Baron & Budd, P.C. Attorney Kevin D. McHargue Appointed Vice Chair of Legal Affairs Committee of the Association of Trial Lawyers of America
Kevin D. McHargue, an attorney and shareholder with the law firm of Baron & Budd, P.C., has been appointed Vice Chair of the Legal Affairs Committee of the Association of Trial Lawyers of America (ATLA). McHargue will serve a one-year term in this position beginning August 1. McHargue is a shareholder and heads the appellate section of Baron & Budd, P.C.

Scott Fisher Wins Landmark Decision
Jaspan partner Scott Fisher obtained the first ruling by a New York court to refer directly to the New York Court of Appeals’ watershed decision in Hernandez v. Robles, 2006 WL 1835429. In that case, the Court of Appeals found that laws enacted over the past 100 years evinced intent by the Legislature to limit marriage to a union between a man and a woman. Funderburke v. Uniondale U.F.S.D. was decided several weeks later by the Nassau County Supreme Court. The Supreme Court in Funderburke denied summary judgment motion to a retired Uniondale School District teacher seeking to obtain spousal benefits for his same sex spouse, whom he had married in Ontario, Canada in 2004. Scott represented the Uniondale U.F.S.D.

AmLaw’s Associate Survey: The More Things Change…
The American Lawyer has been surveying midlevel associate satisfaction at law firms for two decades — the 2006 version is just out — and this much is clear: little has improved since 1986. The overall satisfaction score was 3.7 (out of 5) in 1986; today it’s 3.78.What’s more striking is a comparison of associate gripes: A Kirkland & Ellis associate recently reported to the magazine: “[Kirkland] is asking too much of too few. No one should make the money you make on the backs of people working around the clock. Take fewer cases, hire more people.” The 1986 version of this complaint? “As [the firm] grows larger and makes more money,” reported an Akin Gump Strauss Hauer & Feld associate, “being an associate means I do not share in the increased profits . . . but nonetheless do share in the tensions and changes caused by growth.”

That said, times have changed. According to the survey, partners familiar with both eras report that associate life is more demanding than it used to be. “Today, the pace is totally different,” reported Philip “Pete” Ruegger III, chair of Simpson Thacher & Bartlett. “You used to send a letter and wait for a reply or hand-deliver a memo and wait for a reply.” Not so anymore, in a world of FedEx and email attachments.p

Oh yeah, the survey results? Once again, Rochester, N.Y.-based Harter, Secrest & Emery finished atop the rankings (must be that clean upstate drinking water); with Finnegan, Henderson, Farabow, Garrett & Dunner finishing second, and Dickstein Shapiro; Nutter, McLennan & Fish; and Munger, Tolles & Olson finishing third, fourth and fifth, respectively.

What about last year’s bottom feeders, profiled by Ashby Jones in a recent WSJ.com article? It’s a mixed bag. Proskauer Rose and Cahill, Gordon & Reindell again finished fairly low in the survey (though not at the bottom). The news was better, however, for Curtis, Mallet-Prevost, Colt & Mosle, which jumped nearly 100 slots in the rankings.

Mark D. Litvack Joins Manatt’s Los Angeles Office
Manatt, Phelps & Phillips, LLP, the national law and consulting firm, announced today that Mark D. Litvack, a prominent entertainment and media litigator and trial lawyer, has joined the firm’s Los Angeles office as a Partner. Mr. Litvack joined Manatt from Mitchell, Silberberg & Knupp, LLP.

A litigator and trial lawyer who focuses on entertainment matters and commercial disputes, Mr. Litvack has a national and international reputation for his representation of motion picture studios, media conglomerates, Internet companies and electronic game businesses in intellectual property and anti-piracy matters.

Mr. Litvack previously served as Vice-President & Director of Legal Affairs, World-Wide Anti-Piracy, for the Motion Picture Association of America (MPAA, 1998-2004). At the MPAA, Mr. Litvack worked with senior executives of MPAA member companies to coordinate and direct litigation in over 20,000 civil and criminal matters.

Mr. Litvack brings a range of long-standing relationships on the company side of the entertainment, media and game industries, and he has worked with clients such as AOL, Sony Pictures, Time Warner, Activision, Take 2 Interactive, Rockstar Games, and Vivendi Games.

Mr. Litvack began his career as an attorney for Texaco Inc. (1983-1998), where he litigated a wide range of matters involving breach of contracts, corporate disputes, antitrust, and intellectual property.

Mr. Litvack is a council member of the American Bar Association Committee on Science & Technology. He was profiled in an article titled “The Anti-Pirate: Hollywood's Legal Crusader is Coming to a Courtroom Near You,” which appeared in the Winter 2005 edition of IP magazine.

"Industry Specialists Lead Triple-X Securitizations"
In an article on insurance securitizations, Dewey Ballantine was praised for having strong practices in both general securitization and insurance work. As co-head of the Insurance Group, partner Jeff Liebmann has led the securitization team on such transactions as the MONY closed block securitization in 2002 and the $850 million RGA transaction. Insurance partner Jonathan Kelly commented on the future of XXX deals. He said that excess reserves will continue to exist but that companies will find other ways of dealing with them. He added that one alternative may be more sophisticated and longer term letters of credit.
