Bingham, Flaschen, Silverman Earn Top Rankings
Bingham McCutchen and Hartford partner Evan Flaschen were rated the No. 1 special counsel law firm and No. 1 special counsel lawyer, respectively, based on active cases through April 24, 2006, according to The Deal's Bankruptcy Insider. Bingham McCutchen had 14 active cases in which it was hired as special counsel, while Flaschen led the way among individual special counsel lawyers with seven active cases. Meanwhile, in the April 15 issue of Turnarounds & Workouts, Ron Silverman, a partner in Bingham McCutchen's Financial Restructuring group in New York, was named one of the country's "Outstanding Young Restructuring Lawyers." Among Silverman's major "outstanding achievements" highlighted were his representation of bondholders in Mirant's $1.5 billion leveraged lease transactions; holders of $1.5 billion in Delta Airlines bonds; major creditors in Enron; and bondholders in the TermoEmcali US-Columbian restructuring.

Curcio Appointed to Ethics Committee
Benjamin C. Curcio of St. John & Wayne, Newark, has been appointed to a four-year term as a member of the District VA Ethics Committee (Essex County), effective September 1, 2006. The Office of Attorney Ethics (OAE) -- the investigative and prosecutorial arm of the Supreme Court of New Jersey -- manages 17 district ethics committees throughout the state. It is the task of the district ethics committees to assist OAE in discharging the Court’s constitutional responsibility to supervise and discipline New Jersey attorneys. Curcio is an associate in the Civil Litigation Department at St. John & Wayne where his practice is focused on complex commercial litigation and general civil litigation.

Stephen M. Goodman Chairs Conference on Corporate Governance
Pryor Cashman partner Stephen chaired "Beyond Legal : A Business Approach to Corporate Governance" organized by the American Bar Association's Tort Trial & Insurance Practice Section at Le Parker Meridien Hotel on May 11-13, 2006. The core theme of Beyond Legal is the nature of the relationship among responsible corporate behavior, corporate profitability and litigation risk, including discussions on various approaches to structuring internal processes (such as compensation decisions and internal controls) and may affect this relationship. The conference also analyzed the factors that encourage "good" corporate behavior.

Goodwin Litigator Helps Secure Victory for Tuna Canners
After a two month trial, presiding Judge Robert Dondero of the San Francisco Superior Court issued an opinion today finding that California's Proposition 65, which requires companies to warn consumers of products containing hazardous ingredients, does not require methyl mercury warnings on canned tuna. California's Attorney General Bill Lockyer sued to compel warnings and sought millions of dollars in penalties from three principal tuna manufacturers, Del Monte (Starkist), BumbleBee and Tri-Union Seafoods (Chicken-of-the-Sea), as well as the United States Tuna Foundation.

The Court ruled in favor of the tuna canners on all issues — that the state law is preempted by a federal Food and Drug Administration advisory encouraging fish consumption, that mercury levels are not high enough to warrant health warnings, and that tuna is exempt because mercury in ocean fish is naturally occurring.

Goodwin Procter partner Forrest Hainline represented the tuna canners in this trial.

Fred P. Baggett Joins Smith Moore
High Point City Attorney Fred Baggett has joined the law firm, Smith Moore LLP as Counsel. At Smith Moore, Baggett will continue to head legal affairs activities for the City of High Point, working from his current office in High Point.

Baggett brings to Smith Moore 35 years of experience in virtually all matters related to local and state government law and regulation. In addition to continuing to serve High Point, Baggett's practice at Smith Moore will focus on municipal zoning, government regulation, land use, and government relations.

""The addition of Fred to our legal team will greatly improve the efficiency and effectiveness of the legal services that Smith Moore provides to the City of High Point,"" said Managing Partner Steve Earp. ""At the same time, his availability to consult on matters involving almost any aspect of municipal law and regulation will greatly strengthen the services that Smith Moore provides to its other governmental clients.

""Smith Moore has an active practice representing numerous municipalities in various parts of the state, and Fred's statewide reputation as an experienced and extremely qualified practitioner in municipal law makes him a valuable addition to our firm's capabilities,"" Earp added.

Baggett has been City Attorney in High Point since 1990. Previously, he was Associate City Attorney in Raleigh, and worked as General Counsel for the North Carolina League of Municipalities. He earned his undergraduate and law degrees from UNC Chapel Hill, and was admitted to the North Carolina Bar in 1971.

Adrienne J. Roach Elected as Chairperson of CBA Domestic Relations Committee and Trustee of CBF
Adrienne J. Roach, partner at Keating Muething & Klekamp, recently was elected to serve a 2 year term as Chairperson of the Cincinnati Bar Association Domestic Relations Committee as well as a 2 year term as Trustee of the Cincinnati Bar Foundation.
