Bankruptcy/Restructuring

Chambers writes: ""A top-flight Delaware firm,"" clients say this multiservice outfit is at the top of the list for debtor-oriented work. Fielding a 30-strong team, including nine dedicated partners, this is one of the largest departments in the state and clients value the ""depth of talent available at every level."" It primarily represents debtors but is also commended for its work on behalf of creditors and creditors' committees and its expertise in mass tort bankruptcy proceedings. The department has both built on its established relationships with out-of-state law firms and achieved some high-profile successes as lead counsel during the past year.

Firm chairman James L. Patton, Jr.: Chairman of the firm and ""all-around class act"" described by clients as ""an even-keeled, unflappable attorney at the top of his game."" A nationally prominent figure, he is particularly acclaimed for his involvement in large asbestos bankruptcies. An ""outstanding bankruptcy lawyer.""

Robert S. Brady: ""A lawyer who cut his teeth on bankruptcy in the 90's and really made an impact,"" he is well versed in all aspects of the Chapter 11 restructuring process.

Pauline K. Morgan: A “strong attorney,"" Commentators point to her broad-based skill set as a defining feature.

Michael R. Nestor: A terrific strategist and a consensus-building, practical guy,"" Nestor is a firm favorite of clients and peers alike.

Brendan Linehan Shannon: is renowned for his experience of representing official committees in Chapter 11 cases.

Chancery

Chambers writes: ""Among the top firms in the Delaware hierarchy,"" this corporate counseling and litigation group is recommended both for its litigation avoidance techniques and for pursuing litigation in the Court of Chancery. An established favorite of clients, it is commended for its profile in stockholders' and derivative litigation and its experience in takeover battles. Rather than pointing to a particular type of case, clients applaud this firm for its experience in every type of corporate dispute. It was notably involved in one of the longest-running cases in the Court of Chancery, In Re The Walt Disney Company Derivative Litigation.

David C. McBride: Commonly referred to by clients as ""the firm's number-one corporate litigator"" he is well versed in litigation arising out of M&A transactions as well as a popular port of call for corporate counseling.

Bruce L. Silverstein: Chairman of the firm's corporate litigation and counseling section, he is considered to be among ""the new guard of great chancery litigators"" and both prosecutes and defends corporate and commercial matters.

Corporate/M&A

Chambers writes: This large, multiservice firm attracts national and international clients and sources agree that it is ""not to be underestimated"" for corporate work. Clients and peers note that the corporate counseling and litigation department is most prominent and experienced in terms of litigation. However, its litigious prowess has led to the department's involvement in a range of transactions, and it is widely recommended for its advice on takeover battles and related stockholder disputes.

David C. McBride: ""Clearly among the best corporate attorneys in the state,"" He is as well versed in complex litigation as he is in advising on transactional issues, and is noted for his ""meticulous representation"" of leading national corporate clients.

Norman M. Powell: The corporate profile of the firm has recently been bolstered by the arrival of Powell, who comes highly recommended for his work in the field of alternative entities. He is particularly noted for his niche statutory trusts expertise.

Employment

Chambers writes: Universally acknowledged as Delaware's preeminent employment practice, it boasts the largest team in the state. Its lawyers are said to ""always know exactly what they're doing,"" according to admiring clients. Eight full-time attorneys, assisted by an employee benefits specialist, advise a broad range of public and private sector employers across the full spectrum of employment and labor law issues. On the litigious front, the team often defends clients against class actions relating to discrimination in both state and federal courts, or before the EEOC. Its advisory practice is equally developed, and lawyers advise on all aspects of best practice and workplace protocols, as well as offering bespoke training programs. The team also impressed clients in more traditional areas such as strike control and resolution, and collective bargaining. It drew praise for its ""collegiate and human"" approach.

Sheldon N. Sandler: Possessing a ""wealth of experience"" derived from over 30 years' practice, the admired Sandler is described as ""the father of employment law in Delaware."" His breadth and depth of expertise continue to impress.

Barry M. Willoughby: Involved in all manner of discrimination, whistle-blower and racial or sexual harassment cases. Having successfully defended Ursuline Academy against sex discrimination charges, Willoughby won a case for Waste Management, in which the plaintiff claimed to have been the subject of race discrimination

William W. Bowser: is a seasoned hand when it comes to discrimination cases or representing employers in collective bargaining.

Scott A. Holt: An ""Emerging talent."" His practice includes discrimination and harassment cases, in addition to advising on terminations, trade secrets and wage and hour matters.

Intellectual Property

Chambers writes: The respected IP team at this firm is best known for its capabilities in representing local, national and international clients in patent and trademark infringement matters in state courts. Nine attorneys and one special counsel draw on their commercial litigation experience as well as the expertise of other departments, and are particularly noted for ""their impressive track record in patent litigation."" Lawyers have recently represented Syngenta Seeds in a patent infringement suit brought against Monsanto, which also saw the involvement of Young Conaway antitrust attorneys. Trade secrets and unfair competition advice is also offered, as well as general advisory IP assistance.

John W. Shaw: mixes general commercial lawsuits with IP litigation in the district courts and is respected for his experience in a variety of IP disputes. ""A strong courtroom performer.""

Josy W. Ingersoll: displays ""good, balanced judgment"" and ""knows her way around the courtroom."" Sources observe that she enjoys a high-volume workload primarily focused on patent litigation.

Real Estate

Chambers writes: This firm offers a one-stop shop approach to commercial real estate work and is the largest team in the state, comprising ten attorneys. This means clients are confident in entrusting it with all aspects of complex transactional matters. The outfit is fully equipped to handle acquisitions, leasings, development finance and disposals for major developers, builders and investors. Attorneys recently handled the development, financing, acquisition and condominium creation of the Apex Office Park. The commercial real estate, banking and land use section is also adept at acting for major Delaware lenders. Meanwhile, its prominent position in the new Zoning/Land Use table reflects the firm's highly rated services on the land use front.

Eugene A. DiPrinzio: perceived as being at the heart of the team's commercial real estate practice, working mainly for financial institutions on in-state lending, asset-based loans and development finance. Clients speak highly of his ability to ""simultaneously hit numerous moving targets"" in highly complex matters.

Real Estate: Zoning/Land Use

Chambers writes: The largest real estate team in the state features a sophisticated land use and zoning contingent renowned for its heavy workload and particular flair for assisting national clients on in-state development projects. ""Undoubtedly one of the top teams in Delaware,"" matters handled include land use approvals for major commercial and residential developers. Clients praise the lawyers' ""personal touch"" and excellent connections in an area that is ""about much more than just book law."" Rezoning matters also feature prominently and the team is currently advising one of the country's largest brownfield developers, O'Neill Properties Group, in the redevelopment of a 200-year-old fabric finishing plant into around 1,000 residential properties. Attorneys also advise clients on code compliance, site acquisition and variance matters.

Lisa B. Goodman: Respected as a ""good land use lobbyist,"" head of the real estate, banking and land use department Goodman is a ""sophisticated and competent"" attorney. Her understated style wins her many admirers.

Larry J. Tarabicos: ""First choice for zonings” a high-profile attorney with a ""thorough knowledge of codes, people and practices."" According to clients, he ""excels where you need to think on your feet"" and also takes on commercial real estate cases.

Two additional McLane Employment law group members were added to the tables this year -- Cameron Shilling and Andrea Chatfield. Clients of Ms. Chatfield, who heads the counseling and risk management side of the firm's employment practice noted, ""She is very good at focusing on the real implications of the decisions employers make."" Mr. Shilling is recommended for his expertise in trade secrets and non-competition agreement litigation. Clients report he ""is always prepared and on top of the material.""

These 13 McLane attorneys have been recommended as leading lawyers in New Hampshire in their areas of practice and are included in the book's editorial.

Chambers USA researchers conducted over 10,000 interviews with attorneys and clients across the U.S. in order to rank attorneys on a scale of one through six based on their reputation in the market. The New Hampshire section of the book ranks lawyers in four practice areas: Corporate M&A, Commercial Litigation, Real Estate and Defendant Employment.

Qualities assessed included technical legal ability, professional conduct, client service, commercial astuteness, diligence and commitment. For each firm referenced, the directory provides detailed quotations from clients and peers, a list of practice strengths, an overview of recent work and a client listing.

""Over the past year, the legal marketplace has spoken extensively to Chambers and our guides reflect its judgment and opinions,"" said Fiona Boxall, Director of Chambers and Partners and Managing Editor of the directories.
