White & Case Named Russian Law Firm of the Year 2006
White & Case has been named Russian Law Firm of the Year 2006 by Who's Who Legal. The award, announced in The International Who's Who of Business Lawyers 2006, is based on nominations from clients and private practice professionals. White & Case is the first-ever recipient of the award in Russia.

The guide listed White & Case under five different practice areas and featured more of its lawyers than any other firm in the country. According to Callum Campbell, Managing Editor of Who's Who Legal, White & Case offers ""outstanding individual talent and breadth of expertise. This is the first time we have singled out an individual firm nationally for such an honour, and White & Case can truly be said to be Russia's leading law firm.""

In determining the leading law firm in a given jurisdiction, Who's Who Legal considers the number of ranked partners from the firm, the number of practice areas in which the firm is featured, its past performance and the aggregate total of weighted votes cast by peers and clients in favour of lawyers at the firm, relative to those of other firms in the jurisdiction.

Thomas B. Brigham, Jr. Joins firm as a Partner
Thomas B. Brigham, Jr. has joined the firm as a partner in the firm's Commercial & Public Finance practice group.

Tom focuses his practice on the credit structuring and documentation of commercial loan and leasing transactions, typically representing banks and other financial institutions in connection with senior and subordinated debt facilities as well as various types of equipment leasing transactions.

Tom received his J.D. from Case Western Reserve University School of Law and his A.B. from Marquette University. He practices in both the firm's Cleveland and New York City offices and is admitted to the bar in Ohio, New York and Pennsylvania (inactive status).

Morrison & Foerster Adds Leading White Collar Defense Attorneys Adam Hoffinger and Robert Salerno to its Washington Office
Morrison & Foerster LLP announced that Adam S. Hoffinger and Robert Salerno, two top Washington white-collar litigators, are joining the firm, adding to its deep bench for securities litigation and white collar defense. They join the firm's Washington, D.C. office as partners.

Mr. Hoffinger, a former Assistant U.S. Attorney in the Southern District of New York, has represented clients in many well-publicized government investigations, including Corporate Fraud and Campaign Finance Task Force investigations, and the Whitewater, Teamsters, Travelgate, Ruby Ridge, and Waco cases. He regularly works on securities, money laundering, health care, qui tam, Foreign Corrupt Practices Act, antitrust, environmental, and RICO matters. He also counsels individuals and corporations on compliance issues (including Sarbanes-Oxley and USA Patriot Act), internal investigations, and congressional and regulatory matters.

Mr. Salerno has handled a wide range of white collar criminal matters, as well as parallel civil and administrative proceedings and indemnification disputes, arising out of mergers and acquisitions of companies under investigation. He frequently litigates matters involving government procurement issues, including False Claims Act and whistleblower suits. He has also represented law firms and lawyers in professional malpractice suits and disciplinary proceedings. Additionally, Mr. Salerno counseled the defense team in the on-going litigation related to the collapse of Enron.

Both Mr. Hoffinger and Mr. Salerno have been hired by the U.S. Department of Justice to represent federal law enforcement agents and attorneys who have been sued civilly or charged with crimes for actions taken in the scope of their federal duties.

Morrison & Foerster, with a noted national reputation for securities litigation and enforcement defense, has added a number of prominent partners to its group in the past year. In 2005, longtime former federal prosecutor Ronald White joined the New York office, while the San Diego office added former SEC enforcement attorney Sean Prosser. Last month, the Denver office brought on Randall Fons, a senior SEC field officer who had been director of the Commission’s Central Region Office in Denver. The firm has a number of former prosecutors and veteran enforcement attorneys throughout the practice.

“Securities and white collar defense has become a widespread area of interest for the business community and we have been deeply involved in advising clients in these issues,” said Morrison & Foerster chair Keith Wetmore. “With corporate criminal investigations showing little sign of abating, we’re pleased to add two outstanding trial-tested attorneys in Adam Hoffinger and Bob Salerno.”

“In the past several years our group has really shown its mettle in some of the biggest securities and white collar cases,” said Carl H. Loewenson, Jr., co-chair of Morrison & Foerster’s Securities Litigation, Enforcement and White Collar group. “The addition of Adam and Bob makes this team even more impressive. It’s a terrific boost to our practice nationally as well as in Washington.”

Mr. Loewenson, himself a former federal prosecutor, practiced alongside Mr. Hoffinger in the Southern District of New York from 1985-1990. “From his days with the U.S. Attorney’s office, Adam established himself as a top-notch trial lawyer,” Mr. Loewenson said. “And in private practice he has proven to be one of the country’s leading strategists and trial counselors, especially in challenging, hard-ball investigations and prosecutions.”

Lori Schechter, Chair of the firm’s Litigation Department, noted, “Adam and Bob come to us at a time when their recognized expertise and trial skills are in high demand, and we are very pleased to add them to our nationally recognized white collar and securities litigation team.”

Mr. Hoffinger and Mr. Salerno, who have practiced together since 1990, join Morrison & Foerster from the Washington office of DLA Piper Rudnick, where Mr. Hoffinger served as the chair of the firm-wide White Collar practice group.

Mr. Hoffinger has been named by Washingtonian Magazine and Legal Times as one of the top lawyers in Washington, and is listed in Best Lawyers in America. At the end of his five-year tenure at the U.S. Attorney’s office, he received the Director’s Award for Superior Performance from the Department of Justice. A frequent author and lecturer on government investigations and enforcement issues, he has been an instructor at Georgetown University Law Center, George Washington University Law School, George Mason University School of Law, and the Federal Judicial Center. Mr. Hoffinger earned his J.D. from Fordham Law School (1982) and his B.A. from Trinity College (1978).

Mr. Salerno has served as an instructor of trial and appellate advocacy skills at programs sponsored by the National Institute of Trial Advocacy, Georgetown University Law Center, and George Mason University School of Law. He received his J.D. from the University of Virginia Law School (1990) and his B.A. from Brown University (1983).

Miller Canfield Attorney Reappointed to American Bar Association House of Delegates
The law firm of Miller, Canfield, Paddock and Stone, P.L.C. announces that Marjory G. Basile, a principal in the Detroit office, has been re-appointed by the State Bar of Michigan Board of Commissioners to serve a two-year term on the Michigan delegation of the American Bar Association House of Delegates, the policy-making body of the association.

Basile is former leader of Miller Canfield’s Intellectual Property Group. Her extensive intellectual property practice includes trademark and copyright procurement, patent freedom to use opinions, U.S. PTO inter-party proceedings, licensing, infringement dispute resolution, including litigation, and business counseling regarding trade secrets, intellectual property audits, intellectual property ownership, protection issues, and E-commerce issues.

She received her J.D., summa cum laude, from the University of Detroit-Mercy, and a B.A. in journalism from Marygrove College. She has been registered to practice before the U.S. PTO since 1976.

Her professional memberships include the American Bar Association (ABA), State Bar of Michigan, Oakland County Bar Association, the American Arbitration Association, Michigan Intellectual Property Lawyers' Association, Software Patent Institute (Charter Member), American Intellectual Property Law Association, and the Mortgage Bankers' Association Legal Issues Committee.

Legal Times Selects Hogan & Hartson Partner as a Leading Life Sciences Lawyer
Hogan & Hartson L.L.P. partner Barbara Bennett has been selected as one of the top life sciences lawyers in Washington, D.C., by Legal Times. In its 2006 Leading Lawyers in Life Sciences Report, “Life Sciences: Counsel on the Cutting Edge,” Legal Times identified Bennett as one of only eight leading life sciences lawyers in the Washington, D.C. area.

The selections are part of a Legal Times series on the D.C. area's top private practitioners and, according to the article, were based upon interviews with other private practitioners, in-house counsel, and other industry insiders, in addition to staff and readers’ suggestions.

One of Bennett’s clients quoted in the article states, “Barbara…just gets the job done.” The article notes that Bennett is held in high regard by both clients and the legal community, and has built an “envy-worthy” practice, bringing together mergers and acquisitions work and life sciences transactions, “with a strong dose of strategic business advice.

Hogan & Hartson Achieves Victory on Behalf of Amgen Inc.
Lawyers with Hogan & Hartson L.L.P. recently achieved a significant victory for Amgen Inc. when the Sixth Circuit Court of Appeals affirmed the denial of a motion for preliminary injunction by a judge of the Eastern District of Kentucky. The motion was filed by eight participants in a clinical trial for the drug GDNF. Due to two serious safety concerns and a demonstrated lack of efficacy, Amgen cancelled the study of the drug for treatment of Parkinson’s Disease.

The plaintiffs alleged that Amgen had promised to provide them with GDNF indefinitely, and brought claims against the pharmaceutical company for breach of contract, breach of fiduciary duty, and promissory estoppel. The district court agreed with Amgen who argued that it had no contract with the plaintiffs, and that all study documents clearly stated that Amgen retained the authority to cancel the study at any time.

The Sixth Circuit concluded that the plaintiffs have little chance of success on their claims, and further stated that the district court did not abuse its discretion in reaching its decision to deny the motion.

Hogan & Hartson Baltimore partner Mark Gately argued the case at the Sixth Circuit, and the appellate brief was prepared by Washington, D.C. partner Catherine Stetson, and associates Michele Sartori and Jessica Ellsworth. At the district court level, the matter also involved Washington, D.C. partner Dave Fox and New York partner Dennis Tracey, and along with Baltimore associate Lauren Colton and Washington, D.C. associates Ellen Chung and Nancy Parsons.
