Supreme Court Decides Landmark Wetlands Cases
On June 19, 2006, the United States Supreme Court issued its long-awaited ruling addressing the scope of Clean Water Act (“CWA” of “Act”) authority over remote hydrologic features. The opinions delivered in the consolidated cases of Rapanos v. United States and Carabell v. U. S. Army Corps of Engineers, 126 S. Ct. 2208 (2006), represent some of the most highly anticipated of the Court’s 2006 term. Since oral arguments were held on February 21st, the important issues implicated by these cases have been the subject of careful scrutiny, debate, and concern by all levels of government, private landowners, and environmental interest groups alike. The 5-4 plurality decision for the property owners vacated the rulings of the lower courts in Rapanos and Carabell, which had upheld the extension of federal CWA jurisdiction to the wetlands in both cases. Unfortunately, while the Court reconfirmed that the federal government’s authority under the Act is not infinite, the decision failed to distill for the regulated community the precise scope of that authority.

Prominent San Francisco Land Use Attorney Steven Vettel Joins Farella Braun + Martel
Farella Braun + Martel announces today the addition of Steven L. Vettel as a partner in its San Francisco office. A prominent land use attorney whose successful entitlement work for several major developers has helped shape San Francisco's skyline, Vettel joins Farella Braun + Martel's thriving Real Estate Department from Morrison & Foerster LLP.

Vettel's practice focuses on land use, zoning, legislative advocacy, environmental review and redevelopment law. He regularly appears before planning commissions, legislative bodies, redevelopment agencies and zoning officials to advocate on behalf of real estate developers, property owners and governmental agencies. In addition, Vettel counsels on California Environmental Quality Act (CEQA) compliance and defends his clients' environmental review documents in both administrative and judicial forums.

""Steve's high level work in the CEQA arena and strong background in redevelopment law deepen our bench in this area, as well,"" said Buzz Hines, chair of Farella Braun + Martel's Environmental Law Department.

Vettel has successfully represented several major residential developers in obtaining land use entitlements for the construction of some of the City's largest high-rise residential buildings, including the 55- and 45-story One Rincon Hill project that recently broke ground at the foot of the Bay Bridge. In the face of tough opposition, he also obtained land use entitlements for redevelopment and improvement of several shopping center properties; negotiated zoning amendments and land use entitlements for mixed-use development projects on land formerly zoned exclusively for industrial use; negotiated the land use entitlements for development of a major hotel project on property owned by the City and County of San Francisco's municipal railroad; and, successfully defended the San Francisco Redevelopment Agency in litigation before the California Superior Court, Court of Appeal and Supreme Court, upholding the Agency's expansion of an existing redevelopment area and the approval of a mixed-use project incorporating portions of an historic downtown property.

Vettel earned his J.D. from the University of California at Berkeley School of Law (1984), and received his B.A. from Stanford University (1977).

Farella Braun + Martel's Real Estate Department has handled the acquisition and disposition of billions of dollars worth of commercial properties in Northern California. Many of these transactions required the creation of sophisticated ownership structures, ground leases, tax and historic tax planning, complex financing arrangements, and the resolution of significant environmental issues. The firm has developed strategic capabilities in condo-conversion, hotels and resorts, public/private partnerships and luxury and mega-luxury fractional ownership developments. In 2005, FBM represented The Swig Company in the acquisition of the Kaiser Center in Oakland, a 900,000-plus square foot mixed-use complex, which was honored as a ""Real Estate Deal of the Year"" by the San Francisco Business Times on March 23, 2006. In April 17, 2006, FBM ranked #8 on the California Real Estate Journal's list of ""California's Major Real Estate Law Firms."" On May 30, 2006, Jeanne M. McKinney joined FBM as a real estate associate from Thelen Reid & Priest's San Francisco office.

Telisport Putsavage has nearly twenty years of experience in environmental law and regulation with a significant focus on pesticides. Mr. Putsavage counsels pesticide producers, distributors, retailers and trade associations on federal and state pesticide regulatory and business matters, including product registration and cancellation, compliance and enforcement, and data compensation arbitrations. He is particularly well versed in issues arising from federal preemption of state pesticide law, having developed successful litigation strategies in precedent setting cases. Mr. Putsavage served as Assistant Counsel for the New York State Department of Environmental Conservation (NYSDEC) and served as an Assistant Attorney General representing the Maryland Department of the Environment. Mr. Putsavage's government experience encompassed a wide range of issues, including litigation defense, prosecuting enforcement cases, field investigative techniques, and drafting and negotiating major pesticide legislation and testifying before legislative hearings.

Robert Butz is a biochemist with over twenty five years of pesticide-related experience. Dr. Butz assists clients in the area of environmental fate, residue chemistry and product chemistry. Dr. Butz has a broad knowledge of pesticide issues and is especially able to handle the regulatory/scientific interface. He has extensive experience in registering foreign sources of active ingredients with EPA, and related data compensation issues.

Morgan Lewis Named Top Corporate Law Firm in Philadelphia for 5th Consecutive Year: Also Among General Counsel\'s Top 20 Firms Nationwide
Corporate Board Member magazine announced that directors working in Philadelphia named Morgan, Lewis & Bockius LLP the best corporate law firm in the city for the 5th consecutive year.

The magazine's sixth annual Legal Research Study, sponsored by consulting firm FTI, surveyed directors serving on boards of publicly traded companies. Respondents were asked to select the five local law firms they would most likely select to aid their companies on a broad range of corporate legal issues. Corporate Board Member will publish the results in their July/August issue.

Corporate Board Member and FTI also teamed up to survey corporate general counsel, asking them to name the firms they would most want to engage for national matters. Morgan Lewis was listed among the top 20, sharing the 17th slot with two other national firms.

Cathy Fleming to Be Sworn in as President of the National Association of Women Lawyers
Cathy Fleming, a Partner in the Litigation Department in the New York and New Jersey offices of the national law firm of Edwards Angell Palmer & Dodge, will be sworn-in as President of the National Association of Women Lawyers. The investiture will take place on July 18, 2005 at the organization’s annual meeting at the Waldorf Astoria in New York City at noon. The National Association of Women Lawyers is a national voluntary legal professional organization boasting thousands of individual members and dozens of law firm and law school members. Founded in 1899, NAWL is the oldest organization of women lawyers in the United States.

Ms. Fleming, who is the firm’s first chair of its white collar/corporate integrity group, is an accomplished trial lawyer who has particular expertise in complex civil litigation, white collar criminal cases, money laundering, international extraditions, securities, employment, antitrust and environmental law. She has tried more than 50 cases to verdict, most of which have been in federal courts, including in New York, New Jersey, Florida, Texas, Massachusetts, Pennsylvania, Illinois and California. Many of Ms. Fleming’s cases have been high profile, significant matters.

A frequent speaker and published author, Fleming teaches regularly at the National Institute of Trial Advocacy and at other legal symposia. Ms. Fleming serves as Trustee to the Historical Society of the United States District Court for the District of New Jersey. A resident of Closter, NJ, she is admitted to the New Jersey Bar and the New York Bar. She received her J.D. degree from Columbia University School of Law and her B.A., cum laude, from Mount Holyoke College. Ms. Fleming is the proud mother of son Daniel, 21, and daughter Caitlin, 18. She has been married to Steven John Abrams, also a lawyer, since 1980.
