Kramer Levin Helps ACLU Protect Privacy and Due Process Rights of Pregnant Women
Kramer Levin has helped convince a state court of appeals in Texas to reverse the convictions of two pregnant women who had been convicted of delivering a controlled substance to their fetuses. The firm prepared an amicus curiae brief on behalf of the American Civil Liberties Union and the ACLU of Texas challenging the novel convictions, under a statute barring delivery of drugs to children, on multiple grounds under both the U.S. and Texas Constitutions. Among other things, the brief argued that the prosecutions violated the women’s right to privacy by opening the door to widespread interference with virtually every aspect of a preganant woman’s life on the pretext of protecting the fetus; that subjecting pregnant women to potential criminal prosecution in such circumstances would discourage them from seeking medical treatment and prenatal care, cause them to be less candid with their physicians, or prompt them to terminate their pregnancies rather than face prosecution; and that the prosecutor’s reading of the statute violated due process because the law was not sufficiently clear to provide citizens with fair notice that this conduct was criminally prohibited. Kramer Levin's brief for the ACLU was authored by litigation partner Gregory Horowitz and litigation associates Ilyssa Sena, Patricia Seith, and Josh Kelner. In a decision issued on March 29, 2006, a state court of appeals in Texas unanimously reversed the women's convictions.

Fenwick & West LLP represented Glu Mobile in its recently announced acquisition of iFone, a leading global wireless entertainment publisher based in Manchester, UK. As part of the acquisition, Glu Mobile will obtain global rights to iFone’s top-selling titles including LEMMINGS™, ATARI Classics and Hasbro, Inc.’s (NYSE: HAS) MONOPOLY, and European rights to iFone’s SEGA’s SONIC THE HEDGEHOG. Financial terms of the deal were not disclosed.

Publications Note Addition of Karen Lynch to Government Relations Practice
The addition of Karen Lynch, a former chief of staff to Rep. Rick Renzi (R-Ariz.), to Buchanan Ingersoll was highlighted in the April 4, 2006, edition of American Banker, as well as the March 27, 2006, editions of Roll Call and the Legal Times. Lynch joined the Federal Government Relations Group as an assistant director on March 23.

Roll Call noted that with recent additions, including Lynch, the firm's Government Relations practice has more than doubled over the past two years.

The American Banker and the Legal Times highlighted Lynch's professional experience, including her work as a legislative legal advisor to Chairman Michael Oxley (R-Ohio), serving as counsel and manager of congressional affairs for the Consumer Bankers Association and her work on the 2004 Senate campaign of Sen. Mel Martinez (R-FL.)

Lynch rejoins former colleague Terry Haines, with whom she worked on the House Financial Services Committee. Lynch said the opportunity to work with Haines again factored into her decision to join Buchanan Ingersoll.

Valkonen Helps Finnish Band Sign Major Deal with Universal
Jenner & Block Associate Sami J. Valkonen successfully represented the Finnish alt-punk band Disco Ensemble in its recent negotiations with Universal Music Group.

The band’s deal with Universal Music Germany, one of the largest European subsidiaries of Universal Music Group, will “give the band the resources they need to break internationally,” Mr. Valkonen recently told the Finnish daily financial newspaper Kauppalehti (“Commerce Journal”).

Included in Disco Ensemble’s deal is a firm release commitment for their sophomore album entitled, “First Aid Kit,” as well as two options for future albums.

Firm Welcomes High School Students for a Day of Educational Activities
Students from Dr. Martin Luther King Jr. College Preparatory High School’s Peer Jury Program recently visited Jenner & Block’s Chicago office to learn about how the law impacts their everyday lives and to gain insight into careers within the legal profession.

“We hope that today’s activities will give the students a glimpse of what life is like as a lawyer,” said Associate Meghan C. Morrissey, who organized the event and has been a volunteer with the Peer Jury Program over the past year.

Several Jenner & Block attorneys and staff were on hand to discuss timely legal topics and careers. Partner Reginald J. Hill provided the students with an overview of copyright law within the context of downloading music on the Internet. He highlighted several recent lawsuits challenging websites that illegally offer music files for free, including the U.S. Supreme Court case MGM v. Grokster, which held that file-sharing services that have built their business on distributing illegal copies of copyrighted songs and movies can be held liable for copyright infringement.

Addressing another legal issue in the news, Associate Wade A. Thomson engaged the students in a dialogue about whether the government should be able to regulate or prohibit the sale of violent video games. He described recent cases where local and state governments have tried to restrict the sale of video games based on their content, and outlined the tests used by courts in deciding whether a law that limits a video game manufacturer’s right to free speech is constitutional.

Partner Robert Z. Slaughter, Associate Shyni R. Varghese and Senior Paralegal Uzoma O. Dike were also on hand to share their paths into and experiences in the legal profession. Mr. Slaughter said his interest in the business world eventually led him to practice corporate law, while Ms. Varghese said she always knew that she wanted to be a litigation attorney. Mr. Dike described the role of paralegals in a law firm, including the complex process of managing thousands of case documents for attorneys from pre-trial discovery through trial.

During a lively discussion about the various parts of a courtroom trial, Ms. Morrissey outlined the elements of strong opening statements and closing arguments, and provided examples of direct and cross-examination techniques. The students used these tips later in the day to conduct a mock jury trial of a fictional case involving an 18-year old charged with a felony. Ms. Morrissey acted as Circuit Court Judge, while students played the roles of State’s Attorney, Defense Attorney, defendant, witnesses, bailiff, jury foreperson and jurors.

\"LASHAWN JENKINS APPOINTED TO CITY OF PHOENIX
LaShawn Jenkins, an associate in Quarles & Brady Streich Lang LLP’s Bankruptcy and Creditors’ Rights Group, has been appointed to the City of Phoenix Human Relations Commission effective April 5, 2006.

The Human Relations Commission consists of 17 members (16 citizens and one youth representative) appointed by the Mayor and City Council each serving a three-year term. As part of the Human Relations Commission, Mr. Jenkins will make periodic surveys of the existence and effect of discrimination in the City of Phoenix in public accommodations and employment; plan, coordinate and conduct information, education and awareness programs; plan, coordinate and conduct programs to eliminate discrimination and racism; and report on its activities to the City Council.

“As a recipient of the M.L.K., Jr. Scholarship in college, the Thurgood Marshall Scholarship in law school, and as a current young African American attorney in the Valley, I am eager to work on the Human Relations Commission to give back to my community by promoting equality and justice for all,” said Mr. Jenkins.
