DCH Attorneys Recognized as 2006 Ohio Rising Stars
Duvin, Cahn & Hutton is proud to announce that the following firm attorneys have been selected by their peers as Rising Stars: Heidi Duncan Alten, Timothy S. Anderson, Jonathan S. Forman, Barry Y. Freeman, Bonnie S. Kristan, Sherrie K. Mikhail, Shannon K. Patton, Teresa R. Pofok, Bradley A. Sherman and James P. Smith. These ten attorneys have distinguished themselves in the areas of labor and employment law; employment litigation; employee benefits or workers' compensation.

Publisher Law & Politics, which also produces the Ohio Super Lawyers annual listing, performs the polling, research and selection of Ohio's Rising Stars. To be eligible for selection, an attorney must be age 40 or younger, or in practice for 10 years or less. Only 2.5 percent of the attorneys in Ohio are selected as Rising Stars.

To complete the selection process, Law & Politics mailed a ballot to all Ohio Super Lawyers in January 2006, asking them to nominate the best up-and-coming attorneys. The Law & Politics attorney-led research team evaluates prospective candidates for indicators of peer recognition and professional achievement. Civic service and pro bono activies are also considered. Candidates are then divided according to firm size and geographic location. Only the top candidates from each group are selected as rising stars.

David B. McCormack Elected a Fellow of The College of Labor and Employment Lawyers
Buist Moore Smythe McGee P.A. is pleased to announce that David B. McCormack has been elected a Fellow of the College of Labor and Employment Lawyers.

Mr. McCormack heads the Firm's Employment Practice Group and his practice encompasses all aspects of state and federal employment law, representing employer interests. He also provides extensive advisory and counseling services in such areas as employment contracts, employee handbooks, restrictive covenants, family and medical leave, disability law requirements and sexual harassment.

Mr. McCormack received his B.A. degree from Yale University, his M.A. degree from Cambridge University, Cambridge, England, and his J.D. degree from the University of Virginia. He has been certified by the South Carolina Supreme Court as a Certified Specialist in Employment and Labor Law. Mr. McCormack is a member of the South Carolina Bar’s Employment and Labor Law Section; the American Bar Association’s Labor and Employment Law Section; the American Employment Law Council; the American Law Institute (Member of the Consultative Group for the Restatement of Employment Law); and the Society for Human Resource Management. He has been named to The Best Lawyers in America in the category of “Labor and Employment Law”. Mr. McCormack also serves on the American Arbitration Association’s Southeast Employment Mediation and Arbitration Panels. He frequently lectures on employment law topics and has published numerous employment related articles.

The College was the vision of a number of Fellows and was designed to further establish the profession in all its aspects as one uniquely important to the world of labor and employment law, individual rights, collective bargaining and dispute resolution. The College was established in 1995 through an initiative of the Council of The Section of Labor and Employment Law of The American Bar Association. Represented by over 880 members in 42 states the District of Columbia, Puerto Rico and Canada, it operates as a free standing organization recognizing those who, by long and outstanding service, have distinguished themselves as leaders in the field.

Ashurst wins Infrastructure Team of the Year at The Lawyer Awards
International law firm, Ashurst, has been named Infrastructure Team of the Year at The Lawyer Awards 2006, held on 27 June at the Grosvenor House Hotel in London.

According to The Lawyer, Ashurst has a truly impressive portfolio of top-value work across the transport, infrastructure and energy sectors, both within the UK and internationally. It was noted that the firm is consistently present on the top transactions for financing, regulatory, privatisation, franchising and commercial work, acting for the public and private sectors. In addition, the firm seamlessly moves between acting for sponsors, financiers, contractors and regulators.

It was also commented that internationally, the spread of deals across all sectors covers the full gambit of global markets and in total it was a winning effort for head of energy, transport and infrastructure Mark Elsey and his team.

Recent work includes acting for Docklands Light Railway on the Woolwich Extension project, acting for the bond funders to the Skanska/Innisfree consortium on the Barts and Royal London Hospital PFI project and acting for the Celtic Roads Group consortium on its successful tender for the N25 Waterford Bypass project in the Republic of Ireland.

Further afield, Ashurst has been advising Mitsubishi Heavy Industries on the Dubai Metro project and PIC on the recently closed Greater Equate Petrochemical project in Kuwait. The firm is also currently acting for the lenders to one of the bidders on the Shuqaiq IWPP project in Saudi Arabia.

Jason Baruch's chapter concerning the relation between not-for-profit theater companies and commercial producers will be published in in "Commercial Theater Institute Guide to Producing Plays and Musicals" by Applause Theatre & Cinema Books, in November 2006.

Former Associate Counsel To NYS School Boards Association Joins Albany Office As Senior Counsel
John A. Miller has joined the Albany office as Senior Counsel.

Mr. Miller concentrates his practice in all facets of School Law. Prior to joining the firm, he served as Associate Counsel to the New York State School Boards Association ("NYSSBA") for more than nine years. In this capacity, Mr. Miller regularly advised school superintendents, business officials, school district attorneys, district clerks and school board members on a broad spectrum of legal issues confronting school districts. While at NYSSBA, he frequently presented on a wide array of topics of concern to school districts, including religion in public schools, use of school facilities by community groups, New York's Open Meetings Law and Freedom of Information Law, school budget votes and board elections, civil rights liability, and contingency budgets. Mr. Miller is widely recognized as a leading authority on annual meetings and elections, as well as special district meetings, and has provided training sessions concerning the annual meeting and election process. He has been a contributing writer and chapter editor of NYSSBA's School Law book beginning with the 27th edition, and a Legal Editor of the School Law book beginning with the 30th edition.

Mr. Miller received his B.A. degree, with honors, from the State University of New York at Oswego in 1984 and his law degree from Western New England College School of Law in 1995.

Ashurst advised Abbey in relation to new FTSEpx Fund
Ashurst acted for Abbey Financial Markets on the provision of seed capital for the new FTSEpx Fund, an open-ended property fund intended to drive a new tradeable FTSE index.

The FTSE UK Commercial Property Index Series comprises four separate indices, constructed using performance data from the Guernsey-listed fund, which will be managed by MSS Capital.
In driving the new FTSE index, the fund will provide a facility for derivatives providers to write a property derivative pegged to the index and yet hedge all or part of their exposure by investing in the fund.

The Ashurst team was led by David Evans, head of the real estate funds group, assisted by commercial partner Clive Tucker and corporate solicitor Carl McMillan, tax partner John Watson, real estate partner Richard Vernon with solicitor Sam Lake Coghlan, and international finance solicitor Jessica Jenner. The team worked closely with Charles Shepherd of Abbey's internal legal team. MSS Capital was advised by Maclay Murray Spens, led by Gordon Brough in London.

David Evans said:

"The continued desire for exposure to investment returns from real estate assets has been a key driver of the recent growth witnessed in the property derivatives sector now that historic tax anomalies have been resolved. This product enables cheaper, faster and more flexible execution of alternative investment strategies with the unique facility of an investible index."

Ashurst's Abbey relationship partner, Clive Tucker, said:

"Although we have advised Abbey on a number of deals over the last few years, this is the most significant since Ashurst was appointed to Abbey's 'Major City Firm' panel last year. We look forward to undertaking similar work in the future".
