Graydon Head & Ritchey Attorneys Named Cincinnati Bar Association Committee Officers
Graydon Head & Ritchey LLP is pleased to announce the following new positions currently being held with the Cincinnati Bar Association by Firm attorneys.

Stacy A. Cole has been named Co-Chair of Membership for the CBA’s Young Lawyers Section. Cole is a member of the Firm’s commercial litigation client service department, assisting clients with the efficient and just resolution of personal and business disputes.

Harry J. (Chip) Finke has been named Vice-Chair of Ethics & Professional Responsibility on the CBA’s Board-Appointed Committees. Finke is also a member of the Firm’s commercial litigation client service department and has handled cases in a variety of substantive areas, including commercial disputes, employment discrimination, real estate, lender liability and securities fraud.

Brian S. Jackson has been named the CLE Coordinator of the Real Property Law Practice Committee. Jackson is a member of the Firm’s commercial litigation client service department, with his practice primarily focusing in the areas of creditors’ rights, contested foreclosures, lender liability defense, bankruptcy, and collection and liquidation.

Katherine M. Lasher has been named Chair of the CBA’s Young Lawyers Section. Additionally, she has been appointed to the CBA Board of Trustees, Cincinnati Bar Foundation Board of Trustees and is an ABA Delegate. Lasher is a member of the Firm’s commercial litigation client service department, with her practice including labor and employment law, employment immigration law, media law, and appellate practice in both state and federal courts.

Michael R. Miller has been named Secretary of the Estate Planning & Probate Practice Committee. Miller is a member of the Firm’s personal planning industry group, with his practice concentrating in the areas of estate planning, estate and trust administration, fiduciary taxation, and business succession planning.

Daniel E. Reitz has been named the Co-Chair of Mentoring for the CBA’s Young Lawyers Section. Reitz is a member of the Firm’s commercial real estate industry group, with his practice focusing on commercial real estate law, including the acquisition and disposition of real estate, the negotiation of office, warehouse, retail and other leases, and bank financing, as well as general corporate law.

Jamie D. Scott has been named the Chair of the Employee Benefits Committee. Scott is a member of the Firm’s human resources client service department, with his practice concentrating in the areas of employee benefits and executive compensation.

Attorney Ebony L. Duff Honored Trustee of the Mariners Inn
Garan Lucow Miller, with offices throughout Michigan, announces associate attorney, Ebony L. Duff, has been named a Trustee for the Board of Directors of Mariners Inn. Mariners Inn is a non-profit organization that has a shelter and substance abuse treatment center for homeless men in the City of Detroit.

For the past two years, Ms. Duff has been volunteering her time providing legal counsel and assistance to Mariners Inn.

John Gillooly, shareholder and member of the firm’s Executive Committee, says that “this is a great honor for Ebony. She consistently goes the extra mile to serve her community in addition to her duties as an attorney and mother.”

The Mariners Inn on Ledyard Street has residential and outreach programs. Services include housing; individual counseling; and vocational, computer and literacy programs. The organization dedicates its efforts to provide compassionate care to help homeless men conquer their addiction and gain independence, health, dignity and self-esteem.

Ms. Duff graduated with her B.A. from the University of Michigan and earned her J.D. from Wayne State University Law School. She works out of Garan Lucow Miller’s Detroit office. Her areas of practice include municipal liability and civil rights.

"SEC ANNOUNCES DECISION TO FOREGO FURTHER REVIEW OF DECISION OF U.S. COURT OF
In a statement issued Monday, August 7th, SEC Chairman Christopher Cox announced the agency’s decision not to appeal the June 23, 2006 ruling of the U.S. Court of Appeals for the D.C. Circuit, which struck down recent SEC regulations that required managers of hedge funds to register as investment advisers pursuant to the Investment Advisers Act of 1940, as amended (the “Advisers Act”), noting that “further appeal would be futile and would simply delay and distract from [the agency’s] goal of advancing investor protection.”

Chairman Cox’s statement went on to state that the agency will be advancing several new proposals in the near future aimed at regulation of hedge funds, including a new anti- fraud rule under the Advisers Act that will feature a look through provision to extend anti- fraud provisions under the Advisers Act to individual investors in hedge funds and possible amendments to the qualification standards for individual investors in hedge funds. At present the form and effect of any such new proposals remains unclear. In addition, the adoption of hedge fund legislation by Congress remains a possibility. Foley Hoag will continue to monitor the situation and advise its clients on any further developments.

Richard Block and Sanford Schlesinger Named by Peers to “Best Lawyers in America” Listing
Dreier LLP is pleased to report that Richard H. Block and Sanford J. Schlesinger were named among the “Best Lawyers in America” listing which was published in the August 1, 2005 issue of New York magazine.

Mr. Block was recognized for his expertise in labor and employment law. He is chair of Dreier LLP’s labor and employment practice known as The Employment Law Group of Block Bernstein & Lagasse.

Mr. Schlesinger, who has been on the annual listing previously, was again recognized for his expertise in trusts and estates. He is founding partner of the law firm Schlesinger Gannon & Lazetera LLP, an affiliate of Dreier LLP. He is also a former Adjunct Professor of Law at New York Law School and at the University of Miami Law School and a former Adjunct faculty member at Columbia University School of Law.

SUSAN WHEATLEY SELECTED FOR LEADERSHIP CINCINNATI USA PROGRAM
Susan E. Wheatley, a partner in the Tax, Probate and Estate Planning Department of Taft, Stettinius & Hollister LLP, has been selected for the 2006-2007 Leadership Cincinnati USA program sponsored by the Cincinnati USA Regional Chamber of Commerce.

Wheatley, a resident of Anderson Township, is co-chair of the firm’s Estate Planning Practice Group and co-chair of the firm’s Family Business Practice Group. She is chair of the Estate Planning and Probate Committee for the Cincinnati Bar Association and serves on the Subcommittee on Gift Planning of the University of Cincinnati Foundation She also is co-founder and co-leader of the Walnut Street Poetry Society of the Mercantile Library in Cincinnati, and serves on the library’s Board of Directors. She is a member of Impact 100, Inc. and a member of the firm’s Professional Women’s Resource Group (PWRG).

Wheatley received her undergraduate degree from Yale University and law degree from Northwestern University School of Law, where she served on the Northern University Law Review. She has taught estate planning as an adjunct professor of law at the University of Cincinnati College of Law. She is chair to the Estate Planning and Probate Committee of the Cincinnati Bar Association and serves on the Liaison Committee to the Hamilton County Probate Court. SCHIFF HARDIN'S JEFFREY S. JACOBOVITZ BECOMES VICE-CHAIR OF THE CRIMINAL PRACTICE AND PROCEDURE COMMITTEE OF THE ANTITRUST SECTION OF AMERICAN BAR ASSOCIATION

STATEMENT BY MILBERG WEISS BERSHAD & SCHULMAN LLP ON SECOND CIRCUIT COURT OF APPEALS AMEX DECISION
Milberg Weiss Bershad & Schulman LLP is pleased that Second Circuit Court of Appeals yesterday (August 7, 2006) issued a decision vacating an earlier judgment by the United States District Court for the Southern District of New York that dismissed an amended class action complaint against American Express Co. (Amex) and Amex officials. The decision by the Court of Appeals will allow the lead plaintiffs to amend their claims in this important case.

""We are gratified that the Court of Appeals ruling will allow us to seek recovery for our clients on the basis of the merits of this case,"" stated Sanford Dumain. ""By agreeing with plaintiffs that the amended complaint against Amex and Amex officials is not barred by the statute of limitations, the Court of Appeals has facilitated a new and full hearing on allegations brought against the company and company leadership. These allegations include that Amex failed to disclose its true operating results, its lack of management controls, and its huge losses suffered in risky junk bonds during the time period concerned,"" added Dumain.
