IFC Revising Environmental Health and Safety Guidelines
The International Finance Corporation (IFC), the private-sector lending arm of the World Bank Group, has been updating its Safeguard Policies and its Environmental Health & Safety Guidelines. The IFC’s Policies and Guidelines have increasingly become international benchmarks for environmental and social sustainability. For example, more than 40 leading financial institutions have adopted the "Equator Principles," under which participating banks agree to require certain project sponsors to adhere to IFC standards for projects with a total capital cost of $50 million or more.

The IFC recently adopted new Performance Standards on Social & Environmental Sustainability. The new Performance Standards, which provide broad policy guidance on sustainability, will replace the old Safeguard Policies and apply directly to IFC-financed projects. (These new standards are available here: http://www.ifc.org/policyreview.) IFC is now turning to the development of new and updated EHS Guidelines. These will be industry-specific guidelines that will provide the pollution control and management standards that projects receiving IFC (or other financial institution) support will be expected to satisfy in the future.

The IFC is now revising all of its EHS guidelines for dozens of industry sectors, including those relating to: (i) agribusiness (e.g., food and beverage processing, farming, biotechnology); (ii) chemicals manufacturing (e.g., pesticides, pharmaceuticals, petroleum refining, coal processing); (iii) forestry (including pulp and paper mills); (iv) general manufacturing (e.g., cement, glass, electronics, semiconductors, textiles and construction materials); (v) infrastructure (e.g., ports, telecommunications, airports and waste management facilities); (vi) mining; (vii) oil and gas (including on-shore and offshore facilities); (viii) power (e.g. thermal, electric and wind energy); and several cross-cutting issues (e.g. wastewater reuse and occupational health & safety). These guidelines will be available for public review and comment beginning in August 2006. IFC is interested in receiving input from relevant industry sectors. IFC is expected to roll out batches of draft Guidelines grouped together into related sectors. Stakeholders will then have 60 days to comment on the drafts.

The range of industry sectors and projects that will be affected by these guidelines is vast, and companies should prepare to review and provide inputs on the IFC’s drafts as appropriate. Among other things, participation in this comment process may offer an opportunity to promote best practices or specific technologies to a broad range of industries at the global level.

JUSTICE FUND HONORS ARMISTEAD MAUPIN
The late Armistead J. Maupin was honored Wednesday night (April 5) during a special Justice Fund Dedication Ceremony at the North Carolina Bar Center. The ceremony took place in the James K. Dorsett Jr. Auditorium.

Presenters included former NCBA President W. W. “T” Taylor, whose longtime partnership with the honoree is reflected in the Maupin Taylor nameplate. Thomas W. H. Alexander, a 30-year veteran of the firm, and M. Keith Kapp, chairman, also presented remarks on behalf of Maupin Taylor.

Other esteemed members from the legal community and former colleagues of Mr. Maupin in attendance included North Carolina Supreme Court Chief Justice Sarah Parker, Federal Judges Frank W. Bullock, Jr. and James C. Dever, III, and Federal Magistrate Judge James E. Gates, as well as current attorneys of the firm.

Keith Kapp’s presentation featured excerpts from a 1995 Wake County Bar Association video interview of Maupin, who died July 26, 2005, at the age of 90.

Armistead and his wife Diana Jane Barton Maupin were the parents of Armistead Maupin, Jr., Anthony Maupin, and Jane Maupin Yates. Following the death of his first wife, he married Cheryl Erhard Powell who survives him.

Mrs. Maupin was joined by Anthony Maupin and Jane Maupin Yates, who traveled from her home in New Zealand to attend the ceremony, in unveiling the NCBA Foundation Endowment’s 79th Justice Fund.

A Justice Fund is a named endowment that honors those North Carolina lawyers, past and present, whose careers have demonstrated dedication to the pursuit of justice and outstanding service to the profession and the public. One or more contributors may establish a Justice Fund to honor a colleague, family member or friend. Contributions in Mr. Maupin’s name will be used by the NCBA Foundation Endowment to fund scholarships, pro bono services, and the BarCARES program.

Armistead Maupin was born in Raleigh on Nov. 10, 1914. He attended high school in Raleigh and graduated from the University of North Carolina in 1936. While working in Washington, D.C., Armistead earned a J.D. from George Washington University Law School in 1940.

Maupin served with distinction in the U.S. Navy during World War II, then returned to Raleigh as a member of Brassfield and Maupin, which later became Maupin Taylor. Armistead served as president of the Wake County Bar Association and the N.C. State Bar, was a member of the Fourth Circuit Judicial Conference and a Fellow of the American Bar Foundation, and served in the ABA House of Delegates.

Maupin was a lifelong member of Christ Episcopal Church in Raleigh, serving as senior warden of the vestry and as vice chancellor of the Eastern Diocese of N.C. An Eagle Scout, he later served as president of the Occoneechee Council and was awarded the Silver Beaver for service to the Boy Scouts. An accomplished horseman and friend to animals great and small, Armistead was a founding member of the Triangle Fox Hunt and the Wake County SPCA.

Armistead was descended from Revolutionary War officers who served under General George Washington, qualifying him for membership in the N.C. Society of the Cincinnati. Armistead earned his own laurels as president general of the General Society of the Cincinnati, and was installed as a chevalier of the French Legion of Honor by the president of France in 1974. President Reagan appointed him chair of the American Battle of Monuments Commission.

Attorney Y. Jae Kim Joins Flaster/Greenberg\'s Growing IP Practice
Y. Jae Kim recently joined Flaster/Greenberg’s Intellectual Property Practice Group as an associate in the firm’s Philadelphia office. Kim comes to Flaster/Greenberg from Darby & Darby, a New York City based intellectual property law firm. He concentrates his practice on working with clients to meet their business objectives relating to all different aspects of intellectual property. His primary focus is on patent litigation and prosecution in a variety of areas of technology including the chemical, mechanical, and medical device arts.

Prior to entering the practice of law, Kim worked as a project engineer for over ten years with companies such as Becton Dickinson & Co. and Stryker Corporation. He has extensive experience in the areas of new product development, disposable medical devices, surgical instrumentation, and orthopedic implant design. As a project engineer, Kim helped develop, market, and launch numerous new products to the worldwide marketplace relating to sample collection devices, in-vitro diagnostic devices, orthopedic implants, and surgical instruments.

Admitted to practice in New Jersey and New York, Kim is a graduate of Rutgers University, School of Law - Newark (J.D. 2004) and Rutgers University College of Engineering (B.S., Chemical Engineering, 1994).

Wiley Rein & Fielding Election Law Partner Quoted on the Future of Lobbying
Wiley Rein & Fielding Election Law & Government Ethics practice chair Jan Witold Baran appeared on a panel of lobbying and election law experts to discuss the future of lobbying in the wake of recent scandals and legislative calls for reform. The panel addressed the question ""Why Be a Lobbyist Today?"" at The George Washington University, where students were able to ask current and former lobbyists, Hill staff, reporters and other experts about the future of lobbying as a political tool—and as a profession. Baran was quoted in The Hill, offering counsel to those considering careers as lobbyists.

""My advice to you is, know the rules and obviously follow the rules,"" he said. ""There is a lot of opportunity. I hope those of you who do do it know the rules and follow them.
