Attorney Peter Donati Named One of 40 Illinois Attorneys Under 40 to Watch
Levenfeld Pearlstein LLC is pleased to announce that Peter F. Donati, a partner and leader of the firm’s Employment Service Group, has been named one of the “Forty Illinois Attorneys Under Forty to Watch” for 2006 by Law Bulletin Publishing Company, publishers of Chicago Lawyer magazine and the Chicago Daily Law Bulletin .

Law Bulletin Publishing’s “40 Under 40” honors Illinois attorneys who show a passion for their profession, have had a series of successful verdicts, and above all, demonstrate a dedication and commitment to the legal profession. Honorees are chosen in a nomination process that evaluates candidates’ career achievements, advancement in their fields and community involvement.

“We are thrilled to see Peter honored as one of Illinois’ finest young attorneys,” said Bryan I. Schwartz, chairman of Levenfeld Pearlstein. “Peter’s extraordinary skill in the area of employment law and his unwavering dedication to client service, serve as a prime example of the type of lawyer that we want as our partner, friend and colleague.”

In selecting Mr. Donati for its list, Law Bulletin Publishing Company cited his work on employment and labor matters for Motorola Inc. in the company’s spin-off of its semi-conductor business, as well as his standing as one of Chicago’s “leading specialists in dealing with and coordinating the labor and employment law aspects of international mergers, acquisitions and divestitures.” It also highlighted Mr. Donati’s significant litigation successes on behalf of American Airlines, noting that in the 10 years in which he has represented the company, he has never lost a case.

Mr. Donati represents clients in a wide range of employment-related litigation, including discrimination claims, employment contract disputes, and claims involving restrictive covenants. He has appeared in state and federal courts at both the trial and appellate level throughout the country and represented clients before the EEOC, NLRB, and other government departments and agencies.

Mr. Donati also counsels clients on employment issues, prepares employment policies, drafts and negotiates executive employment agreements, and conducts training for supervisors and managers. He has particular experience helping clients to navigate difficult issues under state and federal leave laws and laws on disability discrimination and accommodation. In addition, Mr. Donati advises employers with union relationships as well as those seeking to remain union free.

Mr. Donati earned his B.S. from Cornell University in 1989 and his J.D. from the University of Michigan Law School in 1992.

HILL WALLACK LLP PARTNER FEATURED SPEAKER AT NJSBA SEMINAR
Stephen J. Hyland a partner of the Princeton law firm of Hill Wallack LLP, where he is partner-in-charge of the firm's Trusts & Estates Practice Group was recently a panelist at the New Jersey Institute for Continuing Legal Education Seminar “New Jersey Guardianship Practice – It’s Going to be a Whole New Ballgame”. Mr. Hyland gave a presentation on the Domestic Partnership Act, new changes to the probate code allowing domestic partners to be named as guardians of their partners, and contrasting New Jersey GLBT rights with other states.

Mr. Hyland concentrates his practice on estate planning and administration, elder law and domestic partnership law. Besides authoring the new book, “New Jersey Domestic Partners: A Legal Guide,” Mr. Hyland has published numerous articles on estate planning and domestic partnership law, privacy law, computer law and internet law, and is a frequent speaker on legal issues. He is an active member of various community and professional organizations, including the GLBT Rights Committee, the Real Property, Trusts and Probate Section, and the Elder Law Section of the New Jersey State Bar Association.

Mr. Hyland graduated from Pennsylvania State University with a B.S. Degree in agriculture. Following a successful career as a software engineer and technology consultant, he embarked on a career in law, receiving his J.D. degree from South Texas College of Law in Houston, Texas. He is a resident of Titusville, New Jersey and currently an LLM candidate at Temple University, Beasely School of Law.

Kelley Drye Represents Investec in $100M Acquisition of Midwest Grain Processors
Kelley Drye represented Investec Bank (Australia) Ltd in its proposed acquisition of a controlling interest in Midwest Grain Processors, LLC. The Federal Trade Commission gave antitrust approval to Investec Bank (Australia) Ltd to go forward with its acquisition of a controlling interest in Midwest Grain Processors, LLC, which recently closed. Investec Bank (Australia) Ltd is a financial services company, while Midwest Grain Processors, LLC uses fields of corn to produce clean-burning ethanol, providing an important market for farmers in Iowa and Michigan and helping to meet the growing demand for environmentally-friendly fuel and fuel additives.

Barry Pollack, Partner in the Litigation Practice Group, was quoted in an August 8th Associated Press article about the federal government's prosecution of former Enron employees. Several major publications picked up the story, including the Los Angeles Times, BusinessWeek, Forbes, CBS News, and the Houston Chronicle, as well as more than 30 local publications throughout the country.

Mr. Pollack is a noted expert on white-collar crime and won an acquittal for his client Michael Krautz, a former accountant with Enron Broadband Services.

Kelley Drye Collier Shannon Attorney Featured in Bloomberg Television Interview
John Delacourt was recently featured in a Bloomberg Television interview regarding the decision of Apotex to enter the market with a generic version of the blood thinner Plavix. Plavix is currently the second best selling drug in the world with annual sales close to $6 billion. Apotex’s decision to enter the market came as a response of the failure of Bristol-Myers and Apotex to obtain approval from the Federal Trade Commission (FTC) and a group of states attorneys general for a proposed settlement of their patent infringement litigation. Mr. Delacourt discussed the significance of the decision as it relates to consumers. In his previous position as Chief Antirust Counsel of the FTC’s Office of Policy Planning, Mr. Delacourt had extensive experience with a number of similar Hatch-Waxman cases, which addressed significant antirust concerns arising from the licensing and enforcement of pharmaceutical patents.
