Zuckerman Spaeder Named Top Five Litigation Boutique by The American Lawyer

Lucas A. Ferrara in New York Times Real Estate Section, PAYING TAXES WON'T GUARANTEE TITLE
Q. I am writing about the ""Your Home” column of July 2, which described a court case, an “action to quiet title by adverse possession,” in which a property owner acquired title to part of a neighbor’s property after using the land for more than 10 years. My question is this: Since the owner paid taxes on the entire property during that 10-year period, wouldn’t that be enough to guarantee his continued ownership? ... S. Lee, Manhattan

A. Lucas A. Ferrara, a Manhattan real estate lawyer, said that the ruling referred to by the letter writer was the case of Walling v. Przybylo, in which a G. Scott Walling, a lawyer, claimed title to a neighbor’s property in Queensbury, N.Y., under the centuries-old legal doctrine of adverse possession.

“In order for adverse possession to ripen into legal title in New York, the use must be actual, hostile, open, notorious, exclusive and under claim of right for a continuous 10-year period,” Mr. Ferrara said. In other words, the “adverse possessor” must be using someone else’s land without permission, without trying to hide the use and to the exclusion of the actual owner for at least 10 years.

“The fact that the owner paid all the property taxes during that time period will not be enough to defeat a claim of adverse possession,” Mr. Ferrara said. “As the Court of Appeals noted in the Walling case, the issue has more to do with who is using and occupying the property rather than who is paying the bills.

Frost Brown Todd Attorney Appointed to the University of Kentucky's Board of Trustees
Governor Ernie Fletcher today announced the appointment of Frost Brown Todd attorney Erwin Roberts, of Louisville, to the University of Kentucky Board of Trustees which is effective immediately.

“Reaching the University of Kentucky’s goal of being a top 20 public research university will take outstanding trustees to guide and direct the institution,” said Governor Fletcher. “Erwin Roberts brings the kind of talent, experience and commitment to excellence that will accelerate the University of Kentucky’s progress. I appreciate Erwin’s willingness to serve in this capacity.”

Roberts, a graduate of Transylvania University and the University of Kentucky College of Law, practices in the Firm’s Litigation department, with an emphasis on government relations and white collar crime. He is a member of the United States Army Reserve Judge Advocate General’s Corps (JAG) 139th Legal Support Organization and previously served as Personnel Cabinet secretary and director of the Office of Homeland Security for the Commonwealth of Kentucky. Roberts is a former Assistant United States Attorney for the Western District of Kentucky and a former Assistant Commonwealth Attorney in Fayette County. He previously served as a member of the FBI Joint Terrorism Task Force and coordinator of the Anti-Terrorism Advisory Council.

Cozen O’Connor Attorney David L. Ladov Named Chairman of Pennsylvania Bar Association Family Law Section
Cozen O’Connor member David L. Ladov was named chairman of the Pennsylvania Bar Association’s (PBA) family law section.

Ladov has also held the positions of treasurer, secretary, second vice chair, first vice chair and chair-elect of the family law section, which is one of the largest sections of the PBA, having a membership of approximately 600 members state-wide. Prior to his officer track, Ladov served as a member of the family law council for two terms, which were each three years in length. He has served as a programming chairman, membership chairman and various other committee positions. He currently serves as co-editor of the Pennsylvania Family Lawyer, the section’s quarterly publication which is disseminated to all members, masters and judges who handle family law cases throughout the state.

Ladov practices in the firm’s West Conshohocken office. He is co-chair of the firm’s family law practice group, concentrating his practice in all areas of domestic relations, including divorce, custody, child support, equitable distribution and abuse. Ladov is a member of the American Bar Association’s family law section, a member of the Pennsylvania Bar Foundation, and a fellow of the American Academy of Matrimonial Lawyers and secretary of its Pennsylvania chapter. He is former chair of the Montgomery Bar Association’s family law section and has been selected as a ""Pennsylvania Super Lawyer"" by his peers, appearing in Philadelphia magazine and Pennsylvania Super Lawyers. He has also been selected as one of the “Ten Leaders of Greater Philadelphia in Matrimonial and Divorce Law” for 2005-2006 by Digital Press International.

Ladov is admitted to practice in Pennsylvania and Georgia, and before the U.S. District Court for the Eastern District of Pennsylvania, the U.S. District Court for the Northern District of Georgia and the U.S. Court of Appeals for the Fifth Circuit.

A resident of, Blue Bell, Pa., Ladov earned his undergraduate degree from The Pennsylvania State University (B.A., with distinction, 1975) and his law degree from Emory University School of Law (J.D., 1978).

Boston Bar Association Announces Results of Leadership Elections
The Boston Bar Association (BBA) announced the results of its elections on July 18, 2006. Kathy B. Weinman, a partner at Dwyer & Collora, LLP, was elected to a one year term as Secretary. Other officers elected were: Jack Cinquegrana, a partner at Choate, Hall & Stewart was elected as President. Anthony M. Doniger, a senior partner atSugarman, Rogers, Barshak and Cohen, P.C. is Presidnet-Elect. Laurie Burt, a partner at Foley Hoag LLP elected as Vice-President, and Donald R. Frederico, a shareholder at Greenberg Traurig, LLP as Treasurer.

New Council members and officers will take office on September 1, 2006.

LINDABURY, MCCORMICK & ESTABROOK, P.A. AND COOPER, ROSE & ENGLISH, LLP JOIN FORCES
Lindabury, McCormick & Estabrook, P.A. and Cooper, Rose & English, LLP, have announced they will merge the two firms, effective September 1, 2006.The new firm will offer new and enhanced practice capabilities and expanded resources to service clients.

The combined firm, to be known as Lindabury, McCormick, Estabrook & Cooper, will have 64 attorneys and more than 120 employees, and will have offices in Westfield, Summit, Rumson, New York City and Philadelphia.

“This is an exciting strategic opportunity for both of our firms,” John R. Blasi, President of Lindabury, McCormick & Estabrook, said. “Our combined firm will offer enhanced and expanded legal capabilities without losing the personal attention and the quality of legal work on which the clients of both firms have come to rely.”

Former Alston & Bird Partner Robert McCallum is Named U.S. Ambassador to Australia
Robert D. McCallum, Jr. was sworn in as Ambassador Extraordinary and Plenipotentiary of the United States of America to Australia by Secretary of State Rice on Friday, July 21. He will arrive at his post in Canberra on August 18.

Mr. McCallum served as Associate Attorney General in the Justice Department, sworn into that position on July 1, 2003. Since September 2001, he had served as Assistant Attorney General for the Civil Division, the largest legal division in the DOJ with over 700 lawyers. Prior to his move to government service, he was a litigation partner with Alston & Bird. Mr. McCallum joined the firm in 1973. He received his undergraduate and law degrees from Yale University.

Mr. McCallum is the second partner from Alston & Bird to serve as the U.S. Ambassador to Australia. Philip Alston, Jr., appointed by President Carter, held the post from 1977 to 1981.
