Federal Appeals Court Rules for IBM in Major Pension Plan Case
The United States Court of Appeals for the Seventh Circuit ruled today that IBM's pension plan formula is both lawful and age-neutral. The decision was the first by a federal appeals court to address the closely-watched question of whether hundreds of ""cash balance"" pension plans across the country are unlawful under an age discrimination provision in the Employee Retirement Income Security Act (""ERISA""). The decision holds that the IBM Plan, and presumably other plans like it, are not age discriminatory. The decision also avoided $1.4 billion in additional pension obligations that IBM would have incurred if the district court judgment had been affirmed. The Seventh Circuit noted that the decision whether to offer employees a cash balance pension plan ""may again be made freely, governed by private choice rather than legal constraint.""

Cash balance plans cover 25% of all participants in defined benefit plans and account for more than 40% of the assets of defined benefits plans. Jeffrey Huvelle, a partner at Covington & Burling LLP, argued the appeal on behalf of IBM; Mr. Huvelle and Robert Wick of Covington were the principal attorneys for IBM throughout the litigation; they were assisted in the case by the head of Covington's appellate practice, Robert Long, and by Covington pension practitioners John Vine, Richard Shea, and Robert Newman.

EDWARD S. HIRSCHLER MEMORIAL SEMINAR SLATED FOR SEPTEMBER
On September 19, 2006, Hirschler Fleischer, in cooperation with the Richmond Jewish Foundation, will present the Edward S. Hirschler Memorial Professional Advisors Seminar.

Shortly after Edward Hirschler’s death, the Richmond-based law firm he founded, Hirschler Fleischer, made a donation to the Richmond Jewish Foundation for the establishment of the Edward S. Hirschler Memorial Charitable Endowment Fund. The purpose of the fund is to provide annual seminars to enhance educational opportunities for legal and financial professionals.

The September 2006 seminar will focus on charitable giving in the context of estate planning. Kathryn W. Miree, a nationally recognized speaker and author on nonprofit gift planning and administration topics, will be the guest speaker. On August 7, 2006, Lauren Sorrentino’s article “Confrontation in Court (and at Home),” was published in the Pennsylvania Law Weekly. The article discusses the United States Supreme Court’s focused attention on several cases with questions of law having a profound impact on victims and perpetrators of domestic violence. The decisions in these cases highlight the difficulty of balancing a state’s need to appropriately prosecute a crime when victims are reluctant to testify against a defendant’s constitutional rights.
