Holland & Hart To Be Summit Sponsor Of Inaugural Rocky Mountain Legal Diversity Summit
The first annual Rocky Mountain Legal Diversity Summit will take place at Invesco Field at Mile High, followed by the 5th Annual Rocky Mountain Diversity Legal Career Fair on September 21. The Summit is the result of joint efforts by the Diversity in the Legal Profession Committee (“DILP”) of the Colorado and Denver Bar Associations and both the University of Colorado Law School and the University of Denver Sturm College of Law.

The deans of both law schools, along with DILP, formed the Deans’ Diversity Council in the fall of 2006. Under this partnership, the deans and DILP invited Colorado’s largest law firms, general counsel the business community, state and federal judges, public-sector attorneys, and bar leaders to join the Council in a unified commitment to diversity in the legal community of Colorado. Questions and proposals put forth by the Council are the basis for the Summit, which will:

* Educate attendees about issues facing diverse attorneys
* Provide best practices for hiring and retaining diverse attorneys
* Examine the business case for diversity
* Discuss how to access existing diverse law firms and legal departments and create mutually beneficial partnerships
* Provide practical tools to improve mentoring of diverse attorneys
* Encourage dialogue on ways to improve the pipeline of diverse individuals entering law school and the practice of law
* Explore successful models for professional development that engage diverse attorneys and encourage them to remain in the legal environment
* Discuss the issues diverse communities face in accessing justice at all levels

Freshfields advises Deutsche Bank on pro bono basis on world's first securitisation of subordinated microfinance credits with an external rating
International law firm Freshfields Bruckhaus Deringer has advised Deutsche Bank on its newly launched 'db Microfinance-Invest Nr. 1', the world's first externally rated securitisation of subordinated microcredits on the German market.

Over the last few weeks, investors have subscribed bonds for a total of €60m in three tranches, including €36m taken up for the first time by private customers of Deutsche Bank, €20m by the major institutional investor, KfW, and €4m by Deutsche Bank. These subordinated loans will help 21 microfinance institutions to make an effective contribution to the fight against poverty by distributing at least 120,000 very small loans to microbusinesses in 15 developing and emerging market countries.

The transaction structure of 'db Microfinance-Invest Nr. 1' is divided up into a senior tranche of €36m, which has been rated BBB by Fitch Ratings, a mezzanine tranche of €20m and a junior tranche of €4m.

Freshfields advised both Deutsche Bank and Fitch rating agency on a pro bono basis.

The Freshfields team advising Deutsche Bank included finance partners Andreas Bartsch and Bernhard Kaiser (both Frankfurt) and associates Gunila Weber (finance), Stefan Berg (tax), Daniel Voigt (finance), (all Frankfurt) and Gautham Srinivas (finance, London).

The London Freshfields team advising Fitch included finance partner Stuart Axford and finance associate Andrew Hoffman.

O.T. Isn't as Simple as Telling Time
Daniel McCoy, a litigation partner in Fenwick & West's employment practices group, was recently quoted in The New York Times on the grey area of "overtime."

Historically overtime simply meant extra money for extra work. These days there's nothing simple about it. With more employees adopting an "always on" mentality, more red flags are being raised about who is exempt and who gets paid.

In fact, lawsuits brought under the Fair Labor Standards Act by employees claiming they had been illegally declared ineligible -- and demanding back overtime pay – have increased by 50 percent. Of these, most take the form of large class-action suits.

Yet, as commutes grow longer (and technology better), and workers use time on the train to tap on their laptop or BlackBerry, the exceptions are starting to define the rule.

What if a message comes over a BlackBerry or cellphone when you are technically off the clock? "BlackBerry time is work time," said Dan McCoy. "It absolutely counts."

IP Attorney Samuel Abrams Joins Dechert LLP as Partner
Dechert LLP announced today that Samuel B. Abrams has joined the firm as a partner in the firm's Intellectual Property practice group. He will be based in the firm's New York office. Abrams was previously with Jones Day.

Abrams focuses on strategic patent counseling and prosecution and also has extensive experience handling interference proceedings and European oppositions on behalf of companies in the biotechnology, chemical, pharmaceutical, drug delivery, and immunology sectors.

"Sam's broad-ranging experience in intellectual property, particularly in the biotechnology and pharmaceutical fields, will be a key addition to the strategic counsel we provide to our clients," said Dechert chairman Barton J. Winokur. "His experience counseling on complex multinational issues will be a major asset to the practice and to the firm."

Abrams works with his clients to find strategic and novel ways to monetize and maximize their patents, and he handles the full range of patent analyses and opinions. Most recently, he spearheaded a litigation team that prevailed in a patent infringement action on behalf of Martek that related to Omega-III fatty acids.

"Sam brings to the firm impressive skills and considerable experience advising clients on complex intellectual property matters," said Dr. Ann M. Caviani Pease, chair of Dechert's patent practice. "A nationally recognized expert in U.S. patent interferences and foreign oppositions, Sam's broad experience will significantly enhance our worldwide IP counseling capabilities. His presence in New York will complement our strong IP transactions practice there. On the personal side, I have had the pleasure and privilege of working with Sam in the past and am pleased to have the opportunity to do so again."

Abrams, a graduate of Rensselaer Polytechnic Institute (B.S., 1978) and Case Western Reserve University (J.D., 1981), worked at Pennie & Edmonds from 1987-2003 and has experience in the patent departments at Merck and Procter & Gamble. He is admitted to practice in New York and is registered to practice before the United States Patent and Trademark Office. He is a member of the American Intellectual Property Association and the New York Patent, Trademark and Copyright Law Association.

JEFF SMITH TO SPEAK AT MARSH ENVIRONMENTAL RISK FORUM

Metro Parks, Serving Summit County’s Director-Secretary, Keith D. Shy, Honored by Buckingham, Doolittle & Burroughs, LLP
Buckingham, Doolittle, & Burroughs, LLP (“BDB”) presented its annual Stellar Performer Award on September 17, 2007 at the BDB Akron office. The award recognizes community and business leaders for exemplary leadership.

Metro Parks, Serving Summit County’s Director-Secretary, Keith D. Shy, received the Stellar Performer Award for his many professional and civic contributions to the city of Akron. Mr. Shy’s professional career has been built on caring for Summit County’s natural park systems.

Mr. Shy has been with Metro Parks since 1982, and was appointed director-secretary in 1998. He has a bachelor's degree from Capital University and an associate's degree in wildlife management and parks administration from Hocking College. He is a certified parks and recreation professional through the Ohio Parks & Recreation Association, and an active member of the Akron Chapter of Rotary International. Under Mr. Shy’s direction, Metro Parks has acquired more than 2,500 acres, including the 290-acre County Home property in Munroe Falls. In October 2006, the Summit County government gave Metro Parks the County Home land, which is directly adjacent to Munroe Falls Metro Park, for just one dollar.

Metro Parks, Serving Summit County manages more than 9,000 acres, including 13 developed parks, six conservation areas and more than 120 miles of trails, with 16 miles of the Ohio & Erie Canal Towpath Trail. The annual attendance averages 4 million visitors.

“I'm pleased to accept this award on behalf of Metro Parks, Serving Summit County. I work with great people on a daily basis and I couldn’t ask to be surrounded by a better team,” stated Mr. Shy. “I'm honored to accept this recognition for the Metro Parks and I believe it's a tribute to the spirit, compassion, and commitment we have for preserving our natural park systems.”
