FITZPATRICK, CELLA, HARPER & SCINTO RECEIVES 2006 BURTON LEGAL ACHIEVEMENT AWARD
Intellectual property law firm Fitzpatrick, Cella, Harper & Scinto is proud to announce that attorneys Nina Shreve and Kristin Blemaster were named recipients of the 2006 Burton Award for Legal Achievement for their article, “Clearing a Trademark for Use,” originally published in the May 2005 issue of General Counsel New York. This year’s award marks the second time the firm has received this prestigious honor. Fitzpatrick, Cella attorneys also received a 2004 Burton Legal Achievement Award.

Each year, The Burton Foundation, in association with The Library of Congress and its Law Library, honors lawyers based on their writing ability, and in particular, those “who use plain, modern language and avoid archaic, stilted legalese.” This year, 30 law firm award winners were selected from a mass of applications submitted by 1,000 of the largest U.S. law firms.

“We are very pleased and honored to receive the Burton Award for a second time,” said Fitzpatrick, Cella Managing Partner Dominick A. Conde. “This year’s honor is a testament to the caliber of our attorneys’ talent and their dedication to pursue professional excellence in all aspects of their legal practice.”

The awards event will be held on June 12 in the Coolidge Auditorium of the Library of Congress. The guest speaker will be George Will, a Pulitzer prize-winning syndicated columnist and ABC Political Correspondent. Nina Shreve, partner, has significant expertise in all aspects of trademark law, including litigation, prosecution, opinion work and transactional matters. She focuses her practice on licensing & transactions, trademarks and unfair trade practices, where she represents clients in diverse industries, including computers and electronics, pharmaceutical products, consumer healthcare products, industrial machinery and building products. Ms. Shreve obtained a J.D., cum laude, from St. John’s University Law School in 1977, and a B.A. in Liberal Arts from Earlham College in 1973.

Kristin Blemaster joined Fitzpatrick, Cella in the fall of 2005 as an associate. At the time of the article’s publication, she was a law clerk at the firm, and a third year law student at Columbia Law School. Ms. Blemaster focuses her practice on trademark litigation and prosecution. She received a J.D. from Columbia Law School in 2005 and a B.A. from New York University in 2002.

Litigation Attorney James Wagner Joins Dorsey & Whitney Seattle
The international law firm Dorsey & Whitney LLP announced today that James P. Wagner has joined the firm’s Seattle office as a partner in the Trial group. Wagner will focus his practice primarily on insurance coverage, construction and commercial litigation, and product liability/defective design.

Wagner has been a shareholder in the Seattle law firm of Stafford, Frey & Cooper since 1992. Previously, he was a partner at Lane Powell, serving in both the Seattle and Anchorage, Alaska offices.He also worked at Taylor, Brian & Hintze, a Seattle area construction law firm. Wagner is a former Committee Chair of the American Bar Association Forum on the Construction Industry

Wagner’s clients include municipalities, manufacturers, and construction/design firms such as Bechtel, Heery International and CH2M Hill. Wagner has extensive experience litigating insurance coverage claims, as well as trade secret, construction and product liability cases.

Litigation Attorney Lisa Marchese Joins Dorsey & Whitney Seattle
The international law firm Dorsey & Whitney LLP announced today that Lisa Marchese has joined the firm’s Seattle office as a partner in the Trial group. Marchese will focus primarily on commercial litigation, including toxic torts, products liability/defective design, contract disputes, professional liability, construction claims and medical malpractice.

Marchese has been a shareholder in the Seattle law firm of Stafford, Frey & Cooper since 1998. Previously, she was a senior deputy prosecutor at the Office of the King County Prosecuting Attorney in Seattle. She also worked as a legislative counsel to former U.S. Senator Daniel J. Evans and former U.S. Senator Henry J. Jackson Marchese is currently an adjunct professor of law at Seattle University and the University of Washington.

Marchese’s clients include manufacturers, construction/design firms and municipalities such as Alcoa Inc., Bechtel and the City of Bellingham, WA. She has extensive experience litigating toxic tort and products liability defense, construction defect, commercial and insurance coverage.

Buchanan Ingersoll Attorneys Attend Annual Brownfield Leadership Summit
May 3, 2006 — Attorneys Brian J. Clark and James O'Toole, Jr. attended the Third Annual Brownfield Leadership Summit sponsored by the National Brownfield Association (NBA). Clark and O'Toole are shareholders in Buchanan Ingersoll's Harrisburg and Philadelphia offices respectively.

The three-day program, held in Washington, D.C., included congressional briefings; a planning session in which Clark and O'Toole helped to develop the National Brownfield Association's comprehensive organizational strategy for addressing brownfield development and legislation; and meetings with national property owners and developers looking to develop contaminated brownfield sites. As members of the NBA Pennsylvania Chapter's Executive Committee, Clark and O'Toole were invited to participate in an invitation-only executive session, as well as the public session. They also held private client briefings with several Buchanan Ingersoll clients.

O'Toole also had the opportunity to meet with Congresswoman Melissa Hart and her staff during the event as part of a continuing dialogue on current and proposed brownfield legislation to address funding and liability concerns of impaired property owners and real estate developers in the marketplace. Clark briefed Pennsylvania Senator Rick Santorum, as well as Congressmen Charles Dent and Michael Fitzpatrick and their respective staffs, on the success of Pennsylvania's brownfield initiatives and the role the federal government can play in advancing brownfield development at the local level.

State Bar of Texas Announces Gib Walton President-elect; Bill Miller to Lead TYLA
State Bar of Texas officials today announced that Gib Walton of Vinson & Elkins LLP in Houston has been named president-elect in a statewide election of Texas attorneys. Bill Miller of Texarkana has been elected president-elect of the Texas Young Lawyers Association (TYLA).

Walton, a partner with Vinson & Elkins LLP since 1982, served as president of the Houston Bar Association, and chair of the Houston Bar Foundation and Houston Volunteer Lawyers Program. He has served on the State Bar Board of Directors, the Executive Committee, and chaired the Finance Committee. Walton led the Bar through a successful Sunset Review as chair of the Sunset Review Committee during the 2003 legislative session. A member of the Pro Bono College and College of the State Bar, the Bar has recognized him with the State Bar Presidents' Award, Judge Sam Williams Leadership Award, and Michael J. Crowley Award.

Walton's community service includes serving on the board of directors of the Texas Equal Access to Justice Foundation, Methodist Hospital, Brookwood Community and the South Texas College of Law. He earned a B.A. from the University of Virginia, and a J.D. from the University of Texas School of Law. Walton is board certified in Civil Trial Law, and is an elected member of the American Board of Trial Advocates, the Garland Walker American Inn of Court, and the International Society of Barristers.

He will serve a one-year term as president-elect before assuming the presidency in June 2007. Walton and his wife, Martha, have two children, Cole, 23, and Emily, 19.

Bill Miller, a partner in the Texarkana firm of Greer, McCasland & Miller LLP, has been elected president-elect of the Texas Young Lawyers Association. Miller currently serves as chair of the TYLA Board of Directors. He has been an advisor to and worked on 14 TYLA committees, received the TYLA President's Award of Merit in 2002, and was named Outstanding Director in 2003. He is a founding member of the Texarkana Young Lawyers Association, and has served as its president and vice president.

Miller received a B.A. from Vanderbuilt University and a J.D. from Texas Tech University School of Law. He and his wife, Jessica, have three sons, Davis, Austin, and Mason.

The State Bar of Texas is an administrative agency of the Supreme Court of Texas. The Bar provides educational programs for the legal profession and the public, administers the minimum continuing legal education program for attorneys, and manages the attorney discipline system.

Ralph Bean Named Foundation Fellow
Ralph J. Bean, Jr., a member in the law firm of Steptoe & Johnson PLLC, has been named Foundation Fellow by the West Virginia Bar Foundation. The Fellows Program recognizes outstanding leaders of the legal profession in West Virginia. He will join a distinguished group of lawyers and judges whose professional, public and private careers have demonstrated outstanding dedication to the welfare of their communities and honorable service to the legal profession. The individuals selected to become Foundation Fellows reflect the diverse nature of the legal profession in West Virginia.

Bean concentrates his practice in the areas of economic development, international and domestic business matters. He has an extensive background in government relations, public utility and energy concerns. He began his practice as corporate counsel for C&P Telephone Companies. Bean served as Elections Chief in the office of then Secretary of State Jay Rockefeller from 1970 to 1972. In 1974, he joined the Consolidated Natural Gas System (CNG) as corporate counsel and was appointed general counsel of Hope Gas Inc. in 1984. In 1986, he was named president of Hope Gas and held this position until December 1995 when he joined Steptoe & Johnson as a member of the firm.

A recognized West Virginia business leader, Bean co-chaired the Economic Development Task Force for Governor Bob Wise’s Transition Team. He is a member and past chair of the WV Council for Community & Economic Development, which is responsible for the State’s economic development strategy; is chair of the Center for Entrepreneurial Studies & Development at WVU; is past Chair of the WV Business Roundtable, an organization for WV CEO’s; and is past chair of the I-79 Development Council, a regional economic development group in north central WV. He has participated in two WV trade missions to Asia and serves on the boards of: Discover the Real WV Foundation; WV Chamber of Commerce; Claude Worthington Benedum Foundation; WVU Foundation; Huntington National Bank WV; National Technology Transfer Center; and the Blanchette Rockefeller Neurosciences Institute. Bean is past Chair of the WV Oil & Natural Gas Association, the WV State Election Commission and the Young Lawyers Section of the WV State Bar. He was the 1993 recipient of the Order of Vandalia award for distinguished service presented by WVU and received the University's Most Loyal West Virginian award in 1992.
