Elizabeth Moore, Nixon Peabody Partner, Receives Prestigious “Diversity Champion” Award from New York City Bar Association
Elizabeth D. Moore, a partner and labor and employment attorney with Nixon Peabody LLP, has been named a recipient of the New York City Bar Association’s Diversity Champion Award. The award recognizes the critical role individuals have played in initiating and sustaining change within their organizations and in the overall New York City legal community.

Often described as a “driving force” behind Nixon Peabody’s goal to foster an inclusive work environment, Ms. Moore also counsels organizations across the country on ensuring their work environments are free from harassment and discrimination. At Nixon Peabody, she has been instrumental in spearheading a diversity initiative that works to create and maintain a diverse and inclusive environment in all areas of the firm, from the recruitment and retention of legal professionals and personnel to new business development and client service. As co-chair of the firm’s Diversity Action Committee, Ms. Moore has helped to initiate many important initiatives in a short amount of time.

Founded in 2004 and championed by the chairman of the firm, the Diversity Action Committee is responsible for implementing a firmwide diversity platform. Ms. Moore has helped to put into place a variety of strategic programs, including diversity training for all attorneys and personnel, the creation of affinity groups, a women’s leadership summit, and a quarterly diversity newsletter. Nixon Peabody is also sponsoring one of the nation’s leading conferences on diversity. “The Case for Diversity: It’s Everybody’s Business” takes place May 22–24 in Rochester, New York, and includes Ms. Moore as a featured panelist. Earlier this year, when Nixon Peabody was named by FORTUNE® magazine as one of the “100 Best Companies To Work For,” it received high marks for its diversity efforts, a testament to the impact of the work already being led by Ms. Moore as co-chair of the Diversity Action Committee.

Ms. Moore focuses her practice on labor and employment law, and is head of Nixon Peabody’s Labor and Employment Practice Preventive Services Team. In her employment law practice, she counsels employers, including Fortune 500 companies, universities, and public sector entities, to ensure that they maintain workplaces free from harassment and discrimination, and remove invisible barriers to recruitment and advancement. At her alma mater, Cornell University, Ms. Moore chairs a board of trustees committee that sponsored a first-of-its-kind conference to bring minority alumni together on campus to discuss with faculty experts critical issues affecting minority communities and to provide alumni of color opportunities to guide current students as mentors. As a trustee of the Rochester Institute of Technology, she serves on presidential task forces created to look at issues that impact women and the gay, lesbian, bisexual, and transsexual community, as well as minority students, faculty, and staff at the university.

In awarding the Diversity Champion Award, the New York City Bar Association evaluated eligible candidates based on a list of criteria that included the influence the candidate has had on others, the candidate’s ability to be a positive role model, the extent to which the candidate has continued to learn, the cultivation of diverse teams, innovation and risk taking ability, accountability for fostering an atmosphere of diversity, and external leadership involvement. Ms. Moore is among three candidates receiving this year’s Diversity Champion Award. Other recipients include Hon. Daniel M. Donovan, Jr., District Attorney, Richmond County; and William Malpica, Associate, Mayer, Brown, Rowe & Maw LLP.

Federal Judge Certifies Class of Former Law Students Suing BAR/BRI and Kaplan, and Installs Special Master
McGuireWoods LLP partner Eliot Disner, the plaintiffs’ lead counsel in a case against the largest provider of bar review courses, announced that a U.S. district court granted class certification on behalf of approximately 300,000 law students. The hearing for Ryan Rodriguez v. West Publishing Corp., No. 05 CV 3222 (C.D. Calif.) was held yesterday, and the order was entered today by the Honorable Manuel Real of the U.S. District Court for the Central District of California.

The eligible students took West's BAR/BRI course to help them prepare for the bar exams given in every state and the District of Columbia between 1997 and 2006. BAR/BRI estimates that 85-95 percent of all law students sitting for the bar have taken its course.

“After reviewing massive filings and hearing arguments from both sides, the judge granted certification and held ‘this case will now proceed as a class,’” Disner said. ""If we prove BAR/BRI and Kaplan, Inc. violated the antitrust laws, several hundred thousand young lawyers who paid too much for their bar prep courses will get some of their money back,"" Disner added.

Among other things, the lawsuit accuses BAR/BRI of an illegal market division agreement with its largest potential competitor, Kaplan. It agreed with BAR/BRI to stay out of the bar review course market, on the condition that hundreds of thousands of dollars per year be paid to it, and that BAR/BRI also stay out of Kaplan's LSAT prep course market. Disner said the claimed conspiracy appears to have resulted in class members being overcharged as much as $1,000 each.

The court also ordered that a Special Master be appointed at plaintiff's urging, prompted by the chronic failure of the defendants to provide discovery reasonably requested. The master will expedite future proceedings in this matter in preparation for the September 12, 2006, trial date.
