Dennis P. Hawkins Joins Husch & Eppenberger's General Business Litigation Practice Group
Husch & Eppenberger, LLC proudly welcomes Dennis P. Hawkins as an Associate Attorney in the firm's General Business Litigation Practice Group.

Mr. Hawkins concentrates his practice in commercial litigation matters, including breach of contract and secured transactions. Prior to joining Husch, Mr. Hawkins practiced with another Memphis law firm. He served as an Assistant District Attorney General in Memphis' Thirtieth Judicial District before joining private practice.

Mr. Hawkins earned his J.D. from the University of Mississippi School of Law in 2002. He graduated with a B.A. in English Language and Literature from the University of Virginia in 1998.

Husch's General Business Litigation Group handles a range of complex litigation matters, including but not limited to, breach of contract, commercial and lender liability, antitrust, insurance coverage, class actions, land use and real estate disputes. Husch has handled significant business litigation for major corporate clients across the country. The Group has approximately 150 attorneys, with substantial jury and bench trial experience in federal courts, state courts and arbitration forums nationwide.

Women Snared by Life-Science Practices
There has been a growing concern among law firms that women lawyers are leaving in greater numbers than men, leaving fewer in the partnership pool. But those women who have deep scientific backgrounds appear to be the exception. They not only stay in firms, but thrive, finding success in the form of partnerships and peer recognition. A large chunk of female partners at some firms are biotech and life-science attorneys. Out of the 24 female partners at Finnegan Henderson, 11 are from its biotech and life-science practice, which has about 123 attorneys.

Dickinson Wright Names New Governing Board Members
Dickinson Wright PLLC recently announced the newest members of the Firm's Governing Board. Newly elected to the board is Michael C. Hammer of the Ann Arbor office. Members reelected include William E. Elwood of the Washington D.C. office, Thomas D. Hammerschmidt of the Ann Arbor office, W. Anthony Jenkins of the Detroit office and Kester K. So of the Lansing office. All members will serve two-year terms expiring June 30, 2008.

The newly elected and reelected members join current Governing Board members Daniel F. Gosch, Kathleen A. Lang, Edward H. Pappas, and James A. Samborn, also the Firm's Chief Executive Officer.

The Board holds policy and strategy meetings once each quarter, working closely with the Firm's Management Committee to develop long-term plans and growth objectives. ""The Governing Board members serve as the representatives of the Firm's membership. They provide an important role not only as visionaries for the direction of Dickinson Wright, but also as spokespersons for the membership,"" said Mr. Samborn.

Frank G. Dunten Joins Dickinson Wright
Dickinson Wright PLLC is pleased to announce the addition of Frank G. Dunten as a new corporate attorney in Grand Rapids. Mr. Dunten is joining Dickinson Wright as a Member from Varnum, Riddering, Schmidt & Howlett LLP in Grand Rapids where he served three terms as a Member of that firm's governing board and, most recently, as chair of the firm's finance committee.

Mr. Dunten is considered one of the leading corporate attorneys in West Michigan. He was recognized as one of West Michigan's Best Lawyers in the 2006 issue of Grand Rapids Magazine and was named as West Michigan Legal Professional of the Year in 2006. He has been on the list of the Best Lawyers in America every year since 1995. He has served as general counsel to a variety of businesses and organizations throughout West Michigan.

Mr. Dunten is an attorney and certified public accountant and a member of the American, Michigan, and Grand Rapids Bar Associations. He served on the Tax Council of the Michigan Bar Association and as Treasurer of the Grand Rapids Bar Association. He received a B.S. in Accounting, with high distinction, from Indiana University and a J.D., cum laude, from the University of Michigan Law School where he served on the Michigan Law Review.

Mr. Dunten currently serves as secretary to the Boards of Goodwill Industries of Grand Rapids and Davenport University. Mr. Dunten and his wife, Jennifer, reside in East Grand Rapids where their children, Jennifer, Jacqueline, Katherine and Daniel will be seniors in high school this fall.

Mark Jarboe and Thomas Vander Molen Suggest Recent IRS PILOT and Tribal Rulings Are Inconsistent With Each Other
Dorsey partners Mark Jarboe and Thomas Vander Molen suggest in a Bond Buyer article that a recent IRS PILOT (payments-in-lie-of-taxes) ruling is inconsistent with the agency's position on Indian tribal bonds. In the ruling, the IRS green-lighted more than $1 billion in debt to be used by a city agency to help Major League Baseball's New York Yankees and the New York Mets build new stadiums.

Vander Molen said the IRS has denied similar tax-exempt status to Indian bonds for tribal golf courses and hotels under the argument that the facilities were intended for tourists. Yet in the stadium financing rulings, the IRS stated that the tourism-promoting qualities of the stadiums would satisfy the ""public purpose"" requirements for governmental bonds. ""There is a disconnect there,"" said Vander Molen.

Jarboe continued that in the stadium ruling, the IRS acknowledged clearly commercial activities of state and local government as essential public functions. ""Yet when they turn to the tribes, which have the same essential government function language, they say 'nothing that's commercial can qualify',"" he said. Vander Molen concluded that the IRS ""ought to be equally open-minded about tribal financings and recognize that ... the test in the statute is whether it's a function that's customarily performed by governmental units.

Wall Street Journal: The British Way
Washington, D.C., partners David Rivkin and Lee Casey authored an opinion column for the August 14 edition of the Wall Street Journal titled, ""The British Way.""

Rivkin and Casey, who served in the Justice Department during the administrations of Ronald Reagan and George H.W. Bush, focus on the recent British pre-emption of an Islamicist plot to destroy up to 10 civilian airliners over the Atlantic Ocean, which, according to the authors, ""Proves that surveillance and other forms of information-gathering remain an essential weapon in prosecuting the war on terror.""

Rivkin and Casey continue: ""Despite this self-evident truth, critics of President Bush and the war on terror have relentlessly opposed virtually every effort to expand and improve the government's ability to gather the type of information needed to detect and prevent terrorist attacks.""

The authors go on to consider ""some of the aspects in which the U.S. and U.K. antiterrorism systems differ, and what lessons can be learned."" They detail the differences in criminal investigations, profiling, privacy, secrecy, and international intelligence gathering, noting that, ""British law, political culture and sensibilities appear to be far more attuned to the practical needs of preventing terrorist attacks than do their American counterparts.""

Rivkin and Casey conclude: ""The United States cannot, of course, adopt all aspects of the British system; our constitutional systems are really quite different. Nevertheless, there are clear lessons that can be drawn from the British experience--especially in affording the police greater investigative latitude and in accepting some compromise of privacy in exchange for a greater security.
