An article published in The Record on August 5, 2006 entitled "Handshake at the heart of fraud suit" discusses a win by Sills Cummis Epstein & Gross on behalf of Steve Kalafer, the owner of the Bergen Cliff Hawks - a proposed minor league baseball team. According to the article, “The owner of the Bergen Cliff Hawks may proceed with his lawsuit alleging fraud by Xanadu developers Mills Corp. and Mack-Cali, a Superior Court judge ruled Friday.” The article continues, “According to Kalafer, the parties reached an oral agreement in September 2002 for the developers to build a 6,500-seat ballpark for his team at the Continental Arena site. The agreement was certified, he said, by a handshake with Xanadu attorney Robert DeCotiis.” “Mills/Mack-Cali executives have argued that although they intended to reach such a deal with Kalafer, no contract has ever been signed because there is no agreement.” Clive Cummis, one of the founding partners of the Firm and its Chairman, argued the motion.
