Britton Reappointed to Rockville, MD Planning Commission
The mayor and city council of the City of Rockville, Maryland appointed John Britton to a second term as a commissioner on the city's Planning Commission, an eleven-member body that reviews the city's zoning code and recommends changes to the mayor and council. John was also named the designated representative of the city on the Air Quality Committee of the Washington Metropolitan Council of Governments.

Merenstein Judges Legal Writing Competition
Bruce Merenstein was recently appointed as a judge of the Philadelphia Bar Association's Justice Ruth Bader Ginsburg “Pursuit of Justice” Legal Writing Competition. This annual competition recognizes the importance of excellence in legal analysis and writing skills at the law school level. There are ten judges in the competition, including law school professors, practitioners and federal judges.

Suplee Honored as Litigator, Internationally
Dennis Suplee has been honored among The International Who’s Who of Commercial Litigators 2006. He will be listed in three publications for a two-year period: The International Who’s Who of Commercial Litigators 2006 book, The International Who’s Who of Business Lawyers 2007, and Who’s Who Legal: USA-Commercial Litigation 2006. Dennis will also be listed on the Who’s Who Legal Web site, www.whoswholegal.com.

Buchanan Ingersoll Shareholder Sherwin Simmons Named to ALI-ABA Employee Benefits Advisory Panel
Buchanan Ingersoll shareholder Sherwin P. Simmons was recently named to serve a three-year term on the American Law Institute-American Bar Association (ALI-ABA) Employee Benefits Advisory Panel.

The ALI-ABA, located in Philadelphia, PA, is a nonprofit organization that has been providing continuing professional education for the legal profession since 1947. ALI-ABA's advisory panels offer suggestions about new issues and topics that the ALI-ABA should pursue in the creation of new or expansion of existing courses, publications and other ALI-ABA products and services.

Members of the advisory panels are selected based upon their experience and in-depth knowledge of the law in a particular area. When selecting members, the ALI-ABA seeks to ensure that each panel is as diverse as possible in terms of gender, ethnicity, age, geographic location and perspectives (e.g., private practice, academe, the judiciary, in-house and government service).

Sherwin P. Simmons is a shareholder in the Miami office of Buchanan Ingersoll PC, and is chair of the firm's Florida Tax Practice. He is also vice chair of the firm's Tax Section and a member of its Business Tax Practice Group.

Neumeier & Hansen Address Remedy Issues Under Civil RICO Claims
Attorneys defending their clients against civil Racketeer Influenced and Corrupt Organizations (RICO) Act claims may soon enjoy clarification by the U.S. Supreme Court on a complex remedy issue prescribed by the act, according to a recent article by Jenner & Block Partner Matthew M. Neumeier and Associate Brian D. Hansen that was published by The National Law Journal.

The Supreme Court will address in Ideal Steel Supply Corp. v. Anza the degree of causation and injury plaintiffs need to show in order to recover treble damages under the Act. Treble damages may be recovered if plaintiffs can show that injury to their businesses or property was proximately caused by fraud or other criminal acts under the RICO statute. However, according to the article, some lower courts disagree on how plaintiffs must show causation of the injury. Regardless of the outcome, the attorneys wrote, Ideal Steel “should provide RICO litigants with much needed clarification on causation and injury issues.”

The article also addressed the split in the Circuits regarding the availability of disgorgement in civil RICO cases, and whether a private plaintiff prosecuting a civil RICO claim has standing to obtain injunctive relief. In National Organization of Women Inc. v. Scheidler, the Supreme Court was to address whether private plaintiffs have standing to request injunctive relief under the Act or if that remedy is reserved for government RICO prosecutions. However, soon after The National Law Journal article was published, the Court issued its decision on Scheidler, ruling there was not an underlying RICO violation to support plaintiff’s claim. As a result, and as The National Law Journal article predicted, the Court did not reach the injunctive relief issue.

The Supreme Court heard oral arguments in Ideal Steel on March 27, 2006.
