Morgan Stanley’s Former Litigation Head Joins Orrick
James P. Cusick, a uniquely qualified, highly experienced commercial litigator and trial lawyer, has joined Orrick, Herrington & Sutcliffe LLP as a partner in the New York office.

Cusick brings a rare blend of experience to Orrick. He has served both as an outside legal advisor to Fortune 500 companies while a senior partner at Kirkland & Ellis and as in-house counsel while a managing director at Morgan Stanley. Cusick also has an accounting background. That combination of trial experience, Wall Street background and financial acumen complements Orrick’s robust litigation practice, particularly in the financial services sector.

At Kirkland & Ellis, where he was a partner from 1989 to 2000, Cusick handled high-stakes trials and appeals in securities, accounting malpractice, products liability and shareholder derivative cases for some of the world’s leading corporations. He successfully defended companies against charges of accounting fraud, securities and ERISA violations and patent infringement, as well as products liability lawsuits and nationwide consumer fraud actions. Cusick was a managing director at Morgan Stanley from 2001 to 2006, most recently serving as Global Head of Litigation. His experience as in-house counsel reinforces Orrick’s commitment to a collaborative relationship with its clients.

“Jim Cusick is a top-flight lawyer and a first-rate individual,” said James Stengel, managing director of Orrick’s litigation division. “He is a strong addition to our internationally recognized litigation practice and fits in well with the firm’s plan to expand its commercial litigation practice in New York, particularly in the financial sector and for investment banking clients.”

Cusick is the second high-profile commercial litigator in two months to join Orrick’s New York office. Former Dewey Ballantine partner Michael Hefter, who was named by The National Law Journal in 2002 as one of the top 40 lawyers under the age of 40, joined Orrick on April 13.

In addition, Fabio Marino, formerly the co-head of IP at Bingham McCutchen, joined the firm in Silicon Valley in April. Three corporate partners also have joined Orrick in New York this month.

“I am very excited to join Orrick’s New York office,” said Cusick. “The firm is a litigation powerhouse with depth in all practice areas. Orrick is a firm on the rise, and I am very happy for the opportunity to be part of the firm’s growth.”

Over the last two years, Orrick increasingly has been recognized for its litigation prowess. The American Lawyer named Orrick to its list of “Distinguished Dozen” firms in its January 2006 “Litigation Department of the Year” issue, and The National Law Journal named Orrick one of 10 firms on its “Defense Hot List” in 2005. Lawyers in the litigation division have been ranked among the nation’s best in securities litigation, white-collar crime, employment law, intellectual property and products liability. Chambers USA: America’s Leading Lawyers for Business, cited Orrick as one of the leading U.S. firms for products liability litigation.

“By any measure, Orrick has one of the strongest litigation practices in the world,” said Peter Bicks, a litigation partner and New York office leader. “The addition of Jim Cusick is a powerful statement that attests to our continued commitment and capability to provide the best litigation services to the New York market and beyond.”

About Orrick’s Litigation Division
Orrick is highly regarded for trying and winning cases. The firm’s 270-lawyer litigation team handles the largest and most complex disputes in general litigation, securities litigation, IP, white-collar criminal defense and employment matters. Clients trust Orrick to manage massive, high-risk litigation and to advise them in matters ranging from pre-litigation strategies to the decision of when and how to try cases.

The litigation division has made several high-profile lateral hires in the past year in New York, Washington, D.C., Paris, London, Moscow, San Francisco and Silicon Valley. In Washington, the firm added three partners, including two former Assistant Chief Litigation Counsels from the Enforcement Division of the Securities and Exchange Commission, Russell Duncan and James Meyers, and a former Assistant U.S. Attorney in the Criminal Division of the U.S. Attorney’s Office for the District of Columbia, Preston Burton. The division expanded dramatically in London and Moscow in June 2005, when more than 50 lawyers joined from Coudert Brothers, and in Paris in January 2006 with the merger with Rambaud Martel. In March 2005, a three-lawyer team from DLA Piper Rudnick Gray Cary, including former co-chair of Gray Cary’s white-collar practice group, Ed Davis, joined the firm’s San Francisco and Silicon Valley offices.
