Lori Chesser to participate in Immigration Summit
Davis Brown attorney Lori Chesser presented at the Immigration Summit, "Preparedness for Change" at the Des Moines Botanical Center August 10th along with two other national speakers. The Summit was focused on national and local advocacy for reform of the current immigration laws, and the effect of changes should current proposals be enacted. Jenny Levy from the American Immigration Lawyers Association and George Goehl form the Center for Community Change were also featured.

Cooper Levenson Opens New Office in Newark and Welcomes Lead Attorney C. Lawrence Crump
Cooper Levenson welcomes C. Lawrence Crump Of Counsel as lead attorney in our newly opened office in Newark, New Jersey. Larry, a lifelong resident of Newark, comes to us from Ezeilo & Crump, P.C. Prior to this, he also completed a clerkship for the Honorable Judge F. Michael Giles, J.S.C. in Essex County. He specializes in Real Estate, Zoning, Land Use, Personal Injury and Workers Compensation.

Larry is involved, and speaks regularly, in various civic and religious organizations including the Bethany Baptist Church in Newark where he was the youngest person ever elected to the Board of Trustees, eventually serving as Vice-Chair. Among his many other community activities, he is a Fellow with Project Leadership, a United Way program, and a board member for University Heights Charter School. He has served on the Community Advisory Board of United Hospital in Newark, and has volunteered his time for Self Help and Resources Exchange (SHARE). He is the former Secretary for the Garden State Bar Association, and former Chair of its Young Lawyers Division. Additionally, he is a former board member for Tri-City Peoples Corporation, and President of the Northern New Jersey Morehouse College Alumni Chapter. While in law school, Larry served as the National Executive Director of the National Black Law Students Association, which presided over all
Black law student associations around the country.

A graduate of Morehouse College (Banking and Finance 1991) and Rutgers University School of Law Newark (J.D. 1998), Larry was admitted to the bar in New Jersey in 1999.

UNION CONTRACT AUTOMATICALLY RENEWED DESPITE ONGOING BARGAINING
The United States Court of Appeals for the Second Circuit in Long Island Head Start Child Developmental Services, Inc. v. NLRB vacated an NLRB order that, among other things, had dispensed with the normal contract termination notices. The employer and the union had a provision in their contract that caused the contract to renew for a year automatically unless notice of termination was issued. That union contract had renewed several times for lack of notice. The parties, however, started negotiating in late 2003, with the contract set to expire in May 2004 (unless it automatically renewed again). The NLRB had found that the employer and union were bargaining and, so, strict compliance with the requirement for notice to terminate the collective bargaining agreement was waived. Consequently, the NLRB had held that the employer's unilateral change in health insurance carrier, which was permitted under the union contract, was improper without bargaining. The Court, however, found that "[a]t no point did either party express an intent to suspend the operation of the evergreen clause [which automatically renewed the union contract]." The Court concluded that the prior NLRB cases finding that "ongoing negotiations suspend the forms and conditions of notice (timeliness and a writing); but [does] not speak to whether the conduct of negotiations dispenses with the need for any manifested notice of intent to terminate." [Emphasis in original.] Because the NLRB did not satisfactorily explain why the rule dispensing with forms and conditions of notice should be extended to the giving of any notice, the Court vacated the NLRB's decision and remanded the case to the NLRB for further proceedings.

JAMES PARSONS APPOINTED TO KENTUCKY SCHOOL FACILITIES CONSTRUCTION COMMISSION
James E. Parsons, Of Counsel in the Northern Kentucky office of Taft, Stettinius & Hollister LLP, has been appointed by Governor Fletcher to serve on the Kentucky School Facilities Construction Commission.

Parsons, a resident of Newport, received his J.D. from Salmon P. Chase College of Law of Northern Kentucky University, where he currently serves as an adjunct instructor in the Public Administration Department, teaching Executive Management and Urban Administration. Parsons is board chairman for the Newport Housing Development Corporation and serves as a board member for OKI, Northern Kentucky Drug Strike Force, Boone County Extension District and Northern Kentucky Independent Health District. For the past seven years, he has also served as the Boone County Administrator.

His memberships include the Kentucky Bar Association, Northern Kentucky Bar Association and Northern Kentucky City-County Management Association. He was the Assistant Law Director, Law Director and City Manager for the City of Newport.

CDRH In Hiring Mode, But Its PMA Stretch Goals Remain Elusive
At the 12th annual meeting of the Medical Device Manufacturers Association, two Finnegan Henderson lawyers spoke at a session that addressed intellectual property concerns. Les Bookoff discussed rules changes that the PTO is considering. Bookoff characterized these changes as “very significant…some of the most radical changes ever seen.” Bookoff recommended that firms with pending applications try to push them through so as to avoid putting their patents under the new rules. Barbara McCurdy reviewed some of the legal entanglements in the area of client/attorney communications that arise when companies clash over patents. She said that while such communications are generally privileged, the privilege might not apply when the opinion is produced in litigation, especially in light of the Echostar Communications case.
