William Kim joins Ropes & Gray\'s International Practice group in New York
Ropes & Gray is pleased to announce that William Y. Kim has joined the firm's International Practice group as a partner. Kim began work at Ropes & Gray on July 1.

From his office in New York, Kim will represent international companies in corporate transactions and mergers and acquisitions, among other matters. In particular, Kim will substantially enhance Ropes & Gray's ability to serve clients based in Korea and other parts of Asia.

""Ropes & Gray has made substantial inroads in the dynamic market for legal services in the Far East,"" said Cary Armistead, the co-head of Ropes & Gray's International Practice group. ""Bill brings a new dimension to our capacity to provide the complete menu of services to our clients in that part of the world.""

Kim comes to Ropes & Gray from the New York office of Alston & Bird, where, as a partner, he focused on the representation of Korean multinational companies and their U.S. subsidiaries, emerging companies, securities firms and banks. He was also called on for his expertise in legislative and public policy affecting Korean clients. Before joining Alston & Bird, Kim was the managing director and general counsel of the Daewoo Group, serving in the chairman's office in Seoul.

Kim earned an MBA degree from the Ross School of Business at the University of Michigan in 1987, four years after he completed his legal studies at the Georgetown Law Center. Kim graduated from the Catholic University of America with a BS degree in 1979. He is admitted to practice in the bars of New York, Minnesota, and the District of Columbia.

Former Pennsylvania Superior Court Judge Graci Named to Head Appellate Practice Group at Eckert Seamans
The national law firm of Eckert Seamans Cherin and Mellott, LLC today announced that the Honorable Robert A. Graci, a member of the firm’s Litigation Division, has been named to lead and expand the firm’s Appellate Practice Group.

“Bob, who served on the Superior Court of Pennsylvania from 2002 to 2004, has been tapped for this important leadership position in our firm because of the depth and diversity of his experience,” said Tim Ryan, Eckert Seamans’ Chief Executive Officer. “His work on the bench, his work as a senior member of the Pennsylvania Attorney General’s office, and of course, his work at our firm, have given him the unique credentials required to establish ours as one of the leading Appellate Practice Groups in Pennsylvania.”

Judge Graci was appointed to Pennsylvania Superior Court by Governor Mark Schweiker in 2002 and was unanimously confirmed by the Pennsylvania Senate. He received a “Highly Recommended” rating for the position from the Pennsylvania Bar Association.

Prior to that, he was the Assistant Executive Deputy Attorney General for Law and Appeals of the Criminal Law Division of the Pennsylvania Office of the Attorney General. He was a deputy attorney general for nearly 18 years, where he argued cases in all of the state and federal appellate courts in Pennsylvania, as well as the Supreme Court of the United States.

“Appellate practice requires a skill set that is distinctly different from litigators involved in the trials of civil or criminal cases,” said Ryan. “In a case on appeal, the evidence and the facts have already been presented. The appellate litigator has to be a master of the letter of the law and the process. Appellate attorneys are sometimes referred to as ‘lawyer’s lawyers,’ and that is certainly an apt description of Bob.”

The Appellate Practice Group at Eckert Seamans consists of a team of attorneys who have argued in the United States Supreme Court, virtually all of the federal circuit courts of appeals, as well as the Court of International Trade, the Army Court of Criminal Appeals and the Court of Appeals for the Armed Services, all of the Pennsylvania appellate courts, and the appellate courts of many other states.

Judge Graci is a member of the American, Pennsylvania and Florida bar associations, and the Pennsylvania District Attorneys Association. He graduated from West Chester State College with his bachelor’s degree. He earned his law degree from the University of Miami School of Law.

Philip R. Hoffman Acknowledged for Assistance in James Patterson's Best Seller: 4th of July
In 2005, James Patterson released yet another best-selling book, 4th of July, the forth book in his successful series (co-written with Maxine Paetro) featuring the Women’s Murder Club. Litigation partner Phil Hoffman, an avid Patterson reader, purchased the book and, much to his dismay, found numerous errors relating to the criminal and civil trial process and wrote a lengthy letter to Patterson about them. A few months later, Maxine Paetro contacted Hoffman and he became a legal consultant on the fifth book in the series (The Fifth Horsemen) and is now working with Ms. Paetro on two future books which have yet to be released.

In late 2005, Ms. Paetro informed Hoffman that the paperback version of 4th of July would be released in a few months and gave him the opportunity to correct the errors which had caused him to write the letter to James Patterson in the first place. Hoffman did so, rewriting, among other things, parts of the closing arguments and the jury’s verdict. In March 2006, the paperback of 4th of July was released with all of Hoffman’s changes, thus creating that rare situation where the text in the hardcover and paperback versions of the same book are different. In addition, James Patterson added a special thanks to Hoffman in the forward of the book.

Ashurst advised Barclays and SMBC as funders for the first PFI project under the BSF programme
Ashurst advised Barclays and SMBC on the £122 million senior debt facilities provided for the first PFI project under the Building Schools for the Future (BSF) programme.
Bristol City Council, the Skanska Educational Partnerships consortium and Partnerships for Schools have reached financial close on the first-ever Local Education Partnership (LEP), which has been set up to deliver the City's BSF programme.

The first phase of the partnership will see the rebuilding of Brislington Enterprise College, Hartcliffe Engineering Community College, Speedwell Technology College and Whitefield Fishponds Community School.

The Ashurst team was led by infrastructure partner Philip Vernon, assisted by infrastructure partner Jan Sanders and infrastructure senior solicitor Patrick Boyle, together with Nick Stalbow (infrastructure), Jon Ornolfsson (infrastructure), Matthew Hooton (real estate), Crowley Woodford (employment), Neil Bhan (pensions) and Sadie Fairfax (trainee).

This deal consolidates Ashurst's position as one of the leading advisers in the BSF programme. Logan Mair and Philip Vernon, lead partners in the firm's education PFI team, are acting on a number of other BSF schemes, including six at the short-listing or preferred bidder stage.

Philip Vernon commented:

"This is the pathfinder deal under the Building Schools for the Future programme and paves the way for PFI financing under the LEP structure. The PFI project reached financial close within around six months from the appointment of preferred bidder and this impressive achievement for a pathfinder deal was only managed through a very high level of commitment and co-operation on all sides of the transaction."

Allen & Overy (Andrew Fraiser) advised the Skanska Educational Partnerships consortium and Bevan Brittan (David Hunter) advised Bristol City Council.
