Pitney Hardin LLP Partner to Speak on Recent Developments in Property Taxation
Christopher J. Stracco, partner in Pitney Hardin's Litigation and Real Estate Practice Groups, will be a featured speaker at the Joint American Bar Association/ Institute for Professionals in Taxation seminar in Atlanta, Georgia on March 30, 2006. Mr. Stracco will speak on “Recent Developments in Property Taxation.”

The faculty will address issues common to income, sales, use, and property tax cases in all jurisdictions with an emphasis on those issues that apply generally to state and local tax appeals throughout the country.

Millan Authors Contemporary CERCLA: Reversals of Fortune and Black Holes
Jones Walker special counsel Stanley A. Millan published an article in the Fordham Environmental Law Journal (Vol. XVI, No. 2, 2005). The piece, titled “Contemporary CERCLA: Reversals of Fortune and Black Holes,” deals with the history and trends surrounding this complex environmental clean-up statute, which led to the Brownfields programs in 2002. Oliver Houck, distinguished professor of Environmental Law at Tulane Law School, remarked upon the reader-friendly nature of Millan’s article. “You have a nice way of colloquializing these things,” Houck said, “making ‘em simple, that’s an art.”

Millan, an associate adjunct professor at Tulane Law School, is also teaching an advanced law course this spring on CERCLA and hazardous waste management (RCRA). His classes are well attended by both law students and graduate law students. Millan conducts CERCLA and RCRA litigation and compliance counseling at Jones Walker.

WRF Secures Dismissal of Fourth Class Action Lawsuit against Coors and Other Major American Beer and Spirits Manufacturers
The Superior Court of the District of Columbia has dismissed “with prejudice” all claims against Wiley Rein & Fielding client MolsonCoors in a lawsuit alleging alcoholic beverage industry ads were to blame for underage drinking. The court found that the plaintiff did not have standing to bring the suit in his own right or as the representative of his putative classes and further that he failed to state any claim on which relief could be granted.

The court is the fourth to dismiss claims on the grounds of lack of standing against Coors and most other major American manufacturers of alcoholic beverages in nearly identical cases. Each case has been brought by the same group of lawyers on behalf of plaintiffs claiming to represent a broad group of parents and guardians. These plaintiffs accused the defendants of false and misleading advertising, unfair trade practices in violation of consumer protection laws, unjust enrichment and negligence.

The plaintiffs sought billions of dollars, which they alleged were the defendants’ ill-gotten gains from underage drinking, and an injunction against the defendants’ advertising. Similar suits are pending in state and federal courts across the country, and three have been dismissed in Ohio, Colorado and Wisconsin.

Chadbourne Represents Crédit Agricole SA in Ukraine Bank Deal
Chadbourne & Parke LLP represented Crédit Agricole S.A. Group in the acquisition of at least 98% of the share capital of JSC Index Bank of Ukraine.

The deal, signed March 24, includes a stock sale agreement with Index Bank shareholders under which Crédit Agricole agreed to pay US$260 million for existing and new shares of Index Bank.

Index Bank, with assets of US$460.4 million, was created in 1993 and now ranks among Ukraine's leading banks with 186 offices including 25 branches throughout the country.

Index Bank's operations, along with those of Calyon Bank Ukraine, one of the country's major foreign corporate and investment banks, will enable Crédit Agricole to expand its position in the growing Ukraine market.

Leading and working for Chadbourne on the deal were London partner David Levin and Kyiv partner Jaroslawa Johnson.

Completion of the deal is subject to obtaining approval from the National Bank of Ukraine (Ukraine's central bank) and the Ukrainian Anti Monopoly Committee.

Buchanan Ingersoll Shareholder George Hovanec Quoted in Article on Patent Case
"Buchanan Ingersoll shareholder George A. Hovanec, Jr. was quoted in a March 29, 2006, article that appeared on PharmExecDirect.com that discussed recent arguments heard by the Supreme Court in the case of Laboratory Corp. of America Holdings v. Metabolite Laboratories Inc.

The case involves Metabolite's patent on a diagnostic test for the amino acid homocysteine. LabCorp asserts that one section of the patent is too broad, covering all tests that detect high levels of homocysteine. The company said this could include other homocysteine assays, not just the one in the patent, explained Hovanec. It lost both the initial suit and the appeal.

When the case reached the Supreme Court, it took on larger implications, such as addressing the issue of whether or not this claim is trying to patent a natural law or phenomenon, which everyone agrees is not allowed, Hovanec continued.

The fact that the court took the case indicates that at least some of the justices are interested in refining what is patentable material, he said.
