Jones Walker Sponsors “Wish Upon a Star” Gala
Jones Walker is a sponsor of the Make-a-Wish Foundation of Louisiana’s 4th Annual Gala, “Wish Upon a Star.” The event will take place Friday, April 7 at the Audubon Tea Room, and will feature food, fun, dancing, and live and silent auctions. The Make-a-Wish Foundation grants the wishes of children with life-threatening medical conditions to enrich the human condition with hope, strength, and joy. The office of the Louisiana chapter closed during the aftermath of hurricanes Katrina and Rita, but they have reopened and continue their mission to make a difference in the lives of these children and their families, whose lives have been made even more difficult by the hurricanes that devastated south Louisiana. Jones Walker is proud to support the Make-a-Wish Foundation and other organizations that are making a difference in the communities we serve.

Michael R. Sklaire, Former DOJ Attorney, Joins Williams Mullen
Michael Sklaire has joined Williams Mullen as a partner in the firm's Litigation Section. His practice focuses on government investigations, corporate compliance, and general commercial litigation. Mr. Sklaire has extensive experience as a trial lawyer, including over 11 years as a federal prosecutor with the U.S. Department of Justice.

Prior to joining Williams Mullen, Mr. Sklaire worked as an assistant U.S. attorney in the District of Connecticut where he was assigned to the Organized Crime Task Force. In that position, he successfully prosecuted the mayor of Connecticut's largest city on bribery and racketeering charges. Additionally, with the Department of Justice, he worked in the Narcotics and Dangerous Drug Section, the Office of Enforcement Operations (Electronic Surveillance Branch), and the Money Laundering Section. He then took a position in the Washington, D.C. office of a nationally-recognized law firm.

Mr. Sklaire is licensed to practice in the states of Connecticut and Maryland, as well as, the District of Columbia. In addition, he is on the board of directors of the Federal Bar Association's Criminal Law Section, and is a member of the Criminal Justice Section of the District of Columbia Bar.

Mr. Sklaire earned a B.A. from the University of Vermont and a J.D. from American University, Washington College of Law.

Lathrop & Gage Achieves Appellate Victories for Environmental Clients
In the first case, the Missouri Court of Appeals – Western District issued a ruling in favor of Lathrop & Gage client Dennis E. Hess, who purchased a piece of residential real estate from Chase Manhattan Bank in 1999. The Court held that Mr. Hess may pursue claims for fraudulent non-disclosure of environmental conditions against Chase Manhattan under the Missouri Merchandising Practices Act, a state consumer-protection law, which was amended in 2000 to recognize private suits for deceptive practices in real-estate transactions.

The Court of Appeals reversed the contrary decision of the Circuit Court, which had dismissed Mr. Hess’ Merchandising Practices Act claim on the ground that the 2000 statutory amendment could not be applied to a 1999 real-estate transaction. Lathrop & Gage appellate lawyer Alok Ahuja argued the case for Mr. Hess, with assistance from environmental lawyers Terry Satterlee, Bill Beck and Jessie Merrigan.

In the second case, the United States Court of Appeals for the 8th Circuit ruled in favor of Lathrop & Gage's client, the Metropolitan St. Louis Sewer District (MSD). The Court rejected a challenge by another potentially responsible party to a consent decree MSD had negotiated with the United States, reflecting a favorable settlement of MSD's potential liability in connection with a Superfund cleanup. The Eighth Circuit adopted the argument, made by Lathrop & Gage environmental lawyer Gene Schmittgens and appellate lawyer Ahuja, that the challenger's objections to the consent decree came too late, and did not justify reopening a settlement the District Court had previously approved.

Michelle M. Funkenbusch Joins Lathrop & Gage
Michelle M. Funkenbusch joined the St. Louis office of the Lathrop & Gage L.C. law firm as a senior litigation associate. She will be concentrating on general tort liability cases, legal and medical malpractice defense, and business litigation.

Litigating for the last seven years, Ms. Funkenbusch is highly skilled in a wide variety of other areas as well, including transportation litigation, class actions, real estate litigation, workers’ compensation, subrogation, contract disputes, coverage disputes, pharmaceutical defense, and toxic tort litigation.

Funkenbusch earned her bachelor’s degree from Truman State University, cum laude, in 1995 and her juris doctorate from Saint Louis University School of Law in 1999. To identify the 2006 Super Lawyers for New Jersey, Law & Politics magazine surveyed more than 30,000 attorneys across the state about the best lawyers they had encountered in their practices. The April edition of New Jersey Monthly features a variety of categories in which lawyers were rated.

Merenstein Appointed to Philadelphia Bar\'s Investigative Division
Bruce Merenstein was recently appointed to a three-year term on the Investigative Division of the Philadelphia Bar Association's Commission on Judicial Selection and Retention. The Investigative Division interviews potential judicial candidates, and conducts a full review of a candidate’s qualifications, which includes interviews with lawyers, judges and others familiar with a candidate; a full review of writing samples submitted by a candidate; and a rigorous assessment of their qualifications. Once this process is complete, the Investigative Division makes recommendations to the Commission about what rating each candidate should receive.

Bressler, Barrie to Consult on Newsletter for Landlords, Property Managers
Barry Bressler has been appointed as the Pennsylvania consultant for Quinlan Publishing Group in connection with its “Landlord Tenant-Pennsylvania” newsletter, a legal reporter for Pennsylvania landlords and property managers. Barry, together with Michael Barrie, will contribute articles to the newsletter quarterly.
