Ashurst advised the Protherics Group on the acquisition of adjuvant technology from CoVaccine BV
Ashurst advised the Protherics Group on the acquisition of adjuvant technology from Dutch pharmaceutical company, CoVaccine BV.

An adjuvant is a substance added to a vaccine which maximises the production of antibodies and enhances the immune response. The adjuvant will be added to Protherics' Angiotensin vaccine, used to treat hypertension. Protherics has recently completed non-clinical safety testing of the new adjuvant and is commencing GMP manufacture of both the adjuvant and the vaccine.

The Ashurst team comprised intellectual property solicitor Dominic Batchelor and corporate partner Andrew Edge.

De Brauw Blackstone Westbroek assisted Ashurst on Dutch legal aspects.

Ashurst is acting for Healthcare at Home Limited in relation to a damages claim made to the Competition Appeal Tribunal
Ashurst has lodged the first claim for damages with the Competition Appeal Tribunal in the UK for breach of the Competition Act 1998 relying upon a finding of the Office of Fair Trading to establish liability.

The claim has been brought against Genzyme Limited in relation to a 2003 Office of Fair Trading decision and subsequent judgment of the Competition Appeal Tribunal which ruled that Genzyme had breached the Competition Act 1998 in its provision of a treatment for Gaucher's Disease to the NHS. By fixing a price for the drug which prevented providers of homecare delivery and nursing services for the treatment from competing with Genzyme's in-house homecare provider, Genzyme was deemed to have abused its dominant position through the application of an illegal margin squeeze.

Ashurst advised Wm Morrison Supermarkets PLC on the service agreement for its new CEO
Ashurst advised Wm Morrison Supermarkets PLC (Morrisons) on issues relating to the appointment of its new chief executive, Marc Bolland.

Marc Bolland will chair the Morrisons executive board, taking responsibility for the group's commercial and strategic development. He joins Morrisons from Heineken NV, where he was chief operating officer.

Ashurst's head of employment, Caroline Carter, advised the company's remuneration committee on the terms of appointment and service agreement for the new CEO. Employee incentives partner Barbara Allen advised on the equity incentive arrangements and pensions partner Steven Hull advised on the pensions aspects of the agreement.

New Edition of 'The EC Merger Regulations: Substantive Issues
Alistair Lindsay, a partner in our Antitrust Group based in London, has recently published the second edition of his already well established reference work on the treatment of substantive issues under the EC Merger Regulation (i.e. the principles that determine whether a merger will be cleared, prohibited or cleared subject to undertakings). The first edition was described in a European Competition Law Review article as a "masterpiece".

This new edition has been extensively rewritten to reflect legal developments, including the interpretation of the new significant impediment to effective competition test and the structuring of transactions when remedies are expected.

The strength of the book lies in the fact that the legal analysis is integrated with an explanation of the underlying economics and supported by a comparative analysis. The text is written from the perspective of a practitioner dealing with the EC Merger Regulation and provides a practical focus.

Silver has been tapped as a “new breed” of attorney, whose experience and personality allow him to serve in a legal mentoring role, guiding young attorneys in their professional/ business development efforts. In his previous endeavors, he served as a mentor for a number of outstanding young lawyers, and he brings those skills to Shughart, Thomson & Kilroy.

Having practiced law since 1989, Mr. Silver opened a sole practice in 1995. Over the next eight years he developed a highly successful commercial practice. His practice grew to five lawyers handling a variety of business and real estate litigation and transactional matters for his mostly Phoenix based clients, including two of Phoenix’s Fortune 1000 retailers. In 2003 Mr. Silver became affiliated with a larger national firm combining offices in Seattle and Phoenix.

Silver joins Shughart, Thomson & Kilroy at a critical point in his career where he represents businesses nationally and internationally, while continuing to represent Phoenix and Arizona based businesses of all sizes. He has handled a variety of high profile legal matters and class action suits, and his background (as both lawyer and client) in personal service contracts, public image, and privacy rights, has brought him celebrity clients and national media prominence.

In addition to his substantial professional achievements, Mr. Silver has been active in numerous bar and civic activities, and supports civic organizations throughout Arizona. In 1999, he was presented with the prestigious Let Freedom Ring, Legal Community Leadership Award, in recognition of his years of volunteer community legal service. In 2005, Mr. Silver founded the Liberty Project, a “think-tank” made up of law students and young professionals seeking to protect and promote reproductive rights. He has spoken publicly on an array of issues regarding the constitutional right to privacy, sexual and reproductive freedom, as well as contraception and the right to choose. He has participated as a volunteer advocate and served as the Chairman of the Board of Directors for Planned Parenthood. Leon also serves on the Community Advisory Committee for the “Advocacy for the Arts,” a non-profit advisory organization for artists and authors. When he is not practicing law, Silver’s substantial talents extend to the performing arts; he paints, writes, records and performs music.

A graduate of St. Lawrence University (B.A. Fine Arts, 1984), Mr. Silver received his J.D. in 1989 from Arizona State University. He is a member of the Arizona State, Federal, and Bankruptcy Courts, the 9th Circuit Court of Appeals, and he serves as a Judge Pro Tempore of the Maricopa County Superior Court.

Brinks Hofer Gilson & Lione Ranks Among the Largest Law Firms in Illinois
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the country, is ranked as the 26th largest law firm in Illinois, according to Chicago Lawyer magazine’s 2006 annual survey. The survey, published in the June 2006 issue of Chicago Lawyer, is based solely on the number of attorneys practicing in Illinois. Brinks is the largest firm in Illinois dedicated solely to the practice of intellectual property law on the survey. Brinks continues to move up in the rankings from 28th in 2004 to 27th in 2005 and now to the 26th slot in 2006.
