Blog Standard Rules: Ownership and Liability of Weblogs
Providence partner John Ottaviani, who practices in the firm’s Intellectual Property Department, has authored an article entitled “Blog Standard Rules: Ownership and Liability of Weblogs,” published in the July/August issue of Copyright World. As the use of blogs (originally used primarily for personal journaling purposes) is increasing, a variety of businesses are now utilizing blogs as a form of communication with their customers or as a general marketing tool. In the article Ottaviani addresses important questions of ownership and liability that have arisen for employers and employees providing or using blogs. He examines issues of trademark and copyright claims and the legal implications of posting infringing and defamatory content to a blog. Ottaviani explains the benefits of expanding company Internet and website policies to include blogs, and taking advantage of federal laws that insulate businesses against legal claims arising from blog content posted by third parties.

Association of Trial Lawyers Honors Bieder for Helping Clients Fight for Justice in the Courtroom
A national association of trial lawyers has honored prominent Bridgeport attorney Richard Bieder for his record of fighting for justice in the courtroom on behalf of those injured by the negligence and misconduct of others.

The Association of Trial Lawyers of America (ATLA) today announced that it has presented Bieder with its inaugural David S. Schrager President's Award. The late David Schrager was Philadelphia trial lawyer and former president of ATLA.

This is Bieder’s second major award this year, having won The Connecticut Law Tribune's annual Pro Bono Award in May.

ATLA cited Bieder for ""embodying the qualities we value most in trial lawyers and dear friends -- brilliant analysis, rigorous ethics, thorough preparation, nimble wit, elegance in argument, charming manner, subtlety when called for and bold directness when needed.""
“His 37 years in the ATLA family have been devoted to its members and its mission, as he has ever been willing to take on any assignment and volunteer for any job that needs doing,” ATLA President Kenneth M. Suggs, Esq. said in his presentation of the Schrager Award to Bieder.

Bieder, a partner at Koskoff, Koskoff & Bieder, P. C. is well known for his handling of individual and class action cases resulting from mass disasters, consumer rights, personal injuries, unfair trade practices and commercial fraud and misrepresentation. He has taken on and prevailed over major insurance companies, accounting firms, manufacturers and other powerful institutions. He also prosecutes and defends actions on behalf of business clients.

He represented victims in such high-profile cases as: the collapse of the L'Ambiance Plaza building in Bridgeport, Conn.; the Dupont Hotel fire in San Juan, Puerto Rico, and investors bilked by the Colonial Realty empire. He is currently advising families of individuals killed in the Oklahoma City bombing. He helped create, and is now president of, Trial Lawyers Care, a nationwide organization that aided victims of the 9-11 terrorist attacks and continues to seek ways to aid other victims of terrorism through pro bono legal work.

Bieder is listed in The Best Lawyers in America and holds a certificate as a Civil Trial Advocate from the National Board of Trial Advocacy in which he served as its president. He is a past president of the Connecticut Trial Lawyers Association and has served as a guest commentator on Court TV.

Theodore I. Koskoff founded the firm in 1936. Today, Koskoff, Koskoff and Bieder, P. C. has offices in Bridgeport, Danbury, and Stamford. The law firm is known for serving victims in malpractice cases, cases related to accidents, civil rights, consumer matters and commercial cases.

Intellectual Property Attorney, Michael Chesal, Spearheads New Trademark Legislation
Individuals and companies in Florida will find it easier to protect their proprietary trademarks, thanks to a bill passed by the Florida Legislature with help from the Business Law Section.

HB 7017 was the first change to the state’s 1964 model trademark law since a substantive overhaul in 1990.

“One of the common questions I would get from legislators is, ‘Why do we need a state trademark law?’” said Michael Chesal, a Miami lawyer who spearheaded the section’s efforts. “Number one, not every company is a national company. There are local companies that may not be entitled to federal protection.""

“Secondly, a state registration filing can be heard in a few weeks,” while the same process through the federal system will take at least a year.

“The main reason for the bill is to better harmonize state and federal law,” Chesal added. “There have been changes in federal law over the years that we needed to catch up with.”

“This is another example of how sections of the Bar develop credibility over the years with the legislature . . . and are able to provide technical support to enact laws that are to the benefit of both business and the people of our state,” said section Chair Mark Wolfson. “This otherwise might not get done if there weren’t lawyers out there like Michael spending their non-billable time to make these laws happen.”

Chesal said the bill “gives a little more teeth to help small businesses better protect their trademarks, their names, and their intellectual property.”

The bill streamlines the application process and provides for more direction for attorneys when they file trademark applications for clients. It also allows for an administrative hearing if an application is denied, and in the event of litigation, provides for attorneys’ fees for the prevailing party.

Fees protection is important for small business, Wolfson said.

“If a big corporations says, ‘I want to put that guy out of business,’ and they come in and try to litigate them out, they will have to think twice about it because there might be a lawyer out there who thinks that mom and pop business has a good case and would be willing to defend that small business,” he said.

Other changes in the law include repealing the provision on reservation of marks, reducing the renewal period of a registered mark from 10 to five years, clarifying that security interests in a mark can be created and perfected according to the Uniform Commercial Code, and revising the dilution provision to be more consistent with federal law while keeping Florida’s “likelihood of dilution” standard.

This year, Chesal said the section worked with Miami attorney, John Malloy III, who represented the INTA’s position, for a bill that recognized changes in federal law, the proposed model law, and distinctive Florida issues.
