Liskow & Lewis Lawyers Named as Local Leaders in Law
Four Liskow & Lewis shareholders recently were selected for the New Orleans CityBusiness Leadership in Law Guide for 2006.

Marguerite (“Peggy”) L. Adams is a shareholder practicing in the firm’s business section. Her practice emphasizes commercial real estate, representing developers and lenders, and trusts and estates. She is the past chair of the Trusts, Estates, Probate and Immovable Property Section of the Louisiana State Bar Association. A fellow of the American College of Trust and Estate Counsel, Ms. Adams serves as chair of its State Laws Committee. She is a graduate of Loyola University Law School, where she was articles editor of the Loyola Law Review, and Auburn University.


Thomas Beron is a shareholder practicing in the firm’s business section and a colonel in the Louisiana National Guard. During and after Hurricane Katrina he served as commander of security forces at the Louisiana Superdome, and he later served as commander of all National Guard forces in the city of New Orleans. Colonel Beron is a graduate of Tulane University Law School, where he was senior notes and comments editor of the Tulane Maritime Law Journal. He is a recent graduate of the U.S. Army War College, and earned a master’s degree at the University of Virginia and his undergraduate degree at Tulane University.


Shaun G. Clarke is a shareholder and co-chair of the firm’s government investigations and white collar criminal defense section. A trial lawyer, he advocates for clients in many of the nation’s highest profile government investigations. Mr. Clarke is a former Assistant United States Attorney and member of the Organized Crime Strike Force for the Eastern District of Louisiana. He also formerly served as San Francisco deputy city attorney. He is a graduate of Yale Law School, where he was editor of the Yale Law Journal, and Brown University.

John M. Wilson is chair of the firm's powerful energy and natural resources section. His litigation practice spans more than three decades, and has involved many of the key legal issues in oil and gas, commercial, professional liability, tax and construction contract areas of litigation practice. Mr. Wilson is a longtime fellow of the American College of Trial Lawyers, where he is active on several committees. He also is a fellow of the American Bar Foundation and the Louisiana State Bar Foundation. He is an Order of the Coif graduate of Louisiana State University Law School, where he was a member of the Louisiana Law Review. He also earned his undergraduate degree at LSU.

As water resources are scarce we need to find unique solutions for meeting development and environmental challenges,"" Ms. Albietz commented.

""I serve as Tribal Attorney for several federally recognized Indian Tribes, who are also concerned about the balance between economic development and environmental concerns."" Ms. Albietz holds a law degree from McGeorge School of Law, a Masters in Public Administration and B.S. from the University of Michigan. She received the Arthur S. Flemming Award - one of the highest honors in the federal civil service - for her work on behalf of Alaskan Natives in conveying over 22 million acres of land, addressing water, energy, and other natural resources issues as part of the land transfer process. Her federal government experience includes upper-management positions at the Bureau of Land Management in the areas of environmental law, Indian law, and land and energy-related issues.

Leading Silicon Valley Patent Litigator Joins Orrick
Orrick, Herrington & Sutcliffe LLP announced today that Fabio Marino, previously co-head of Bingham McCutchen's Intellectual Property practice, has joined the firm as a partner in its Silicon Valley office. Marino complements the firm's robust and senior patent litigation bench with his technical and litigation expertise and will chair the Strategic Intellectual Property Counseling group of the Intellectual Property practice.

Highly-Regarded Litigator Joins Orrick in New York
Michael Hefter, a highly-regarded lawyer with considerable complex commercial litigation experience, has joined Orrick, Herrington & Sutcliffe LLP as a partner in the New York office. He was formerly a partner with Dewey Ballantine in New York.

Hefter was named by The National Law Journal in 2002 as one of the top 40 lawyers under the age of 40. He has handled high-stakes litigation in complex business disputes, representing clients in the energy, banking and health care sectors.

WRF Team Secures Victory in D.C. Circuit with Respect to Deemed Lawful Status of Vitelco Tariff
Washington, DC—In a significant victory for local exchange carriers, Wiley Rein & Fielding partner Helgi C. Walker successfully secured reversal of an order of the Federal Communications Commission (FCC) that found client Virgin Islands Telephone Corporation (Vitelco) liable for damages based on a tariff filing for access charges. The court found that the FCC’s reconsideration of its suspension of the tariff, which the Commission claimed permanently removed “deemed lawful” status from the tariff, restored the tariff to its previous legal status.

The order in question held Vitelco liable to AT&T for damages resulting from Vitelco’s overearnings during the period covered by a 1997 tariff. The FCC found that the tariff had lost its “deemed lawful” status—and thus could give rise to damages—based on its earlier suspension of the tariff, despite the fact that the FCC had later reconsidered its decision to suspend. The court stated in its decision that “there is nothing to suggest that the Reconsideration Order had anything other than the effect of vacating the earlier order,” and that “the Commission’s determination that Vitelco was liable for retroactive refunds . . . was therefore arbitrary and capricious.” The court accordingly vacated the order in part and remanded for further proceedings.

USTelecom Vice President, Law and General Counsel Jim Olson hailed the decision as ""a significant victory for all companies that file tariffs at the FCC.

Amos Cohen Joins Robins, Kaplan, Miller & Ciresi L.L.P.
Amos Cohen has joined the Minneapolis office of the national law firm of Robins, Kaplan, Miller & Ciresi L.L.P. as an associate. Mr. Cohen’s practice focuses in the area of business trial and litigation. He is admitted to practice in Minnesota and the U.S. District Court, District of Minnesota.

Prior to joining Robins, Kaplan, Miller & Ciresi L.L.P., Mr. Cohen was an associate at another law firm where his practice focused on criminal defense. He has worked on cases involving mail fraud, Medicare fraud, campaign finance, murder, interstate extradition, and assault. Prior to that he was a judicial clerk to the Honorable Judge Susan R. Nelson, U.S. Magistrate Judge.

Mr. Cohen received his J.D., magna cum laude and Order of the Coif, from the University of Minnesota Law School (2001), and he received his B.A. in Philosophy from Grinnell College (1992).

Real Estate Finance Attorneys Join Nelson Mullins in Atlanta
Four attorneys have joined Nelson Mullins Riley & Scarborough LLP in the Atlanta office, all practicing in the Firm’s Financial Institutions area with an emphasis on
real estate finance.

“The addition of the real estate finance team benefits both existing clients and new clients with a new practice area for the Firm,” said Richard Herzog, who leads the Nelson Mullins Financial Institutions group. “Brad Denson, Joshua Katz, James Budd and Brooks Morel are well-known and respected attorneys in this growing field, and we welcome them to Nelson Mullins.”

The Real Estate Finance Practice Group at Nelson Mullins represents major financial institutions in structuring and closing commercial mortgage loans intended for securitization. Nelson Mullins attorneys are experienced with structuring loans to meet rating agency requirements and to comply with the representations and warranties made in connection with the securitization of commercial real estate loans. The Firm has an efficient closing and post-closing process to meet client needs and the demands of securitization. The attorneys have deep and varied real estate and finance backgrounds, including service as in-house counsel to a major New York based commercial mortgage-backed securities lending institution.

“Our real estate finance team also represents and works with master servicers in connection with loan assumptions, tenant-in-common syndications and defeasance transactions, and with special servicers in connection with the foreclosure and workout of loans in default,” Herzog said. “Nelson Mullins’ Bankruptcy and Creditors Rights Practice Group has extensive experience in real estate loan workouts and restructuring and will work closely with the Real Estate Finance Practice Group.”

The new attorneys joining Nelson Mullins follow:

Bradley J. Denson has previous experience as a former counsel for J.P. Morgan Mortgage Capital and joins the Firm as a partner. He is admitted to practice in Florida, Georgia and the U.S. Tax Court. He is a member of the Atlanta Bar Association (Sections on: Business, Finance and Taxation); the American Bar Association, and the State Bar of Georgia.

He earned a Master of Laws in Taxation from New York University School of Law and a Juris Doctor, cum laude, from Nova University Shepard Broad Law Center. His Bachelor of Arts degree in Economics came from the University of Florida.

Joshua M. Katz is an associate who practices in the areas of financial institutions, real estate, and bankruptcy and creditors’ rights with an emphasis on capital markets lending.

Before joining the Firm, Katz practiced capital markets lending and real estate in Atlanta. Additionally, he was a judicial extern for the Honorable Paul W. Bonapfel, United States Bankruptcy Court for the Northern District of Georgia, and spent several years as a bankruptcy attorney, where he represented debtors, creditors and trustees in all phases of bankruptcy and insolvency litigation.

A member of the State Bar of Georgia and the Atlanta Bar Association, he is admitted to practice in the U.S. District Courts for the Northern, Middle and Southern Districts of Georgia.
Katz earned a Juris Doctor from Emory University School of Law. While in law school, he served as associate editor of the Emory Law Journal. He earned a Bachelor of Arts degree in Political Science and Sociology from Emory University.

James A. Budd joins the Firm as an associate. A member of the American Bar Association, the State Bar of Georgia, and Atlanta Bar Association, he is admitted to practice in Georgia.

Budd earned a Juris Doctor from Emory University School of Law. While in law school, Mr. Budd served as the articles editor for the Bankruptcy Developments Journal. He was also a member of the dean’s list. He earned an A.B. degree in Government from Dartmouth College.

Brooks C. Morel, also an associate, is a member of the State Bar of Georgia and is admitted to practice in Georgia. She earned a Juris Doctor from Georgia State University College of Law where she was a member of the Georgia State University Law Review and a participant in the 1998 Moot Court Competition.
