Article by Michelle Williams Published in Hospitals & Health Systems RX
Michelle Williams’ article, The Levinson Open Letter to Healthcare Providers, appeared in the June Hospitals & Health Systems RX, published by American Health Lawyers Association. Michelle’s article discusses the open letter from the Inspector General of the Department of Health and Human Services, Daniel Levinson, which addresses the Self-Disclosure Protocol. Michelle points out that “cooperation and the quality of a provider’s compliance program are key to a successful self-disclosure. Those providers with existing compliance programs judged to be effective by the OIG… are providers for which the OIG believes it can and will afford reasonable enforcement treatment.

Kirkland & Ellis is pleased to announce that Rajinder Bassi, a partner in the international arbitration practice in Kirkland's London office, has been selected as one of Management Today's top 35 female businesses talents under the age of 35.

West Midlands-born Bassi is an international commercial arbitration lawyer and one of the youngest to practice in her field. Her clients have included Fortune 100 companies and governments, and her pro bono activity brought her a death-row case in Trinidad & Tobago.

Connell Foley Partner Karen Painter Randall Tapped by the State and National Bar Association Leadership
Karen Painter Randall, partner and Co-Chair in the firm’s Professional Liability and Director and Officer Litigation Practice Groups, was reappointed Vice Chair of the Insurance Benefits Committee by the New Jersey State Bar Association. As Vice Chair, Ms. Randall will play an important role in helping to advance the interests of the Bar Association, the legal profession and the public, relevant to insurance benefits

Ms. Randall was also reappointed by the leadership of the American Bar Association to serve as Co-Chair, of the Director and Officer Committee, Section of Litigation, Insurance Coverage Litigation Committee.

Potter Anderson & Corroon Secures Victory for DuPont in Employment Suit
Potter Anderson & Corroon LLP is pleased to announce a jury has found for its client, DuPont, in a workers compensation retaliation lawsuit, one of only a few such cases to be tried in Delaware. The case, Robert E. Pekala v. E.I. Du Pont De Nemours and Company, Inc., was heard in the Superior Court of the State of Delaware in and for New Castle County.

In a verdict issued May 12, 2006, the jury found that the plaintiff had not proven that his on-going workers compensation claim was a factor in DuPont’s decision to eliminate his position in a 2001 reduction in force in DuPont’s Crop Protection business. The jury also found that DuPont did not breach the implied covenant of good faith and fair dealing in terminating the plaintiff’s employment. The plaintiff had alleged that he was targeted for termination because he had a workers compensation claim relating to his sensitivity to mold.

“This is a complete vindication for our client and we are pleased by the result,” said Kathleen Furey McDonough and Jennifer Gimler Brady, partners with Potter Anderson and lead trial counsel to DuPont in the case. “We consistently maintained that our client acted appropriately in its dealings with the plaintiff and are gratified to see that was recognized by the jury.

John Hardaway Chairman-Elect of US Section of International IP Organization
John B. Hardaway, III, a member of the Nexsen Pruet law firm, has been voted Chairman-Elect of the United States Section of an international group of patent and trademark attorneys.

Hardaway, who practices at Nexsen Pruet's Greenville location, was elected at the Paris Convention of the Fédération Internationale des Conseils en Propriété Industrielle (FICPI) last month. He has previously served as the Secretary of the FICPI’s United States Section and as an alternate delegate to the FICPI Executive Committee.

Hardaway, who has practiced Intellectual Property Law for 30 years, sat on a trademark panel with His Honour Judge Michael Fysh of the Queens Bench in Great Britain while at the Paris Convention. He also spoke in November on Trademark Licensing at the Lisbon, Portugal conference of the FICPI.

The FICPI is the largest Intellectual Property organization in the world. Founded nearly 100 years ago, the FICPI boasts 3800 members in 80 countries.
