OMM Represents Abounding Grace Ministries in Property Dispute
Attorneys in O'Melveny's New York office successfully represented Abounding Grace Ministries, Inc. (AGM), a nonprofit religious organization, on a pro bono basis. The O'Melveny team was able to help AGM out of a difficult legal predicament in New York Supreme Court.

AGM entered into a contract with an individual, Giovanni Curra, to sell its real property in Delaware County. As a nonprofit organization, AGM needed the approval of the New York State Attorney General to convey the property. Due to unanticipated issues with the Attorney General's office that delayed the closing, Curra filed suit to compel AGM to convey the property. AGM then filed a motion to dismiss Curra's complaint. Before the return date of that motion, New York Lawyers for the Public Interest referred the case to O'Melveny.

A team including New York counsel Joshua Schwartz, associate Bingna Guo, and then-counsel Abbey Walsh negotiated an extension of the return date and the date to file AGM's reply brief. They then investigated the facts of the case, including the circumstances surrounding the delay in the Attorney General review process and the merits of the lawsuit.

After its investigation, the O'Melveny team determined that AGM had not properly valued certain assets on its financial statement. After the client met with its accountant to correct those errors, the team then negotiated a further extension of the return date on the motion, giving AGM time to obtain the Attorney General's approval for the sale. With the new financial statement, AGM obtained approval to convey the property.

On June 21, 2006, AGM conveyed the property to the plaintiff. At the closing, the plaintiff signed a General Release and Stipulation of Discontinuance with each party bearing its own costs to conclude the litigation. The O'Melveny team also worked with AGM's pro bono real estate counsel, Katten Muchin Rosenman LLP, which handled the closing. Tanc Schiavoni was the supervising partner on the case. The team was also ably assisted by Francisco Rosa, Keith Whitman, and the Managing Attorney's office.

According to Joshua Schwartz, ""This was a very rewarding experience for our team, both because we were able to assist AGM in selling its property and because we were able to end the litigation and help them focus on their mission of serving Manhattan's neediest."" Pastor Rick Del Rio, AGM's founder, expressed his appreciation for the services provided by O'Melveny: ""It is a joy to know that people like you who value compassion and service populate some of our city's best law firms.
