Elizabeth Lihn of Cooper Levenson to Participate in New Orleans Mitzvah Mission
Elizabeth Lihn will proudly participate in the New Orleans Mitzvah Mission, sponsored by the Friedman Commission for Jewish Education of the Palm Beaches and the Board of Jewish Education of Atlantic County, New Jersey.

Elizabeth will join a group of nearly thirty people who will meet in New Orleans for this memorable journey of social service. During this effort, Elizabeth will spend time on house gutting, debris clean-up and working for the Animal Rescue of New Orleans. At least one day will be dedicated to a local synagogue, doing specific cleaning of areas that hold and manage ""yarzeit"" (memorial) plaques in the synagogue.

Elizabeth's work program is being sponsored by the law firm of Cooper Levenson in Atlantic City, New Jersey, where she has been employed as a legal secretary for 20 years. She resides in Ventnor with her husband Barney and two sons, Ben and Jake.

Kelley Drye Represents Westchester One in Multi Million Dollar Sale of Office Building
Kelley Drye represented Westchester One, LLC in the sale of an 851,773 square foot office building in White Plains, NY to an affiliate of Boston-area based Beacon Capital Partners LLC, one of the largest US private real estate investment fund. The 21-story property, the tallest office building in Westchester, was sold by Bianco & Pepe, a family-owned enterprise, who had built it in 1975. The major tenants in the building were IBM, Argent Mortgage, Reuters, United Health Care and Blue Sky Studios. The deal was detailed in The New York Times, in an article reporting on Beacon Capital Partners latest acquisitions.

Right to Collect Undisputed Funds
I recently came across a court decision in which a contractor had filed a claim and the U.S. government contracting officer only allowed part of it - about $72,000. The contractor appealed, and the contracting officer said that no money should be paid out until the entire matter was resolved. The contractor filed a separate claim for the $72,000, which it felt was undisputed and payable immediately, even if the rest was going to take a while to resolve. The Board of Contract Appeals agreed with the contractor. It found that once the contracting officer found the contractor to be entitled to the $72,000, that amount should have been paid promptly. Appeal of Jacobs Engineering Group, Inc., DOE No. C-510394, 06-1 BCA ¶33210.

It is, unfortunately, not uncommon for an owner to think that if someone disagrees with part of a decision that has been made by an arbitrator, court, administrative officer or other designated decision-maker, the entire decision is on hold. As the Jacobs Engineering opinion makes clear, however, that is wrong. An undisputed part is due and payable while the remainder goes on.

Carlton Fields' website has been ranked in the top 50 in the 2006-2007 Top 250 Law Firm Web Sites in the United States by IMA (Internet Marketing Attorney). The Firm's website came in at number 31 overall.

The Appellate Practice Group's Florida Week-At-A-Glance page received ""kudos for rich and unique content"" and was regarded as ""an excellent resource that many Florida practitioners most likely access."" ""An extraordinary hyperlinked summary of select civil and criminal cases, this is the type of dedicated, resourceful content that can take a firm's presence a step further than the typical bio, practice, office genre.""

InternetMarketingAttorney.com conducts an independent survey of law firm websites based upon five criteria, including design, content, usability, interactivity, and intangibles.

"SARs and TIPs Noted in Podcast Featuring Hyland", NAFCU Today
Suspicious activity reports, the trade, industry and profession common bond and other issues of importance to credit unions were discussed in a podcast Tuesday that featured NCUA Board Member Gigi Hyland.

In a discussion on SARs, Hyland said credit unions should exercise discretion in filing these reports. She said many credit unions know their members and are aware of habits or hobbies that may seem, but are really not, suspicious activity warranting a report. “If the credit union has ... done a risk assessment on its member and knows the member’s habits, then [the situation] does not merit filing a SAR.”

Hyland also said changes in BSA enforcement could place a strain on credit unions but that there is some flexibility built in to allow for cost considerations. For example, a credit union might opt to keep records manually rather than electronically. “It depends on the credit union and whether they can afford the software. If they know their members and also know the transactions are fairly low-risk, software may not be necessary,” said Hyland.

Regarding the TIP charter, NCUA Senior Policy Advisor Gary Kohn noted that the decision to opt for this charter should be based on members’ best interests; it’s not the only charter type available. The TIP option was introduced in 2003. According to Kohn, 10 FCUs currently operate with this type of charter.

Guy Messick, of Messick & Weber, P.C., said TIPs could present service challenges. For example, he said a membership spread over a broad geographic expanse may require online services.

The podcast is a collaborative effort held to discuss issues facing the credit union system. Hosts of the podcast include Robert Rutkowski of Weltman, Weinberg & Reis Co., L.P.A.; Brian Witt of Farleigh Witt; Messick; and Gwen Baker of Venable LLC.

"CU Podcast Hits BSA and AML Topics and More", CUNA News Now
National Credit Union Administration (NCUA) Board Member Gigi Hyland and her senior policy adviser, Gary Kohn, participated this week in a ""podcast"" on credit union issues, including the revised Banker Secrecy Act/Anti-Money Laundering guide released last week by NCUA and other federal financial regulators.

The Monday podcast,--an audio broadcast suitable for playback on mobile devices and personal computers--was part of a monthly, collaborative effort intended to explore issues facing the credit union system, according to an agency release. Hosts of the information sessions include credit union attorneys Robert Rutkowski of Weltman, Weinberg & Reis Co., L.P.A.; Brian Witt of Farleigh Witt; Guy Messick of Messick & Weber, P.C.; and Gwen Baker of Venable LLC.

We discussed issues ranging from Bank Secrecy Act compliance to strategic issues facing the credit union system. The format is fairly informal, but filled with valuable discussion, debate and insight from four very experienced, knowledgeable credit union attorneys,"" Hyland said of the session.

Regarding the new BSA/AML manual, Hyland called it ""more user friendly"" and a ""better road map"" for doing risk-assessment for BSA compliance.

Other topics included a Credit Union National Association (CUNA) request to the NCUA for additional guidance for credit unions on filing Suspicious Activity Reports, and--keeping with BSA topics--how credit unions are handling the requirement to monitor structured transactions?

Widow Faces Deportation
The judgment of the court in Freeman v. Gonzales, 444 F.3d 1031 (9th Cir. 2006) became final on August 3, 2006, after the court denied the government's request to amend the judgment. The finality of the decision is welcomed by the lawyers and staff of Tonkon Torp, who have been battling the unjust interpretation of this law for over two years. The judgment is now binding on the immigration agencies in the region covered by the U.S. Ninth Circuit Court of Appeals - Alaska, Arizona, California, Guam, Hawaii, Idaho, Montana, Nevada, Northern Marianas, Oregon and Washington.
