McCarthy Tétrault Gains Two Top Energy Regulatory Lawyers in Calgary
McCarthy Tétrault, Canada’s premier full-service law firm, announced today that Don Davies and Terry Hughes, both leading lawyers in the oil and gas regulatory area, have joined the firm as Partners in the Calgary office. They will be instrumental in the growth of McCarthy Tétrault’s oil and gas and pipeline project practice, which advises leading industry participants in Western Canada’s high growth energy markets.

Don Davies represents oil and gas producers, industry organizations, and pipeline companies in proceedings before the National Energy Board and the Alberta Energy and Utilities Board. Don has acted for proponents of various energy projects, including pipelines, oil and gas developments, power plants, and well and field facilities. He has also acted in numerous proceedings involving the determination of tolls and tariffs for oil and gas pipelines. Don is recognized as a leading Canadian regulatory lawyer. He appears in the Canadian Legal Lexpert Directory and is ranked as one of the two leading energy regulatory lawyers in Canada in the Chambers Global Directory of The World's Leading Lawyers. Don is a 1979 call to the Alberta bar.

Terry Hughes has over 25 years of experience in the energy project development, marketing and regulatory fields and has appeared frequently as counsel before the National Energy Board and the Alberta Energy and Utilities Board. Terry's energy marketing experience includes natural gas purchase, sales, storage, transportation and export arrangements, as well as to gas pricing arbitrations. The Canadian Legal Lexpert Directory recognizes Terry as a leading lawyer in energy (oil and gas) law. Terry is also a Professional Engineer and was called to the Alberta bar in 1982.

Veteran Litigator and Political Strategist Returns to Tonkon Torp
Tonkon Torp LLP has launched a new government relations and public policy practice, led by former Portlander Mark L. Cushing, who is returning to the firm after more than a decade on the East Coast.

The new government relations practice emphasizes high level strategic counsel and advocacy on federal, state and local government issues affecting private and public companies.

“Clients understand that organizational success often requires involvement in regulatory or policy action, or preventing harm from such action,” said Cushing. “Businesses should be as active in strategic public policy initiatives as they are in doing deals, but they need skilled advice to participate in this arena.”

In addition to working with clients on legislative and regulatory matters, Cushing will provide strategic counsel to organizations who seek to sell their goods or services in the government marketplace.

Cushing returns to Tonkon Torp as a partner based in Portland. He will continue to maintain an active Washington, DC practice, allowing the firm to expand its presence in that region. Most recently, Cushing was a partner in the Washington, D.C. office of Sonnenschein Nath & Rosenthal LLP, where he represented Oregon companies as well as government and private clients in Canada and the eastern U.S.

He began his public policy and legal career in Oregon in the 1970s and 80s, advising some of the state’s high profile elected officials and politicians and serving as a special assistant to the Governor. He first joined Tonkon Torp in 1983 and built a significant business litigation practice. Cushing left Oregon in 1993 for the East Coast, where he was involved in the financing and launch of two start-ups and led the buyout of a private manufacturing company.

“Mark’s unique combination of skills as a senior business trial lawyer, political strategist and former corporate executive, enable him to provide high-level strategic advice and to advocate on behalf of business clients at any level of government,” said Michael M. Morgan, chair of Tonkon Torp’s managing board. “We are delighted that he is bringing this capability back to the firm where he began his legal career.”

A native of McMinnville, Oregon, Cushing earned his B.A. from Stanford University and his J.D. from Willamette University.

Four BLB&G Partners Named to Lawdragon Magazine’s “New Stars, New Worlds
Four BLB&G Partners were named to the inaugural listing of Lawdragon’s 500 “New Stars, New Worlds.” Lawdragon, a national legal publication, selected partners Robert Gans, Blair Nicholas, Erik Sandstedt and Jerry Silk as four of the 500 “freshest faces in American law.”

Both Mr. Gans and Mr. Nicholas have served as lead counsel in some of the most significant securities fraud cases in history. Most recently, they served as lead trial counsel in In re Clarent Corporation Securities Litigation, which resulted in only the second securities fraud class action verdict in favor of investors since the 1995 passage of the PSLRA.

Of Lawdragon’s 500 “new stars,” nine were personally interviewed and profiled, allowing them to share their unique perspective on the law. One of these profiles focused on Mr. Sandstedt and Mr. Silk. Dubbed a “dynamic duo” by Lawdragon, they have each played a significant role in numerous cases at the firm, including the WorldCom and Cendant cases - two of the largest securities settlements of all time. As detailed in the publication, the cases “also resulted in a change in plaintiff tactics, seeking not just money, but changes in corporate governance.
