Leonard, Street and Deinard’s Employment Litigation team helped the St. Paul Pioneer Press achieve a favorable decision protecting its proprietary computer information and ordering its former publisher to cease work for one-year at the rival Star Tribune
Leonard, Street and Deinard’s Employment Litigation team helped firm client, the St. Paul Pioneer Press, achieve a legal victory Tuesday when a judge ruled that former Pioneer Press publisher Par Ridder knowingly shared confidential data from from Pioneer Press computer after accepting employment with competitor Star Tribune. The judge enjoined Ridder from working at the Star Tribune for one year.

Kaye Scholer's Investment Funds Practice Listed As One of Best in the UK
Kaye Scholer LLP's Investment Funds Practice was listed as among the best in the United Kingdom in the 2007 edition of the UK Legal 500. This is the first year the firm has been ranked in the UK Legal 500, which reported that the "impressive hire of Timothy Spangler and Simon Firth" has "helped cement the firm's reputation as a serious player in the market. Ellsworth Discusses New FINRA Agency at DC Bar Discussion
Jenner & Block Partner Larry P. Ellsworth moderated a DC Bar luncheon program featuring speaker Susan Merrill, Executive Vice President and Chief of Enforcement of the new Financial Industry Regulatory Authority (FINRA).

FINRA is a new self-regulatory agency for the securities industry that unites for the first time the regulatory functions of the New York Stock Exchange and the former National Association of Securities Dealers (NASD). A central question for the entire broker-dealer industry in 2007 and 2008 will be the extent to which FINRA can successfully bring together the two systems of regulation.

"Among the principal challenges for FINRA will be eliminating unnecessarily duplicative regulation by consolidating two different member rulebooks and two different enforcement systems," Mr. Ellsworth told an audience of 60 at the luncheon meeting.

The program was jointly sponsored by the D.C. Bar's Sections on Corporation, Finance and Securities Law and on Criminal Law and Individual Rights. Mr. Ellsworth is Chair of the Broker-Dealer Regulation and SEC Enforcement Committee of the Securities Law Section.

At the session, Ms. Merrill said she hopes she plans to complete a recommended organization combining the two enforcement entities by October 1, 2007 and that a completed member rulebook will be issued by FINRA by the end of 2008. "However, I don't know how realistic that time frame is," she added.

EAPD Attorneys Obtain Dismissal for Client
Christopher Healy, a Partner in the firm's New York office, along with Stephen Prignano, a Partner in the Providence office, and Renee Gallagher, an Associate in the New York office, recently obtained dismissal from the New York Supreme Court of a $20,000,000 declaratory judgment action against EAPD client, American International Specialty Lines Insurance Company (AISLIC), an AIG affiliated entity. The action sought a declaration of coverage for the much publicized May 12, 2005 retaining wall collapse on the property of Castle Village Owners Corporation, located along the Henry Hudson Highway in Riverside, New York. Castle Village was ordered by New York City to reconstruct the wall. After spending more than $20,000,000 in repairs and exhausting its primary layer of insurance, Castle Village sought coverage from AISLIC, its excess insurer. Judge Helen Freedman's ruling was based on the clear provisions of the AISLIC policy, which excluded coverage for damage to Castle Village's own property. Castle Village fought aggressively for the Court to adopt the reasoning of several pollution cases decided under New York law, which extend coverage for repairs to an insured's property (in spite of an owned property exclusion) if such repairs are for the purpose of protecting third party property damage. Judge Freedman disagreed that such cases applied, and dismissed the case against AISLIC in its entirety. Judge Freedman also made a further ruling that AISLIC's coverage denial was not untimely, and accordingly, it did not waive its right to assert the owned property exclusion.

Accounting Malpractice Case Dismissed for EAPD Client
The United States District Court for the Southern District of New York reversed a bankruptcy judge’s order and dismissed an accounting malpractice claim against Edwards Angell Palmer & Dodge client, BDO Seidman, LLP, in the bankruptcy of Suprema Specialties, Inc., a cheese company that has now been liquidated.

The court’s ruling hinged on the trustee’s failure to serve and file an affidavit of merit within 120 days of BDO’s answer as required by the New Jersey statutes. The court held that New Jersey law controlled notwithstanding the fact that the bankruptcy was pending in New York; that the affidavit of merit statute could be applied consistent with the Bankruptcy Rules; that the trustee’s failure to appreciate the fact that he was required to comply did not excuse his failure to do so; and that a settlement meeting before the litigation commenced at which the trustee’s accounting expert was present did not constitute substantial compliance with the statute. The complaint had sought damages of $175 million.
