and New Haven offices, was elected for a three-year term as a Regent of the American College of Trust & Estate Counsel (ACTEC). ACTEC consists of 2,700 members selected for their experience and knowledge in the fields of wealth transfer and preservation planning, estate administration, family business succession planning, and related fields.

Mr. Schloss is listed in The Best Lawyers in America® in the trust and estate law and corporate law practice areas. Mr. Schloss has authored numerous articles on estate and retirement planning. He co-authored ""Understanding TIAA-CREF,"" published by Oxford University Press in 2000 and is currently working on a second edition. Disputed Technology: Patent Holder Has Already Won Legal Fights Versus U.S. Banks
Canadian banks are set to adopt a new electronic cheque-processing system that could save them millions of dollars. But using the technology could draw them into a patent dispute that some of the biggest U.S. banks have taken on.

The new technology securely scans cheques and shifts them electronically between financial institutions (costing pennies to clear a cheque), and would replace the current manual process that relies on paper cheques (costing up to $2 per cheque). With Canadian banks processing five million cheques a day, the savings from the electronic system could be enormous.

Check 21, the related U.S. law, was put into force in response to the September 11 terrorist attacks, when millions of cheques were held up because planes carrying them were grounded for days. Under an initiative led by the Canadian Payments Association, the system is to be implemented in Canada for all banks over the next three years.

But the Canadian industry may have to contend with Texas-based Data Treasury Corporation, which acquired a Canadian patent for the process in January 2006 that corresponds to its U.S. patent.

Data Treasury already won its patent battle with JPMorgan Chase & Co. in the United States, forcing it to settle in 2005 out of court. In February 2006, Data Treasury launched a further suit against another 56 U.S. banks, including industry Bank of America, Wells Fargo & Co. and Wachovia.

North American patent litigation experts predict that Data Treasury will enforce its Canadian patent. Robin Coster says that in fact, the cheque-processing dispute highlights an industry trend that could see a greater number of patent suits aimed at financial services companies.

""Data Treasury is just one of many patent holders taking a run at the big guns in the financial industry,"" says Robin. Other patent disputes already hitting the U.S. financial services industry, he adds, cover technologies ranging from those used to trade futures to high-tech telephony systems.

There are a number of options for banks facing the risk of patent litigation in Canada, says Robin. Those options include changing processes to avoid infringement, negotiating a licensing agreement with the patent holder, taking steps to challenge the patent, or simply laying low and establishing a reserve fund for potential license or litigation costs in the future.

Manko, Gold, Katcher & Fox, LLP Attorneys Join Pennsylvania Bar Institute\'s Faculty and Participate In 2006 Environmental Law Forum In Harrisburg
Joseph Manko, Robert Fox, Brenda Hustis Gotanda, Michael Meloy, and Jonathan Rinde, all partners at Manko, Gold, Katcher & Fox LLP (MGKF), an environmental and land use law firm, will join the faculty at the Pennsylvania Bar Institute’s (PBI) 11th Annual Environmental Law Forum on April 4-5, 2006. Jill Hyman Kaplan, also a partner at MGKF, served as a course planner for the Forum which will take place at the Harrisburg Hilton in Harrisburg, Pennsylvania.

Manko, a founding partner at his firm, will moderate a panel to discuss current state and federal environmental issues, including up-to-the-minute regulation and practice modifications. Manko has been listed as one of the Best Lawyers in America since 1991 and is experienced in handling a variety of environmental matters including land recycling, indoor air liability and financial disclosure of environmental liabilities.

Fox, also listed as one of the Best Lawyers in America, will discuss eminent domain after last year’s Supreme Court ruling in Kelo vs. City of New London. Discussion will include the repercussions of the ruling and ramifications for future environmental law. Fox’s experience in environmental litigation before federal and state courts will facilitate exceptional insight into this recent government decision.

Gotanda will moderate a program on complex water quality issues presented in impaired waterbodies. She counsels and represents businesses, industry, private parties and coalitions on a wide variety of environmental issues in regulatory, transactional, permitting, and enforcement matters. Gotanda was selected as a 2005 Lawyer on the Fast Track by American Lawyer Media. Meloy, a Best Lawyer in America attorney, will discuss agriculture and pollution regulation of CAFOs. Meloy brings both a legal and engineering background to bear in representing clients in connection with a broad spectrum of environmental litigation, regulatory and transactional issues.

Rinde will moderate a discussion on stormwater management issues at construction sites, a growing regulatory enforcement priority at the state and federal levels. His practice includes matters relating to the environmental aspects of real estate development and management, water, waste and air regulation and permitting, wetlands regulations, brownfields redevelopment, military base conversions, business transactions, and environmental litigation.

Kaplan served as a course planner for the Forum and was responsible for selecting the topics and speakers for all of the sessions at the Forum. She has a wide range of experience in environmental counseling and litigation and concentrates her practice in real estate development, safety regulations and audit policies.

The 2006 Environmental Law Forum will present the latest information in 20 critical areas, including natural disasters in the wake of Hurricane Katrina, alternative/clean energy resources, land use and zoning, historic preservation, mediation and litigation and discovery.

The Pennsylvania Bar Institute is a non-profit organization that provides Pennsylvania lawyers with recent, practical and cost effective information through courses and programs.
