Five Kaye Scholer Attorneys Named to Lawdragon\'s 500 Leading Litigators List
Lawdragon, a new media company that rates lawyers and judges, has released their latest guide to the best and brightest of the legal profession in their list of 500 Leading Litigators in America. This year, Kaye Scholer has five litigators on this list, Randolph S. Sherman in our New York office, Jan E. Dodd and Larry R. Feldman in our Los Angeles office, and Alan M. Fisch and Steven S. Rosenthal in our Washington, DC office. The publication wrote about Mr. Sherman, "The breadth of his expertise spans coordination of Novartis' PPA defense and co-leading RJ Reynolds' antitrust claim against Phillip Morris." About Ms. Dodd, "PPA, Rezulin, breast implants, even latex gloves--she's a star product liability defender." About Mr. Feldman, "From taking on insurance companies to defending Dow Jones, Feldman's cases are always high-stakes." Referring to Mr. Fisch noted that, "This standout patent litigator wrestled a $60 million infringement verdict from Microsoft" and about Mr. Rosenthal said, "This all-around threat handles goodwill bank claims work $30 billion, airport contests and energy ratemaking.

Patent Attorney Ian Scott Joins Duane Morris\' New York Office
Duane Morris LLP is pleased to announce that Ian Scott, formerly of Jones Day LLP, has joined the firm as a partner in its New York office. Ian, a member of the Intellectual Property Practice Group, is the second patent attorney to join Duane Morris in New York in the past month. James Markey, formerly of Winston & Strawn LLP, joined in late March. Ian is the eighth addition to the office in the past year.

Ian practices in the area of patent counseling, litigation and prosecution. He primarily focuses on pharmaceuticals, chemistry and chemical processes, medical devices, polymers and mechanical patents, and counsels clients on matters of patentability, invalidity, infringement, freedom-to-operate and priority of invention. Before becoming a lawyer, Ian was a Senior Chemist at E.M. Industries, an affiliate of Merck KGaA, Darmstadt, Germany. He worked at E.M. Industries for nearly a decade, performing and supervising applied research and development. He is a member of the New York Intellectual Property Law Association, and is admitted to practice in New York, New Jersey and before the United States Patent and Trademark Office. Ian earned his J.D. from Pace University School of Law in 1996. Prior to this, he received an M.S. in Chemistry from St. John's University in 1994. Ian, a native of Wales, graduated in 1988 with a B.Sc. in Chemistry, with honors, from University College Swansea, the University of Wales in the United Kingdom.

Paul, Weiss Achieves Major Victory for TECO Energy

Last Thursday Paul, Weiss scored a significant victory for our client TECO Energy, a public utility holding company that owns both the ""Con Ed"" of middle Florida as well as various unregulated energy businesses. TECO's stock price had sustained a significant decline as a result of problems that plagued the entire merchant power sector. First the U.S. District Court for the Middle District of Florida granted our motion to dismiss a securities fraud class action alleging Section 10(b) violations, accepting our argument that plaintiffs had failed to plead ""loss causation"" as required by last spring's Supreme Court decision in Dura Pharmaceuticals. The court stated that plaintiffs’ 164-page complaint only contained ""broad, vague allegations regarding the existence of a disclosure or revelation of fraud or improper accounting practices,"" and that the purported ""revelations"" cited by plaintiffs do not identify, reveal or correct any prior misstatement, omissions or improper accounting practices of the defendant or establish a connection with fraudulent conduct.

Carl Reisner Discusses Hedge Fund Proxy Fights

Partner Carl Reisner was quoted in the April American Lawyer article, ""Hedged Bets."" The article discusses the increased opportunities and challenges for corporate lawyers in the hedge fund industry. Carl, who is noted for representing hedge fund Pardus Capital Management LP in its successful proxy contest for seats on the board of Bally Total Fitness Holding Corporation and in subsequent litigation earlier this year, said, ""very few proxy fights go the distance...In the great majority of cases, the hedge fund can't get traction and moves on, or they work out a settlement.

John Breglio Honored by Cherry Lane Theatre for Legal Work

On April 3 partner John Breglio received the Cherry Lane Legacy Award from the historic Cherry Lane Theatre in Greenwich Village for his contributions to the not-for-profit theatre community and his pro bono legal work. Other honorees included NYC Council Speaker Christine Quinn and playwrights Edward Albee and David Henry Hwang.

Paul, Weiss' representation of AIG in its agreement with regulators to settle multiple claims and investigations with federal and state agencies was highlighted in the April American Lawyer's ""Big Suits"" column. The article notes that partners Marty Flumenbaum and Robbie Kaplan and associate Rebecca Shore represented AIG in this matter.

Two Recognized Intellectual Property Attorneys Join Perkins Coie
Perkins Coie announces the addition of Stephen C. Bishop, former Associate GC at Amazon.com, and R. Michael Ananian, who joins from Dorsey & Whitney, to its nationally recognized Intellectual Property practice. Both attorneys join as partners and will reside in the firm’s Seattle and Menlo Park offices respectively.

Bishop joins Perkins Coie from Amazon.com, where he was associate general counsel in charge of intellectual property. While at Amazon.com, he led the group responsible for the creation and management of the worldwide patent, trademark and domain portfolio of the company. Bishop has deep roots in the Seattle technology community and is a frequent speaker on intellectual property issues.

""When I decided to re-enter private practice, Perkins Coie was the natural choice,” Bishop said. “I used Perkins extensively while at Amazon and was always impressed with the depth of their IP practice.""

Ananian, formerly a partner with Dorsey & Whitney, focuses his practice on intellectual property and patent strategic counseling, as well as patent, trademark and copyright procurement. His clients include many leading electronics and software companies in Silicon Valley.

He is focusing his practice at Perkins Coie on the strategic analysis of patent portfolios, the preparation and prosecution of electrical, software and business method patent applications, the development of corporate intellectual property programs, and counseling clients on avoiding patent infringement. In addition to being admitted to practice in Washington, he is registered to practice before the USPTO.

Prior to Dorsey & Whitney LLP, Ananian worked with IP boutique Flehr Hohback Test Albritton & Herbert LLP. He has significant experience in patent procurement for the electronics and electrical engineering, semiconductor, computer, software, communications, medical and mechanical devices, e-commerce and Internet fields. He is admitted to practice in California, Washington, Colorado and Minnesota, as well as the U.S. Court of Appeals, Ninth Circuit, and the USPTO.
