Hogan & Hartson Expands Reach of Colorado Litigation Practice
DENVER, April 19, 2006 — Dan Hoffman, regarded as one of Colorado’s leading trial lawyers, has joined the Denver office of Hogan & Hartson L.L.P. as a member of the firm’s litigation practice.

During Hoffman’s high-profile career, he has handled a broad array of complex litigation matters for individuals and numerous corporations and partnerships. Prior to joining Hogan & Hartson, Hoffman served as co-counsel on merger and antitrust matters for the American Basketball Association (ABA) in its merger with the National Basketball Association and was lead trial co-counsel for The Gates Corporation in a theft of trade secrets suit against Bando Chemical Industries. Hoffman has also been the arbitrator of numerous cases before joining the firm, including those involving the United States Olympic Committee.

Hoffman is dean emeritus and professor emeritus of the University of Denver College of Law, where he served as dean from 1978 to 1984. He is also the only person to have served as president of the Colorado Bar Association and the Colorado Trial Lawyers Association and as state chair of the American College of Trial Lawyers.

Goodwin Procter Attorneys Honored with 2006 Pair Pro Bono Attorney Award
Goodwin Procter LLP, one of the nation’s leading law firms with offices in Boston, New York and Washington, DC, today announced that Joseph Theis and Terence Shields have been awarded the 2006 PAIR (Political Asylum/Immigration Representation) Pro Bono Attorney Award. Theis and Shields will be honored at PAIR’s annual benefit and awards dinner on Thursday, June 1.

PAIR is a legal services organization that provides pro bono representation to asylum-seekers who are fleeing persecution in their homeland and could not otherwise afford this critical legal assistance.

The PAIR award recognizes Theis and Shields for their extraordinary pro bono legal assistance on behalf of two women from Uganda who suffered imprisonment and torture due to their political beliefs. Together, Theis and Shields dedicated hundreds of hours of pro bono assistance and successfully represented each client, one before the Asylum Office and the other in Immigration Court. One of their clients is currently pursuing a job in hotel management and the other provides counsel to women on affordable housing alternatives.

Both Theis and Shields are associates in Goodwin Procter’s Business Law Department and joined the firm in 2005. Goodwin Procter has a well-developed pro bono program which, in fiscal year 2005, provided more than 47,700 hours of pro bono legal assistance to charitable organizations and individuals who could not otherwise afford legal assistance.

Alan D. Minsk Joins Townsend’s Seattle Office
Townsend and Townsend and Crew LLP, a 170-attorney law firm specializing in intellectual property, antitrust and complex litigation, announced today that Alan D. Minsk has joined the firm's Seattle office as special counsel.

Minsk joins Townsend as a member of the firm's Electronics & Software Practice Group and brings with him a wide range of experience in patent portfolio strategy, development and management. Prior to joining Townsend, Minsk was Associate General Counsel and Patent Counsel for Openwave Systems, Inc., a leading independent provider of open software products and services for the communications industry. In addition to managing Openwave's domestic and international patent acquisition efforts, Minsk was responsible for managing patent litigation; pre-litigation counseling; and intellectual property aspects of product clearance, and mergers and acquisitions. Minsk is a graduate of Harvard Law School and received his undergraduate degree in Astronomy (concentration in Applied Math and Physics), and his masters degree in Physics from the University of California at Berkeley.

Litigation Boutique Pays Salary-Equaling Bonuses
Gibbs & Bruns, a 34-lawyer litigation boutique in Houston, recently set a high bar for associate bonuses by paying bonuses to its 10 associates that are at least as large as their yearly base salary.

Those bonuses were paid to the associates over the past year, but the firm paid a big chunk of the money April 13, in the wake of two large litigation settlements finalized during the week of April 10.

The firm has had a good run of settlements during the past 12 months, with settlements exceeding $500 million. Partner Robin Gibbs says he cannot discuss the terms of the settlements. But partner Kathy Patrick confirms that the firm represents plaintiffs in the National Century Financial Enterprises multidistrict litigation (MDL), which is pending in the U.S. District Court for the Southern District of Ohio. The MDL consolidates a number of suits filed in connection with the bankruptcy of NCFE, a company that financed health-care receivables. In a recent 10-k filing, defendant JPMorganChase reported that it agreed in February to pay a total of $425 million to plaintiffs in the MDL.

Gibbs says Gibbs & Bruns has a policy to share the wealth with its employees, and that led to the bonuses paid last week.

""Each of our associates received a bonus at least equal to salary,"" Gibbs says.

Including the recent payment, Gibbs says senior associates have received as much as two times their salary in bonus payments over the past 12 months. Some were paid more than $300,000 in bonus money, he says.

Patrick says the firm pays out bonus money at various times of the year, not just at year end like many other firms.

""When we make money on contingent-fee cases, we share the wealth from Robin [Gibbs] right down to the newest employee,"" Patrick says. ""We don't differentiate whether you worked on the case or not.""

Gibbs says that, also on April 13, staff at the firm received bonuses equivalent to several months' salary.

Gibbs says the recent run of settlements has been extraordinary.

""It's a big deal for us to have had this good of a year,"" Gibbs says.

In the meantime, Gibbs says the firm is looking at its associate salary scale in the wake of increases adopted by many of Texas' largest firms in recent weeks.

He notes that the starting base salary for first-year associates at Gibbs & Bruns has been $127,000 since 1999. The new, higher market base salary rate for first-year associates at large Texas firms is around $135,000.

Last December, 76-lawyer Susman Godfrey, another litigation boutique, paid year-end bonuses to its associates ranging from $86,000 to $150,000.

At the time, partner Stephen Susman said the bonuses were paid because the firm's financial performance for the year was second only to its best-ever results in 2004. The Susman Godfrey bonuses averaged 75 percent of each associate's base pay.

Kelley Drye Merges With Collier Shannon
Kelley Drye & Warren and Collier Shannon Scott have officially merged.

The firm will operate as Kelley Drye & Warren, except in the Washington, D.C., area, where the firm will be known as Kelley Drye Collier Shannon.

The newly merged firm has nearly 400 lawyers, with more than 150 located in the Washington, D.C., area. Gross revenues are expected to be more than $220 million.

The move expands Kelley Drye's presence in Washington, where Kelley Drye and Collier Shannon have had practices for several decades.

Danny E. Adams, who will remain as managing partner of Kelley Drye's northern Virginia office, and Brad E. Mutschelknaus, who managed Kelley Drye's Washington, D.C., office, will continue as members of the firmwide executive committee.

As a result of the merger, Kelley Drye expects to offer new or enhanced capabilities in such areas as international trade and customs, advertising, government relations, environmental and antitrust. The combination also bolsters Collier Shannon's depth in litigation and other practices in Kelley Drye offices in New York, Chicago, Stamford, Conn., Brussels and elsewhere.

Many companies who do business with the state are fearful of violating the law, including the new rules on contact with government officials that could cause them to lose contracts and be barred from doing future business. The State Comptroller’s office is the watchdog agency for ethics violations. Richard Brodsky, as the author of the law, will provide background as to how and why the law was enacted and what it means for companies across New York State.

Last year, Comptroller Hevesi completed a series of audits that showed poor management practices in a number of Long Island school districts. His findings and recommendations are also part of the new laws.
