REAL ESTATE ATTORNEY JOINS LATHAM & WATKINS IN ORANGE COUNTY
Latham & Watkins LLP1 is pleased to announce that Steven Otto has joined the firm as of counsel in the firm's Finance Department and Real Estate Practice Group, based in the Orange County office. Otto's practice primarily focuses on real estate, particularly the representation of clients in the acquisition, joint venture, development, leasing and sale of commercial, industrial and residential projects.

Otto was a partner at Luce, Forward, Hamilton & Scripps LLP in San Diego where he was a member of the Real Estate Practice Group for six years.

“Steven adds additional depth to our real estate finance group and provides clients with strong and diverse experience across a range of matters,” said Virginia Grogan, Office Managing Partner of Latham & Watkins Orange County.

David Meckler, Chair of the Orange County Finance Department, commented: “The real estate sector in the United States continues to be characterized by dynamic and challenging transactions. Otto said he was attracted by the opportunity to apply his experience at a firm that has advised such notable clients as Health Care Property Investors, Harrah's Entertainment, Pulte Homes Corporation, BRE Properties, Inc., and PS Business Parks, L.P. “Latham has clearly established a strong real estate practice, and I am excited about the opportunity to help the group in its continued growth,” said Otto.

Otto also has served as a member of the Executive Committee of the State Bar of California, Real Property Section (2004-2006). He is a graduate of the U.S. Naval Academy and the George Washington University Law School.

Denise Wheeler and Ceci Berman Named to Gulf Coast Business Review’s 40 Under 40
"Fowler White Boggs Banker is proud to announce that Denise L. Wheeler and Ceci Berman have been named to Gulf Coast Business Review’s 40 Under 40.

Ms. Wheeler is the managing shareholder of Fowler White Boggs Banker’s Fort Myers office and is a member of the firm’s Employment Group. Ms. Wheeler concentrates her practice in the area of management representation in all types of federal and state employment litigation and before administrative agencies involving discrimination law, employment contracts, employee benefits (ERISA), union/management matters, minimum and overtime wage issues, OSHA matters, general personnel matters, counsel management in preventive measures, liability avoidance, and compliance with federal, state, and local employment laws.

Ms. Berman is an associate in the firm’s Tampa office and practices in the Appellate Practice Group where she concentrates her practice in all aspects of federal and state appellate litigation, with a focus on commercial litigation appeals. She also handles bankruptcy and family law appeals.

Duane Morris Attorneys Help Secure Financing for San Diego Natural History Museum
When the San Diego Natural History Museum decided to feature the Dead Sea Scrolls as a major exhibition in 2007, its leaders realized that they needed to secure funds for the purchase and installation of special climate and ventilation systems to properly protect the scrolls from deterioration. The museum turned to Duane Morris, where lawyers led by Philadelphia partner David Flynn were part of an advisory team that helped the San Diego Natural History Museum secure $1.3 million in bond financing.

David, along with fellow Philadelphia partner Dianne Meyer, chair of the firm's Commercial Finance Practice Group, and San Diego partners Mikel Bistrow and Stuart Sorenson, worked with several other advisors to help negotiate a tax-exempt financing with both the California Infrastructure and Economic Development Bank and Wells Fargo. The newly acquired funds will allow the museum to upgrade the environmental control systems for its permanent exhibits and will enhance its ability to host other high-profile artifacts with similar environmental requirements.

""This is an exciting project for the San Diego Natural History Museum,"" said museum executive director Dr. Michael Hager. ""The upgrade to our environmental systems will have a long-lasting impact on the museum. The financing transaction was complex, and could not have been completed without the help provided by Duane Morris and our other advisors.""

Founded in 1874, the San Diego Natural History Museum is the oldest scientific institution in southern California. Through programs, exhibitions and collaborative scientific research, the museum aims to educate the public on and promote the study of regional and global natural history. The Dead Sea Scrolls exhibition will run from June 29, 2007, to December 31, 2007.

Former FTC Chief of Staff Maryanne Kane Joins O'Melveny & Myers
O'Melveny & Myers LLP announced today that Maryanne Kane joined the firm as Of Counsel and will be resident in the firm's Washington DC office. Until recently, Ms. Kane served as Chief of Staff to Federal Trade Commission (FTC) Chairman Deborah Platt Majoras. Ms. Kane has joined the firm's 75 lawyer Antitrust/Competition practice, which is co-chaired by former FTC Chairman Timothy J. Muris and Richard G. Parker, a former Director of the FTC's Bureau of Competition.

About Maryanne Kane

Ms. Kane served as Chief of Staff for two FTC Chairmen, first for former Chairman Muris from January 2003 to August 2004, and then for Chairman Majoras from August 2004 through April 2006. In this role, Ms. Kane was a key advisor to the Chairman and the Commission on congressional, budget, personnel, management, and strategic planning issues. She helped direct the agency's senior staff in implementing the Commission's antitrust and consumer protection initiatives, including those in the law enforcement, policy, and education arenas. Of particular note, Ms. Kane helped guide the agency's consideration and implementation of the National Do Not Call Registry. She also helped formulate the agency's responses in the continuing congressional debates over petroleum pricing, and she was instrumental in managing the development and issuance of key FTC reports addressing the interface between competition and patent law and policy, the injection of a stronger dose of competition into the development of health care policy, and the evaluation of the factors that affect gasoline pricing.

Ms. Kane joined the FTC's Bureau of Consumer Protection in 1978 and worked on advertising cases, particularly those involving food and drugs. In 1984, she moved to the FTC's Office of the General Counsel, where she focused on a broad array of legal issues, and devoted particular attention to congressional matters. Ms. Kane developed the legal support for the Commission's legislative agenda and helped to establish an effective and productive working relationship between the FTC and the Congress. In 1992, she received the FTC Chairman's Award for outstanding work in this area. She was a principal architect of the legislative proposals that, in 1994, provided the foundation for the FTC's reauthorization and also for the Telemarketing Fraud and Abuse Prevention Act. She also contributed significantly to the development of legislation affecting various market sectors, including energy and financial services.

Ms. Kane graduated with honors from Rutgers University in 1970, and received her J.D. from Georgetown University in 1973. She is a member of the Bar of the District of Columbia. She is also a member of the American Bar Association's Antitrust Section.

Fulbright Partner Represents Motiva Enterprises in Refinery Expansion
Fulbright partner Greg Barker represented Motiva Enterprises LLC (a limited liability company owned by Shell Oil Company and Saudi Aramco) in the negotiation and preparation of an engineering, procurement and construction contract between Motiva and a joint venture between Bechtel Corporation and Jacobs Engineering.
The contract involved a $4 billion expansion and renovation of Motiva’s 325,000 barrels per day crude oil refinery in Port Arthur, Texas.

This project will be one of the largest refinery expansions ever in North America. The potential expansion could bring much needed supplies of fuels to the United States.

Motiva Enterprises LLC refines, distributes and markets oil products in the eastern and southern United States. Headquartered in Houston, Texas, the company refines and markets gasoline to approximately 7,700 Shell-branded gasoline stations.
