Sughrue Partner to offer expertise at LexisNexis Conference
Sughrue Mion, PLLC, announced today that they will be one of the sponsors of the LexisNexis Corporate Intellectual Property Conference in China. This conference will focus on new methods and strategies for securing intellectual property; assessing values of IP portfolios; commercializing IP portfolios for maximum returns; protecting trade secrets and fighting cyber squatters.

Sughrue Partner, Joseph Bach, will offer insight on patent valuations. Joseph Bach is a partner in the firm's Silicon Valley office. He has more than a decade of legal experience in all aspects of intellectual property law, including patent prosecution and litigation. Mr. Bach has developed methodologies for, and counseled clients on, efficiently building and managing effective patent portfolios. Mr. Bach has successfully handled and managed cases in a broad range of technologies and has litigation experience before the ITC and federal courts. Mr. Bach was formerly Senior Director of Intellectual Property for Applied Materials, the world’s largest supplier of products to the global semiconductor industry.

Stoel Rives LLP Names New Managing Partner and Practice Group Chair

PORTLAND - Stoel Rives has appointed Wally Van Valkenburg as managing partner for its Portland office. Van Valkenburg chaired the firm’s Technology and Intellectual Property Group for the past five years. Steven T. Lovett will replace Van Valkenburg as the new Technology and Intellectual Property Group Chair.
""I am confident that Wally and Steve will assist the firm in achieving its long-term goals through strong leadership and strategic vision,"" said Beth Ugoretz, the firm’s Managing Partner.

Van Valkenburg will provide strategic and operational leadership for the Portland office, which at 160 lawyers is the largest in Oregon. Van Valkenburg has been with Stoel Rives since 1979. In addition to representing technology companies, he also has represented clients in footwear and apparel, health care, electric and gas utilities, manufacturing, and wood products. Van Valkenburg also chairs the Oregon Economic and Community Development Commission and is a board member for Portland Center Stage and the Oregon Sports Authority.

Van Valkenburg succeeds Ruth Beyer, who held the Portland Managing Partner position for over 9 years.

Lovett, an IP litigator, will lead the firm’s 30 lawyer Technology and Intellectual Property Group. Lovett joined Stoel Rives in 1990 after spending two years with Cravath, Swaine and Moore in New York. He has over 17 years experience representing businesses in intellectual property, unfair competition and antitrust litigation in federal and state courts. Clients he has worked with include Intel Corporation, U.S. Cellular, Xerox Corporation, Behringer Spezielle Studiotechnick GmbH, and Radisys Corporation. Lovett also serves on the Boards of Oregon Episcopal School and Playwrite Inc.

Kaplan Fox Seeks to Recover Losses for Investors Who Purchased ProQuest Company Common Stock
Kaplan Fox & Kilsheimer LLP (www.kaplanfox.com) has filed a class action suit in the United States District Court for the Eastern District of Michigan against ProQuest Company (“ProQuest” or the “Company”) (NYSE: PQE) and certain of its officers and directors, on behalf of all persons or entities who purchased the publicly traded common stock of ProQuest between February 13, 2003 and February 8, 2006 (the “Class Period”).

The complaint alleges that during the Class Period, defendants violated Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 by publicly issuing a series of false and misleading statements regarding the Company’s business and financial prospects, thus causing ProQuest’s shares to trade at artificially inflated prices.

In particular, the complaint alleges that on February 9, 2006, prior to the market opening, the Company issued a press release titled ""ProQuest Company to Restate Historical Financial Statements."" The press release stated in part that “during a review related to its internal controls assessment required by the Sarbanes-Oxley Act of 2002, the company discovered material irregularities in its accounting. As a result, the company intends to restate certain of its previously issued financial statements . . . Based upon its initial findings, the company believes that its deferred income and accrued royalty accounts are materially understated in previously issued financial statements. It also believes that its prepaid royalty account is materially overstated. It anticipates that as a result it will be required to recognize amounts of royalty and other expenses as well as reduce a portion of revenues previously reported for its Information and Learning business, the effect of which will materially reduce earnings from continuing operations for many of the affected periods.”

The complaint alleges that the true facts, which were known by the defendants but concealed from the investing public during the Class Period, were that the Company’s financial statements: 1) were materially misstated due to its failure to properly defer income and royalty payments and its improper capitalization of royalty expenses; and 2) were not prepared in accordance with generally accepted accounting principles (“GAAP”).

Following the Company’s disclosures on February 9, 2006, ProQuest’s stock declined from $29.41 per share to close at $24.19 per share, a decline of $5.22 per share or approximately 18%, on heavier than usual volume.

If you are a member of the proposed Class, you may move the court no later than April 11, 2006 to serve as a lead plaintiff for the Class. You need not seek to become a lead plaintiff in order to share in any possible recovery.

Hodgson Russ LLP Adds Denise L. Jensen
Denise L. Jensen has joined the Boca Raton office of Hodgson Russ LLP as an associate in its Florida Family & Marital Law Practice Group. Ms. Jensen was previously an associate with Robert W. Sidweber, P.A., in Fort Lauderdale, Florida.

Ms. Jensen concentrates her practice in the areas of marital and family law, including dissolution, mediation and appellate proceedings. She also serves as a Guardian Ad Litem in dissolution of marriage proceedings.

Ms. Jensen received her J.D., magna cum laude, from Nova Southeastern University, Shepard Broad Law Center, (2001) and her B.S. from Nova Southeastern University (1998). She served as a senior staff member on the Nova Law Review and was a member of the Moot Court Society. She was also a recipient of the Goodwin Fellowship.

Delaware Court Finds In Favor Of Mattel and Fisher-Price in Patent Dispute
Kenyon & Kenyon LLP client Mattel, Inc. has announced that it prevailed in a patent infringement lawsuit brought against it by LeapFrog Enterprises, Inc. In the suit, LeapFrog alleged that one of its patents was infringed by the PowerTouch Learning System sold by Mattel's wholly-owned subsidiary, Fisher-Price, Inc. The U.S. District Court in Wilmington, Delaware, found that Mattel and Fisher-Price did not infringe the patent and that the asserted patent claim was invalid.

The case, filed in October of 2003, was tried before a jury in May of 2005. The Court made several rulings during trial in favor of Mattel and Fisher-Price, including the exclusion of infringement under the Doctrine of Equivalents and certain damages theories. After seven days of testimony before the Honorable Gregory M. Sleet and three days of deliberation, the jury was unable to reach a unanimous decision and the case was submitted to Judge Sleet for decision.

Handling the matter in court on behalf of Mattel and Fisher-Price were Kenyon & Kenyon partners Richard L. DeLucia, John Flock, John R. Hutchins, and Jerry Canada. LeapFrog was represented by Wilson Sonsini.

Millan Presents Cracking the Floodwall Code
Stan Millan, special counsel in litigation at Jones, Walker, participated in a Levee Failure and Liability panel at Tulane’s 11th Annual Environmental Law Conference in New Orleans, on April 1, 2006. His talk “Cracking the Floodwall Code ” featured the Federal Tort Claims Act, Rising Tide, the Flood Control Acts of 1928 and 1965, inverse condemnation and atmospheric modification themes. The conference was attended by hundreds of scientists, lawyers, teachers and students.

Wiley Rein & Fielding Attorney Quoted on Consumer Advertising Rules for Prescription Drugs
Wiley Rein & Fielding attorney John F. Kamp was quoted widely in national and trade press on a recommendation to the U.S. Food and Drug Administration (FDA) to change its rules for direct-to-consumer (DTC) advertising for prescription drugs in order to make the advertising messages more consumer friendly. Mr. Kamp, who also serves as executive director of the Coalition for Healthcare Communication—an organization that represents trade associations specializing in medical advertising, marketing, communications and publishing—submitted a petition on the group’s behalf seeking to simplify DTC requirements. The petition states that current rules requiring DTC advertising to contain information on all side effects and contraindications of a drug are too complicated for many consumers to understand, and do little to prepare patients for effective consultations with their physicians.

“Our goal is simpler, clearer messages that communicate both the risks and the benefits of prescription medicines, more informed doctor-patient dialogue and improved patient compliance,” said Kamp, who adds that current DTC ads tends to “overwarn and underinform,” resulting in “more confusion than communication.
