Hogan & Hartson Adds Top Litigators to its Growing Miami Office
Hogan & Hartson L.L.P. announced today that prominent South Florida litigation lawyer John F. O’Sullivan has joined the firm’s Miami office as a partner. O’Sullivan is joined by associates Julie E. Nevins and Jason Kellogg, both members of the firm’s litigation practice.

O’Sullivan is a highly accomplished lawyer whose practice focuses on sophisticated commercial litigation matters, particularly in the areas of intellectual property, antitrust, and business disputes.

“John’s extensive courtroom experience and broad knowledge in complex commercial litigation matters is of tremendous value to our firm’s clients, both in South Florida and nationally,” said Parker Thomson, managing partner of Hogan & Hartson’s Miami office. “We are delighted to have John join our Miami office – now 30-plus lawyers strong – as we further develop our firm-wide litigation practice.”

O’Sullivan represents companies in a wide range of litigation and corporate compliance cases. He has substantial experience in arbitration, banking litigation, and resolving international disputes.

Prior to joining Hogan & Hartson, O’Sullivan was a partner at another major law firm in Miami and before that worked for several years at a top litigation firm in New York City. He has been consistently ranked among South Florida’s top litigation lawyers by publications such as Florida Trend and the South Florida Legal Guide. He is also the recipient of the Legal Aid Society’s Outstanding Volunteer Lawyer Award for his extensive pro bono work.

O’Sullivan received his law degree from The George Washington University Law School and his bachelor’s degree from the University of Massachusetts at Amherst. Following law school, O’Sullivan served as a law clerk to The Honorable William H. Timbers on the U.S. Court of Appeals for the Second Circuit.

Nevins received her law degree from Florida State University College of Law and her bachelor’s degree from Vassar College. Kellogg received his law degree from Florida State University College of Law and his bachelor’s degree from Northwestern University.

Kathy J. Tayon joins Fowler White Boggs Banker

Tayon has joined the firm as a shareholder from McDermott, Will & Emery in Miami, Florida where she was a partner. She joins Linda M. Robison and Mark D. Duane Morris Partner Appointed to New Jersey District Export Council
Duane Morris LLP is pleased to announce that Steven M. Richman, a partner in the Trial and International Practice Groups in its Princeton office, has been appointed to the New Jersey District Export Council. The appointment to the position by the U.S. Secretary of Commerce is an acknowledgement of Steven's contributions to the New Jersey business community as well as his extensive experience in international law.

The New Jersey District Export Council assists companies attempting to export their products through a combination of advisory services, trade promotion/education and networking opportunities statewide. DEWEY BALLANTINE ANNOUNCES INTELLECTUAL PROPERTY LITIGATION APPOINTMENTS
Dewey Ballantine LLP, a leading international law firm,
announced today that Jeannine Sano and Cono A. Carrano have been named to co-chair the firm’s
intellectual property litigation practice. Mr. Carrano is a partner resident in the firm's
Washington D.C. Office and has been recognized in Best Lawyers in America 2007. Ms. Sano is
the managing partner of the firm's East Palo Alto Office and current chair of the ITC Committee
of the American Bar Association IP Law Section. Dewey Ballantine has over thirty attorneys in
the IP Group firmwide.

Significant IRS Enforcement Initiatives Announced
Highlights from the May meeting of the American Bar Association’s tax-exempt finance committee were published in The Bond Buyer under the headline “IRS: Major Audits to Come on Derivatives, 501(c)(3) Deals.” Blank Rome partner Jeremy Spector moderated the enforcement panel at the meeting held in Washington D.C. Mr. Spector, who chairs the American Bar Association Subcommittee on IRS Enforcement, is quoted on the prospect of a parallel voluntary compliance regime, and the potential of a fast track settlement process.

The IRS will launch two “significant” enforcement initiatives by early summer, and is on the brink of revamping its operations manual. The agency is also developing a “parallel” voluntary compliance regime that will expand upon the existing voluntary closing agreement program or VCAP. Spector said the parallel program could be very useful.

“If it is well-structured, it has the potential to encourage and promote voluntary compliance on a large scale,” he said. “I am very pleased that the IRS plans to release the program and accept comments from the industry.”

A fast track settlement process is another new TEB effort being discussed by the wider Tax-Exempt/Government Entities and Appeals divisions.

Spector said a fast track settlement program has great promise. “As designed and currently used by the LMSB division of the IRS, the program can handle both legal and factual issues.” It should be successful, he continued, because an independent party will take an early look at cases while they are still under the TEB office’s jurisdiction and recommend settlement terms, prompting parties to re-examine the merits of their positions earlier in the audit process.

“If the parties are still unable to reach agreement, either party can withdraw from the fast track program,” Spector said. “Failure to reach agreement will not use up an issuer’s appeal right.”

Jeremy Spector serves as chair of the American Bar Association Subcommittee on IRS Enforcement and is currently serving a three–year term on the faculty of NABL Bond Attorneys’ Workshop. He represents clients in IRS enforcement actions, Circular 230 matters, and on the tax aspects of public finance transactions for:

Mr. Spector is a tax columnist for the National Association of Bond Lawyers quarterly journal The Bond Lawyer. He is often called upon to comment on tax and public finance issues for many prominent media outlets, such as Bloomberg News, The Bond Buyer, and the Wall Street Journal. Mr. Spector has been actively involved in obtaining private letter rulings and submitting comments to the IRS on proposed regulations affecting tax-exempt bonds since 1984. He has handled over 2,000 transactions with an aggregate dollar volume greater than $50 billion.
