Laura Beth Miller Named Chair of Brinks Hofer Gilson & Lione's International Trade Commission Group
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S., is pleased to announce that Laura Beth Miller has been named Chair of the firm's International Trade Commission (ITC) Group. The ITC group represents clients in section 337 proceedings before the International Trade Commission. That section provides protection against unfair trade practices involving patent, trademark and copyright infringement.

Ms. Miller is a skilled litigator with experience in intellectual property law and commercial litigation, including antitrust, contract, product liability, RICO actions and bankruptcy law. She received her B.A. from the University of Virginia and her law degree from The College of William and Mary, Marshall Wythe School of Law. She has been recognized as one of Illinois' leading intellectual property lawyers by Chambers USA for the past three years and as an Illinois ""Super Lawyer"" in intellectual property litigation for the past two years. She is an Adjunct Professor at The John Marshall Law School, Chicago, Illinois.

""I have focused on this area of law throughout my career and I'm honored by this appointment,"" said Ms. Miller. ""My goal as chair of the ITC Group is to play a central role in the growth of the group and to continue protecting our clients' interests in ITC proceedings.""

Notably, in January 2006, Ms. Miller and several members of the ITC Group, including Gary Ropski, Thomas Filarski, Charles McMahon, Ray Ricordati and Timothy LeDuc, won a landmark ruling in a Section 337 enforcement proceeding on behalf of their clients, ZF Friedrichshafen AG and ArvinMeritor, Inc., distributors of the FreedomLine™ heavy duty truck transmission systems. The complainant had sought penalties in excess of $40 million, all of which were denied. This is believed to be the first time in the 75-year history of the ITC's Section 337 investigations that an administrative law judge has ruled for a respondent in an enforcement proceeding.

In another recent case, Brinks attorneys obtained a limited exclusion order for a patent owner, Flexsys America L.P. At issue were patents covering a process for preparing chemicals and intermediate compounds used in the manufacture of rubber products that prevent premature degradation of the rubber from exposure to sun, heat, ozone and other environmental factors. Brinks successfully defended against invalidity and unenforceability defenses, while proving a case for infringement.

Brinks attorneys also successfully defended their client in a temporary exclusion proceeding before the ITC. The ITC complaint alleged that the respondent had infringed a patent for home vacuum sealers. Following a multi-day evidentiary hearing, the administrative law judge rejected the complainant's request for a temporary exclusion order.

McCollum and Alexsy of Pepper Hamilton Appointed to US Bankruptcy Court's ECF Subcommittee
Hannah McCollum, an associate in the bankruptcy and reorganization practice at Pepper Hamilton LLP, and senior paralegal Mary-Ellen Alexsy have been appointed to the Electronic Case Filing (ECF) subcommittee of the U.S. Bankruptcy Court of Eastern Michigan Rules Committee.

The ECF subcommittee recommends changes to the local Bankruptcy Rules and administrative ECF procedures in an effort to improve system efficiency and effectiveness, as well as to improve the alignment of the rules and procedures with practices under the ECF system.

Pepper has been practicing in downtown Detroit since 1979, and was one of the first national law firms to enter the Detroit market. Lawyers in the office handle bankruptcy and reorganization, corporate and securities (including venture capital and SBIC), environmental (litigation and regulatory), labor and employment, litigation, public finance, real estate and tax matters. Fannie Mae Deputy General Counsel Joins Latham & Watkins
Latham & Watkins LLP1 is pleased to announce that Donald Remy will join the firm's Washington, D.C. office as a partner in the Litigation Department effective September 1, 2006. Remy joins Latham from Fannie Mae where he has served as the Senior Vice President, Deputy General Counsel and Chief Compliance Officer.

Prior to joining Fannie Mae, Remy served as Deputy Assistant Attorney General of the United States with responsibility for the daily management and leadership of the Torts Branch of the Department of Justice. During his tenure at the Department, Remy also served as head of the Civil Division's Federal Programs Branch and as the Senior Counsel for Policy.

From 1991 through 1995, as a Captain in the United States Army, Remy held the positions of Assistant to the General Counsel of the Army, Special Counsel to the Secretary of Defense, and Special Assistant to the Deputy Undersecretary of Defense.

“Donald is an impressive, highly-respected counselor who has a unique and pervasive presence in the Washington legal community, and we believe Latham will benefit tremendously from this experience,” stated Eric Bernthal, Office Managing Partner of Latham & Watkins in Washington, D.C. “His judgment, spirit and enthusiasm will make him a terrific colleague.”

Thacher Proffitt ranked first for number of deals for all US debt, equity and equity-related deals on the issuer side in an article, "McKee Nelson, Sidley Austin rise to top of deal and equity leagues," published in The Lawyer. Thacher Proffitt was also acted on 77 deals totalling $44 billion for US mortgage-backed securities.

Guillermo Aguilar-Alvarez Named Partner in Weil, Gotshal & Manges LLP’s New York Office
Weil, Gotshal & Manges LLP is delighted to announce that Guillermo Aguilar-Alvarez has joined the firm as a partner in the Litigation/Regulatory Department and will be resident in the New York office.

Mr. Aguilar-Alvarez’s practice is devoted to international arbitration.
