Tillie Kidd Fowler Inducted into the Florida Women\'s Hall of Fame
Holland & Knight LLP is tremendously proud to announce that our late partner Tillie Kidd Fowler has been inducted into the Florida Women's Hall of Fame. Started in 1982, the Florida Women's Hall of Fame was created by Florida Statute to honor women who, through their lives and efforts, have made significant contributions to the improvement of life for women and for all citizens of Florida.

Fowler was one of three women inducted in a ceremony on March 14 by Florida Lt. Governor Toni Jennings. Fowler's photo and biography will be permanently displayed along with those of the other recipients on plaques on the walls of the Capitol's first-floor Rotunda.

Having served four terms in the U.S. House of Representatives, Congresswoman Fowler (FL-4th) became an integral part of the Leadership, where she served on the House Committee on Armed Services, Subcommittees on Military Installations and Facilities, and Military Readiness. She also served on the House Committee on Transportation and Infrastructure, Subcommittees on Railroads, Ground Transportation and as chairwoman of Oversight, Investigations and Emergency Management.

Upon her departure from Congress, Rep. Fowler's extraordinary efforts to ensure a strong United States military were recognized by the Secretary of the Navy and the Secretary of Defense. She received the Navy's Distinguished Public Service Award and the Department of Defense Medal for Distinguished Public Service. These are the highest civilian awards given by the Navy and the Department of Defense.

Rep. Fowler was appointed to the Defense Policy Board Advisory Committee by Defense Secretary Donald Rumsfeld in 2001. In May of 2003, the Secretary named her Chairman of the board which advises the Secretary of Defense on issues central to strategic planning for the department. She was the first woman to serve as Chairman of the Defense Policy Board in its 20-year history. She also served on the Chief of Naval Operations' Executive Panel.

In the spring of 2003, she was appointed by the Secretary of Defense to lead the seven-member panel created by Congress to review sexual misconduct allegations at the U.S. Air Force Academy. The panel conducted a 90-day study of the policies, management, organizational practices and cultural elements of the Academy that may have been conducive to alleged sexual misconduct, including sexual assaults and rape.

When allegations of prisoner abuse by U.S. military personnel at Abu Ghraib prison in Iraq surfaced in 2004, the Secretary of Defense appointed Rep. Fowler, along with two former Secretaries of Defense and a retired four-star general, to a blue-ribbon panel charged with providing the Secretary with independent, professional advice on issues related to the allegations of prisoner mistreatment.

Fowler joined the Washington, DC office of Holland & Knight as a Partner in 2001 after a distinguished eight-year tenure in the House of Representatives. In 1998, she was chosen by her Republican colleagues to be the Vice Chairman of the Republican Conference, making her the highest-ranking woman in the U.S. Congress when she retired. She also served for six years as a Deputy Majority Whip.

Holland & Knight Completes Asset Purchase Deal for Colombia\'s Caracol Televisión
MIAMI – Holland & Knight has completed an asset purchase transaction for Colombian client Caracol Televisión. Caracol has received FCC approval and completed purchase of 25 percent of Key West-based television station WGEN-TV 8 and its related stations in South Florida. A New York-based group of investment bankers, also a client of Holland & Knight, will own 50 percent of the station.

The Holland & Knight team was led by Washington, D.C., partner Enrique Gómez – Pinzón and included partners Frances Faigenblat and Mike Silva from the firm's Miami office and Charlie Naftalin and Eric Fishman from the firm's Washington, D.C., office. Associates Mark Arnold and Marian Ancheta from the firm's Miami office also participated actively in the transaction.

Caracol will produce a wide range of original Spanish language programs as well as offer Latin-American programming content and will be available to South Florida cable system viewers. The deal is significant in that it will intensify the competition for South Florida's Hispanic television viewers.

Paul Wilson to Chair on Hot Topics in Land Use Law at the Spring Meeting of the ABA's Section of State and Local Government Law

Paul Wilson will again chair a panel on Hot Topics in Land Use Law at the Spring Meeting of the American Bar Association's Section of State and Local Government Law, this year in San Diego on April 1. In addition to serving as moderator, Paul will speak on the topic of recent developer lawsuits, successful and unsuccessful, seeking damages from municipalities that deny permits required for the development of land. Paul, a member in the firm's Boston office, serves on the Council (or governing body) of this Section of the American Bar Association.

Competition (Amendment) Act 2006 signed into law; Groceries Order revoked
On 20 March 2006, the Minister for Enterprise, Trade & Employment Micheál Martin, signed the Order to commence the Competition (Amendment) Act 2006.

The Act took immediate effect and has revoked the Restrictive Practices (Groceries) Order 1987. As a result, the ban on selling certain grocery products below ""net invoice price"" has disappeared. The requirement under the Order for a supplier to publish terms and conditions has also ceased.

The Act provides a new definition of ""grocery goods"", as being all food and drink, including alcohol. It applies to the conduct of ""grocery goods undertakings"" (GGUs), and ""retailers"".

The Act inserts new sections into the Competition Act, prohibiting various activities that have as their aim or result in a negative affect on competition in the grocery trade. Under the Act, anti-competitive conduct in grocery goods trading may be committed by firms that are not ""dominant"".

GGUs cannot attempt to coerce another GGU to impose resale price maintenance (e.g. specifying a minimum sale price). Since it is only the attempt that is prohibited, it may be difficult to apply in practice. It is unlawful for a GGU to apply dissimilar conditions to equivalent transactions with another GGU. A GGU may not coerce another into paying advertising allowances. A retailer may not coerce another GGU to pay ""hello money"" for stocking a product in certain outlets.

The Act does not impose criminal penalties - civil remedies only apply. It has no effect on the application of the competition rules already contained in the Competition Act 2002. Therefore, if conduct also breaches these rules, criminal penalties could apply.

The revocation of the Groceries Order does not affect legal proceedings involving breaches of the Order before revocation.

Some of the Act's provisions are problematic (for example, prohibiting attempts and coercion as opposed to conduct that may be easier to prove) and enforcement could be difficult.

Tyler Cooper Attorney to Participate in UConn Law School Moot Court Competition
Tyler Cooper attorney Benjamin Buckley will take part in the Alva P. Loiselle Moot Court Competition at the University of Connecticut School of Law in Hartford on Friday, March 31.

The case being argued involves issues of insanity law and constitutional due process in the prosecution of a mentally disturbed teenager for the killing of an Arizona police officer. As one of the panelists, Ben will help judge the competition among second- and third-year law students.

Ben is a graduate of the University of Connecticut School of Law and also received his bachelor's degree from UConn. He served on the UConn Moot Court Board and is a past winner of the Loiselle Moot Court. He was also a quarter-finalist in the American Trial Lawyers Association Regional Mock Trial Competition.

An associate in the Hartford office of Tyler Cooper, Ben concentrates his practice in business litigation, insurance coverage and defense, personal injury law and appellate work.

Stevens & Lee\'s James C. Schwartzman Re-Elected to Independence Blue Cross Board of Directors
James C. Schwartzman has been re-elected to the Board of Directors for Independence Blue Cross.

A board member since 1991, Mr. Schwartzman will serve a three-year term. He also is a member of the Executive and Finance committees for the company, which along with its subsidiaries, is the Philadelphia area’s largest health insurer with more than 2.7 million members locally and 3.5 million overall.

Mr. Schwartzman, a shareholder, represents and counsels lawyers and judges on ethics-related issues. He has an active federal white collar criminal defense practice and frequently argues cases before the Pennsylvania Supreme Court. He also has extensive trial experience in civil matters.

Last month, Mr. Schwartzman was unanimously re-elected Vice Chairman of the Board of Directors for the Southeastern Pennsylvania Transportation Authority (SEPTA). He is a member of The Committee of Seventy and a former Chairman of the Supreme Court of Pennsylvania’s Disciplinary Board and Continuing Legal Education Board.

Mr. Schwartzman received a J.D., cum laude, from Villanova University School of Law (1972) and an A.B. from Washington University (1967). He is a resident of Radnor, Delaware County.
