McLane Attorney Andrea L. Daly Named Board Member of National Alliance for the Mentally Ill
Andrea L. Daly, a litigation attorney with McLane, Graf, Raulerson & Middleton, Professional Association, has been elected to the board of the New Hampshire chapter of the National Alliance on Mental Illness (NAMI NH), the nation’s largest grassroots mental health organization dedicated to improving the lives of persons living with serious mental illness and their families through advocacy, research, support, and education.

Ms. Daly's law practice focuses heavily on mental health and probate actions, including administrative proceedings before licensing boards, risk management in mental health matters, guardianship proceedings, durable power of attorney abuses and fiduciary duty challenges.

She is also a member of the Board of Governors of the Warner House Association and of the Board of Directors of Pro Portsmouth, Inc. Ms. Daly received her undergraduate degree from Boston University, cum laude, in 1991 and her J.D. degree from Vermont Law School, magna cum laude, in 1997. She currently resides in Portsmouth with her family.

Stock Options Backdating Scandal Expands with Likely Restatement of Earnings by Apple Computer
Apple Computer announced today that it will delay filing quarterly results and will likely restate past financial results after discovering more "irregularities" as part of an internal probe of stock-option grants going as far back as 1997. Sutter Health Uninsured Pricing Class Action Lawsuit
In September 2004, uninsured patients filed a class action lawsuit against Sutter Health (“Sutter”) on behalf of themselves and hundreds of thousands of uninsured patients at Sutter-affiliated hospitals in California. The Plaintiffs alleged that Sutter charged uninsured patients excessive and unfair prices for medical treatment and engaged in aggressive and unfair collections practices.
Sutter is a major California nonprofit healthcare system headquartered in Sacramento, with over 20 affiliate hospitals in its system. Sutter denied wrongdoing and liability in the case.

Court Grants Preliminary Approval of Settlement
On August 3, 2006, Sacramento Superior Court Judge David W. Abbott, granted preliminary approval to a settlement of the action. The settlement resolves the named Plaintiffs' and Class members' claims against Sutter and its affiliated hospitals.
As part of the settlement, Class members will be entitled to make a claim for refunds or deductions of between 25% to 45% from their prior hospital bills. For the next three years, Sutter hospitals have also agreed to maintain discounted pricing policies for uninsureds that will make Sutter's pricing for uninsureds comparable to the pricing for patients with private insurance. In addition, Sutter has agreed to maintain more compassionate collections policies that will protect uninsureds who fall behind in their payments.

Commenting on the settlement, Plaintiffs’ attorney and Lieff Cabraser partner Kelly M. Dermody stated, ""This settlement is groundbreaking and substantial. Sutter has effectively ended price discrimination against uninsureds and has agreed to maintain policies that will protect uninsureds from unfair collections practices going forward. We hope that other hospital systems follow this positive trend in fair hospital pricing for the uninsured.

KLA-Tencor Litigation
The law firm of Kohn, Swift & Graf, P.C. announces that a class action shareholder lawsuit has been commenced against KLA-Tencor Corporation (“KLA” or the “Company”) (NASDAQ: KLAC). The lawsuit, filed in the United States District Court for the Northern District of California, seeks damages for violations of federal securities laws on behalf of all investors who purchased KLA securities between June 30, 2001 and May 22, 2006 (the “Class Period”).

The Complaint alleges that KLA and certain current and prior officers and directors manipulated the prices of stock option grants and made materially false and misleading statements and/or omitted material facts necessary to make those statements not misleading. The Complaint alleges violations of Sections 10(b), 14(a) and 20(a) of the Securities Exchange Act of 1934, 15 U.S.C. Sections 78j(b), 78n(a), and 78t(a) and Rules 10b-5 and 14a-9 promulgated thereunder, 17 C.F.R. Section 240.10b-5 and 240.14a-9.

When the truth about the Company’s stock options backdating first emerged publicly on May 22, 2006, KLA’s stock price fell as a result, from a close of $ 45.24 per share May 19, 2006 to a close of $39.07 per share on May 23, 2006.

If you bought the securities of KLA during the Class Period, and sustained damages, you may, no later than August 28, 2006, request that the Court appoint you as lead plaintiff. A lead plaintiff is a representative party that acts on behalf of other class members in directing the litigation. In order to be appointed lead plaintiff, the Court must determine that the class member’s claim is typical of the claims of other class members, and that the class member will adequately represent the class. Under certain circumstances, one or more class members may together serve as “lead plaintiff.” Your ability to share in any recovery is not, however, affected by the decision whether or not to serve as a lead plaintiff. You may retain Kohn, Swift, & Graf, P.C., or other counsel of your choice, to serve as your counsel in this action.

Walter LaCon Appointed to State of New Jersey Committee on Character
Walter LaCon, Esquire, of Cooper Levenson has been appointed member of the State of New Jersey Committee on Character for an unexpired term ending in 2009. It is the duty of the committee on character to determine the fitness to practice law of each candidate for admission to the bar of the State of New Jersey. There are currently forty-seven members of the Committee.

Walter has been an associate with the firm for seven years. He concentrates his practice in Research and Appellate Law, handling matters of civil and criminal law at the state appellate level. Prior to joining the firm, Walter, an experienced attorney and Lieutenant Colonel in the United States Marine Corps Reserve, was using his legal skills to help facilitate the distribution of aid and rebuild the infrastructure in the war-torn region of Kosovo.
